AN ORDINANCE amending the Uniform Fire Code and Chapter
18.04 PMC; and making it unlawful for any person to
sell, issue, possess, fire or discharge fireworks
within the city except by permitted public display;
and, amending the penalties for violation of fireworks
laws.
WHEREAS, the City Council after deliberation, public
hearing, and report from staff has determined that use and
possession of fireworks by the general public poses a significant
hazard to the health, safety and general welfare of the community
that substantially outweighs the individual and public benefits;
and
WHEREAS, the City Council believes that the minimum
state-wide regulations for the protection of the public from
fireworks contained in RCW 70.77 are inadequate; and
WHEREAS, the City Council further believing that permitted
public displays of fireworks by licensed pyrotechnics on special
occasions such as the 4th of July and at special events provides
an adequate safeguard to the public yet enables the general
public to enjoy a fireworks celebration; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 18.04.110 of the Pasco Municipal Code
is hereby amended to read as follows (deletions shown by
interlineations and additions by underlining):
18.04.110 SUBSTITUTION FOR SECTION 78.102 OF THE
UFC. Section 78.102 of the Uniform Fire Code is omitted
and the following shall be substituted in its place:
Section 78.102. Manufacture, Sale and Discharge of
Fireworks.
A. The manufacture of fireworks is prohibited
within the City and all districts, except by special
permit, and only in I-1 (light industrial) and 1-2
(heavy industrial).
B. Except as herein provided, it is unlawful for
any person to possess, store, offer for sale, expose
for sale, sell at retail, or use, or explode, fire,
or discharge any fireworks.
(1) The Fire Chief is authorized to adopt
reasonable rules and regulations for the granting of
permits for supervised public displays of fireworks.
Applicants shall meet all qualifications and
requirements of State law regarding public display of
fireworks and all fire and safety requirements as set
forth here in the standards for public display.
Every operator shall have first obtained a state
license pursuant to RCW 70.77.300. The display shall
be of such character and so located, discharged or
fired that, after proper inspection, shall not be
hazardous to property or endanger any person.

BC. Standards for Public Fireworks Displays. All
public fireworks displays shall conform to the
following minimum standards and conditions:
(1) Applications for permits for public display of
fireworks shall be made in writing at least ten (10)
days in advance of the display.
(2) All public fireworks displays must be planned,
organized and discharged by a State of Washington
licensed Pyrotechnician.
(3) A permit must be obtained from the City of
Pasco and approved by the Fire Chief or his designee
prior to any display of public fireworks. The permit
shall include the name of the applicant and his
address, the name of the Pyrotechnician and his
address; the exact location, date and time of the
proposed display; the number, type and class of
fireworks to be displayed; the manner in which the
fireworks are being stored prior to the public
fireworks display; and shall include the name and
address of the insurance company providing the bond
required.
(4) A drawing shall be submitted to the Fire
Department showing a plan view of the fireworks
discharge site and the surrounding area within a five
hundred (500) foot radius. The drawing shall include
all structures, fences, barricades, streets, fields,
streams and any other significant factors that may be
subjected to ignition or that may inhibit fire
fighting capabilities.
(5) A City of Pasco Fire Department pumper and a
minimum of two (2) trained City of Pasco
firefighters shall be on site thirty (30) minutes
prior to and after the shooting of the event.
Reasonable compensation for stand-by apparatus and
manpower may be necessary as determined by the Fire

Chief. Any compensation for Fire Department
apparatus and manpower will be as per the Washington
State Chief's Association fee schedule.
(6) All combustible debris and trash shall be
removed from the area of discharge for a distance of
three hundred (300) feet in all directions.
(7) All unfired or "DUD" fireworks shall be
disposed of in a safe manner.
(8) A minimum of two 2A rated pressurized water fire
extinguishers and one (1) fire blanket shall be
required to be at the fireworks discharge site.
(9) The permit may be immediately revoked at any
time deemed necessary by the Fire Department due to
any noncompliance or weather conditions, such as
extremely low humidity or wind factor. The display
may also be cancelled by accidental ignition of any
form of combustible or flammable material in the
vicinity due to falling debris from the display.
(10) Areas of public access shall be approved by
the Fire Department and maintained in an approved
manner.
Section 2. Section 18.04.120 of the Pasco Municipal Code
is hereby amended to read as follows (deletions shown by

The applicant for a permit for a public display of
fireworks shall file with the Fire Chief a copy of a
public liability and property damage insurance policy
providing coverage with minimum limits as specified
in RCW 70.77.295; however, the holder of a general
license from the State Fire Marshall and, upon
compliance with RCW 70.77.355, shall be excused from
compliance with this section.
Section 3. Section 18.04.180 of the Pasco Municipal Code
is hereby amended to read as follows (deletions shown by
interlineations and additions by underlining):
18.04.180 VIOLATIONS - PENALTIES. Any person, firm
or corporation violating any of the provisions of this
code shall be deemed guilty of a gross misdemeanor, and
each such person shall be deemed guilty of a separate
offense for each and every day or portion thereof during
which any violation of any of the provisions of the code
is committed, continued, or permitted, and upon
conviction of any such violation such person shall be
punishable by a fine of not more than Five Humdred

Summary publication for Ordinance no. 2782 ; an ordinance
amending the Uniform Fire Code and Chapter 18.04 PMC; and making
it unlawful for any person to sell, issue, possess, fire or
discharge fireworks within the City of Pasco except by permitted
public display; and, amending the penalties for violations of
fireworks laws.
On June 18, 1990, the Pasco City Council passed Ordinance
No. 2782 • The ordinance amends the Uniform Fire Code and
Chapter 18.04 PMC by making it unlawful for any person to sell,
issue, possess, fire or discharge fireworks within the City of
Pasco except by permitted public display. The ordinance further
amends the penalties for violation of local fireworks laws from
misdemeanor to gross misdemeanor penalties.
The full text of the ordinance will be mailed to any
person upon written request to the City Clerk.
Section 1 of the ordinance deletes from PMC 18.04.110 all
provisions permitting the sale, possession and useage of
fireworks within the city, except by permitted public displays.
It is now unlawful for the general public to use, possess, or
discharge fireworks at any time within the city.
Section 2 of the ordinance deletes the insurance
requirements attendant to a permit for the sale of fireworks.
Section 3 of the ordinance amends the penalty section for
violation of Ch. 18.04 PMC by increasing the penalties from the
misdemeanor maximum penalties of a $500 fine and/or 90 days in
jail, to the gross misdemeanor penalties of a maximum fine of
$5,000 and/or 1 year in jail.
