ORDINANCE NO. 2822
AN ORDINANCE relating to the energy code and amending the
provisions of PMC Chapter 16.18.
WHEREAS, the State Building Code Council has adopted a new
State Energy Code as Chapter 51.11 WAC; and,
WHEREAS, according to the provisions of State Legislation,
local governments must enforce the new energy code beginning on
July 1, 1991, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That PMC Section 16.18.010 hereby is amended
to read as follows:
16.18.010 ADOPTION OF WASHINGTON STATE ENERGY CODE.
Chapter 51712 51.11 WAC, Washington State Energy Code, as
hereafter amended or revised, is adopted by the City as its
official energy code. Three-eeptes-ef-satd-eede-has-heretefere

fer-use-and-examtnat±en-by-the-publte-as-requtred-by-iaw-prter-te

Section 2. That PMC Section 16.8.030 hereby is amended
to read as follows:
16.18.030 BOARD OF APPEALS. In order to determine the
suitability of alternative materials and methods of construction
and/or installation and provide for reasonable interpretation of
the provisions of the Energy Code, the Board of Appeals, created
pursuant to Section 204 of the 1982 1988 Uniform Building Code
as amended by Section 16.04.020 of the Pasco Municipal Code,
shall hear appeals and make determinations arising out of or in
connection with the decisions of the building official. When
it is claimed that the provisions of this code do not apply or
that the true intent or meaning of this code has been
misconstrued or wrongly interpreted, the applicant may, within 30
days of the decision, appeal to the Board of Appeals.
Section 3. This ordinance shall be effective July 1,
1991.

ters relating to the pro
posed improvement and all
objections thereto and for
determining the method of
payment for the im
provement and
WHEREAS Dennis Wright
the City Engineer caused
an estimate to be made of
the cost and expense of the
proposed improvement and
certified that estimate to the
City Council to9ether with
all papers and information
in his possession touching
the proposed improvement
a description of the bound
anes of the proposed local
improvement district and a
statement of what portion of
the cost and expense of the
improvement should be
borne by the property
within the proposed district
and
WHEREAS that estimate is
accompanied by a diagram
of the proposed im
provement showing
thereon the lots tracts par
cels of land and other
property which will be spe
cially benefited by the pro
posed improvement and
the estimated cost and ex
pense thereof to be borne
by each lot tract and parcel
of land or other property
and
WHEREAS due notice of
the above hearing was
given in the manner pro
vided by law and the hear,
ing was held by the City
Council on the date and at
the time above mentioned
and all objections to the
proposed improvement
were duly considered and
overruled by the City Coun
cil and all persons ap
peering at such hearing
and wishing to be heard
were heard and
WHEREAS the City Coun
cil has determined it to be
in the best interest of the
City that the improvement
as hereinafter described be
carried out and that the im
provement district be cme
ated in connection
therewith NOW THERE
