' ORDINANCE NO.
AN ORDINANCE related to zoning amending PMC Title 22 by enacting
new definitions in Chapter 22.12 and amending
Chapter 22.44 and 22.68 to include additional
provisions regulating pawnshops and secondhand
dealers.
WHEREAS, over the recent past, Pasco has attracted an ever
increasing number of secondhand stores that are concentrated
geographically on Lewis Street between First and Fourteenth
Avenues and in the Central Business District; and,
WHEREAS, the concentration of secondhand stores and
Pawnshops along with the manner in which they are maintained
contributes to visual blight, physical decay, declining property
values and perpetuates a negative public image for the community
in general; and,
WHEREAS, among other things the external effects of
physical decay and blight make the Central Business District and
certain portions of Lewis Street less desirable for business
investment; and,
WHEREAS, it is in the interest of the general public and
community at large to guide the location of Pawnshops and
secondhand dealers to ameliorate the negative externalities
associated therefrom; and,
WHEREAS, secondhand dealers and pawnshops require
considerable regulation to protect the community and public
interest by preventing said establishments from becoming
facilities for the concealment of crime and outlets for stolen
goods; and,
WHEREAS, the enforcement of municipal codes relative to
the operation of pawnshops and secondhand dealers is time
consuming, burdensome, and costly to the community; and,
WHEREAS, the Planning Commission did undertake an analysis
of existing zoning regulations by directing staff to research
the issue regarding the number, location, operation and
maintenance of secondhand dealers and pawnshops within the city.
This was followed by an open workshop session on December 21,
1989; and,
WHEREAS, the Planning Commission conducted a public
hearing on January 18, 1990 at the conclusion of which, it was
determined that evidence demonstrated pawnshops and secondhand
dealers have an adverse impact on surrounding properties and the
community in general and that it was in the public interest to
guide the location of such business enterprises to mitigate
adverse external impacts through zoning; and,
WHEREAS, the City Council has reviewed the recommendation
of the Planning Commission and finds the proposal to be
appropriate and is necessary to further the public health, good,
and order of the community; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. That a new PMC Section 22.12.066 hereby is
enacted to read as follows:
22.12.066 ANTIQUE. Antique means a piece of furniture,
glassware, silverware, art work or other items that are at least
sixty years old and are distinguished from general secondhand
personal property, and collectables by educational value,
historic value, artistic value, ornamental character or intrinsic
aesthetic merits.
Section 2. That a new PMC Section 22.12.067 hereby is
enacted to read as follows:
22.12.067 ANTIQUE DEALER. Antique Dealer means an
establishment having as its primary stock-in-trade "antiques" as

Section 3. That a new PMC Section 22.12.695 hereby is
inacted to read as follows:
22.12.695 SECONDHAND DEALER. Secondhand Dealer means
an establishment having any portion of its stock-in-trade
"secondhand personal property" as that term is defined in this
chapter.
Section 4. That a new PMC Section 22.12.097 hereby is
enacted to read as follows:
22.12.697 SECONDHAND PERSONAL PROPERTY. Secondhand
personal property means any item (or part thereof) of secondhand
personal property, regardless of condition, age or value;
including scrap and melted metals. EXCEPTING the following:
stamps, coins, books, reconditioned appliances, empty food
containers, goods used in trade-ins on the purchase of other
merchandise of the same or greater value, used automobiles,
unclaimed goods sold to collect mechanics liens and antiques.
Section 5. That PMC Section 22.68.020 hereby is amended
to include a new subsection 212.68.020(q) to read as follows:
22.68.020(q) Pawnshop and secondhand dealers as defined in
Section 22.12.615 and 22.12.695 are prohibited from operating in
the C-2 (Central Business District) zone, the C-1 (Retail
Business) zone, the C-1-D (Designated Shopping Center District)
zone and any residential zone. Pawnshops and secondhand dealers
are permitted to operate in the C-3 (General Business District)
zone and the I-1 (Light Industrial District) zone provided
however no new pawnshops and secondhand dealers licenses shall be
issued to an establishment located closer than 1,000 feet from an
existing pawnshop or secondhand dealer. All business activities
of pawnshop and secondhand dealers located in the C-3 (General
Business District) zone shall be conducted entirely within an
enclosed structure.
Section 6. That PMC Section 22.44.050 hereby is amended
to include a new subsection 22.44.050(11) to read as follows:
22.44.050(11) Secondhand dealers.
Section 7. This ordinance shall be in full force and
effect after its passage and publication as required by law.
