HomeMy WebLinkAbout2828 OrdinanceORDINANCE NO calc,8 \AN ORDINANCE relating to traffic and adding a new section to Chapter 044 of the Pasco Municipal Code THE ORDAIN AS 17'Y COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO LLOWS: Section 1. There is hereby added a new §1044 080, to Chapter 10 44 of the Pasco Murucipal s de to read as follows 10.44.080 'UISING. (a) No person may cruise, or permit a motor vehicle in his care, custody or control to be used for cruising in or around posted "No Cruising" area (b) The Police ef or his designee shall determme when an area has become so co ,gested by traffic as to present a danger of traffic congestion, obst ction of streets, sidewalks or parking lots, impediment of acces to shopping centers or other buildings open to the public, or in rference with the use of property or conduct of business in the ea adjacent thereto or that emergency vehicles cannot respond in tha area within a reasonable penod of time The Police Chief or his designee shall then direct that the no cruising signs shall be erecte • or installed and maintained until the congestion has lessened to an accep bible degree (c) At reasonable points along a a no cruising area there shall be p Cruising" areas ublic street to be designated ted signs which say "No (d) A traffic control point as used m is section means any point or points within the no cruising ar established by the Police Department for the purpose of morutonng crui ing (e) No area shall be permanently designated • posted as a no cruising area except upon the passage of a r olution by the Council (f) In determining whether a person is cruising, court may consider not only the conduct of the driver and his pas ngers, but the traffic conditions at the time and the conduct of o r dnvers and passengers as well as pedestrians on or adjacent to th public way The court shall consider such factors as whether or ot the vehicle has passed a traffic control point in the same direction within a two-hour period, whether or not the vehicle has stoppe in the roadway or slowed to a speed of five miles an hour below e speed limit for any appreciable time, whether or not the driver passengers m the vehicle have conversed with others outside the vehicle, whether or not the vehicle has entered upon pnvate property solely for the purpose of turning around to proceed m the opposite direction, and the intended destination and purpose of the driver and passengers (g) This section shall not apply to government vehicles, in service emergency vehicles, taxicabs for lure, buses and other vehicles bemg dnver for business purposes Section 2. There is hereby created a new §1044 090, to Chapter 10 44 of the Pasco Municipal Code to read as follows 10.44.090 CRUISING - PENALTIES. Any person found to be in violation of § 080 of this Chapter shall be guilty of committing a civil infraction and be fined a civil penalty in the amount of $150 00 plus court costs and statutory assessments Sectwn 3.
