2789 ORDINANCE NO.
AN ORDINANCE concerning amusement devices; and amending
Section 5.20.050 of the Pasco Municipal Code.
WHEREAS, the municipal code currently prohibits amusement
devices to be used or operated in any building or place within
300 feet of the grounds of any school, whether or not the school
is in session; and
WHEREAS, after due consideration the City Council believes
that the use or operation of such devices within 300 feet of the
grounds of any school after regular school hours is no more of a
detriment to school age children or their education than the
location of amusement devices at other locations throughout the
city;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.20.050 of the Pasco Municipal code
is hereby amended as shown by the underlined new language to read
as follows:
5.20.050 LOCATION NEAR SCHOOLS. No license shall
be issued for any device to be used or operated in any
building or place within 300 feet of the grounds of
any school, during the hours that the school is in
session and one-half hour before and one-half hour
after, except that this section shall not be
applicable to electrical phonographs.
Section 2. This Ordinance shall take effect five (5)
days after passage and publication.
