WHEREAS, the City Council after deliberation, public hearing, and report from staff has determined that use and possession of fireworks by the general public poses a significant hazard to the health, safety and general welfare of the community that substantially outweighs the individual and public benefits; and WHEREAS, the City Council believes that the minimum state-wide regulations for the protection of the public from fireworks contained in RCW 70.77 are inadequate; and WHEREAS, the City Council further believing that permitted public displays of fireworks by licensed pyrotechnics on special occasions such as the 4th of July and at special events provides an adequate safeguard to the public yet enables the general public to enjoy a fireworks celebration; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 18.04.110 of the Pasco Municipal Code is hereby amended to read as follows (deletions shown by interlineations and additions by underlining): 18.04.110 SUBSTITUTION FOR SECTION 78.102 OF THE UFC. Section 78.102 of the Uniform Fire Code is omitted and the following shall be substituted in its place: Section 78.102. Manufacture, Sale and Discharge of Fireworks. A. The manufacture of fireworks is prohibited within the City and all districts, except by special permit, and only in I-1 (light industrial) and 1-2 (heavy industrial). B. Except as herein provided, it is unlawful for any person to possess, store, offer for sale, expose for sale, sell at retail, or use, or explode, fire, or discharge any fireworks. (1) The Fire Chief is authorized to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks. Applicants shall meet all qualifications and requirements of State law regarding public display of fireworks and all fire and safety requirements as set forth here in the standards for public display. Every operator shall have first obtained a state license pursuant to RCW 70.77.300. The display shall be of such character and so located, discharged or fired that, after proper inspection, shall not be hazardous to property or endanger any person. -€R)---The--Ftre--Department--shaii--tssue--eaeh-year permtts---fer--the--saie--ef--f±rewerks--te--persens7 eerperattems7--er—erganttatiems7-after-trivesttgatten amd—determtnatiem--that---the---Ieeatten—where—the ftrewerks-are-te-be-seid-ts-met-hatardeus-te-preperty -1- and--dees--net—endanger--any-persen7--and--that—the perserqs}--tn--eharge--ef--seiitmg—the-ftrewerks-are eempetent--and—tratned-te-handie-sueh-ftrewerks--and meet--aii-requtrements--as--set--ferth--here--tn--the standards-fer-retati-saies-ef-ftrewerks7 fa}--The-use7-saie-and-dtseharge-ef-ftrewerks-sheal be--gevermed--at--all--t±mes-by-the-prevtstens-ef-ReW 7877-and-by-the-rules-and—reguiattens--ef-the-State Ftre--Marshaii—adepted-pursuant-te-the-auther±ty--ef sa±d-statute7 f4}--The-fee-fer-a-Iseai-ftrewerks-dtspiay-er-saies perm±t-shaii-be-Ftfty-Beiiars-f$50708}7-the-fee-te-be payabie-te-the-ety--F±manee--efftee-upen-apprevai-e€ the--appieatten--by-the-Fire-Bepartmemt7--and--±s--a nen-refundable-fee7 f5}--Appi±eants-fer--the-sale-ander-pubite-d±spiay ef-f±rewerks-shaii-ebtetn--a--etty--ef-Pasee-bustness i±eemse7--upen--eempitanee-w±th-ether-appi±eabie-e±ty erd±nanees--and—generai—laws--and—payment—ef—the 1±eemse-fee- i.6}--Appi±eat±ens--fer--leeai-f±rewerks-dtspiay-and seles--permtts--shall--be—±nvesttgated—fer--matters eemeerntng-the-appi±eants 4 -past-htstery-ef-eempl±anee wtth-safety-reguiat±ens7 e.
