AN ORDINANCE related to zoning amending PMC Title 22 by enacting
special use provisions for commercial agricultural
uses.
WHEREAS, the City of Pasco is a service center for the
Columbia Basin agricultural industry and as such, can be termed a
agricultural community; and,
WHEREAS, considerable agricultural production takes place
within and adjacent the City limits of the City of Pasco; and,
WHEREAS, there is considerable undeveloped land within the
City limits of the City of Pasco that is likely to remain
undeveloped for many years; and,
WHEREAS, agricultural production appears to be an
appropriate transitional and interim use of vacant lands within
the City; and,
WHEREAS, when properly managed, farm lands can be an asset
to the community; and,
WHEREAS, the City Council has reviewed the proposed
amendments and finds them to be appropriate and necessary to
further the overall good and order of the community; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That PMC Section 22.80.020 hereby is amended
to include a new sub-section (15) to read as follows:
(15) Agricultural Use (Commercial) except in
areas 1,000 feet from a residential subdivision or
dwelling unit.
Section 2. That PMC Chapter 22.80 hereby is amended to
include a new section 22.80.045 to read as follows:
22.80.045. AGRICULTURAL USES. (1) Commercial
agricultural uses listed as conditional or unclassified uses in
this title shall conform to the following prior to the issuance
of a special permit:
(a) Special permits for agricultural uses (commercial)
may be granted for tracts of land over ten (10) acres in size
within 1,000 feet of a residential subdivision or a dwelling
unit. (Ref. note: See Section 22.68.020(r) permitting
agricultural use Commercial 1,000 feet or more from a
residential development and alfalfa and pasture grasses in all
zones).
(b) The applicant for a special permit shall be required
to submit a conservation plan approved by the USDA Soil
Conservation Service.
(2) All existing agricultural uses (limited to existing
acreage) occurring within any zoning district of the City of
Pasco where not expressly permitted by this code, shall be deemed
a lawfully established non-conforming agricultural use.
Section 3. That PMC Section 22 22.020 hereby is amended
to read as follows:
22.22.020 PERMITTED USES. The following uses shall be
permitted in the R-T zone:
(1) Single-family dwelling;
(2) Home occupations, see definition in Section
22.12.390;

Section 4. That P.M.C. Section 22.68.020 uses hereby is
amended to include a new subsection to read as follows:
22.68.028 (r) AGRICULTURAL USES.
(1) Commercial agricultural uses shall be considered
permitted uses in all zoning districts when the
proposed agricultural uses are located 1,000 feet or
more from a residential subdivision or a dwelling unit.
(2) The production of alfalfa or pasture grasses on
acreage of any size shall be considered permitted uses
within all zoning districts
Section 5. That P.M.0 Section 22.12.029 which reads as
follows:
22.12.029 AGRICULTURAL USES (COMMERCIAL).
"Agricultural uses (commercial) means an agricultural
operation consisting of irrigated land only. When an
agricultural use (commercial) is within or in close
vicinity of a residential zone, conditions may be
imposed to safeguard residential development. (Ord.
2361 Sec. 1 (part), 1982)
Hereby is amended to read as follows:
22.12.029 AGRICULTURAL USES (COMMERCIAL). Agricultural
uses (Commercial) means agricultural activities,
involving ten (10) or more acres, carried on as a
commercial enterprise with the object of gain, benefit,
or advantage, directly or indirectly. Agricultural
uses (commercial) do not include feed lots, stockyards,
dairies, hog farms or poultry husbandry.
Section 6. That PMC Section 22.80.050 hereby is amended
to read as following:
22.80.050 PULIC HEARING REQUIRED. Upon the filing of a
complete application for special permit, the application shall be
scheduled for a public hearing before the planning Commission.
Notice of such hearing shall be given as provided for in Section
22.080.015. Except that in the case of agricultural uses, the
notification distance shall be increased to 1,000 feet. The
public hearing may be continued as deemed necessary by the
planning commission, provided the applicant consents to any such
continuance. In the event the applicant does not consent to a
continuance, the planning commission shall close the public
hearing and render a recommendation to City Council in accordance
with the provisions of Sections 22.80.060 and 22.80.070. (Ord.

Section 7. This ordinance shall be in full force and
effect after its passage and publication as required by law.

SUMMARY OF ORDINANCE NO.9.4S24/
ORDINANCE NO,R7P is an ordinance relating to zoning enacting
new conditional use standards for special permits relating to
commercial agricultural uses.
Sections 1. Enacts a new sub-section designating commercial
agricultural as a conditional use in all zoning districts when
such use occur within 1,000 feet of a residential subdivision or
dwelling unit
Section 2. Amends Chapter 22.80 by creating a new section
providing standards for approving commercial agricultural special
use permits.
Section 3. Amends the R-T zone by deleting commercial
agriculture.
Section 4. Establishes commercial agriculture, alfalfa and
pasture grasses as permitted uses in all zones.
Section 5. Amends the definition of commercial Agriculture.
Section 6. Amends the notification process for special
permits.
