HomeMy WebLinkAbout2722 OrdinanceORDINANCE NO. 2722 AN ORDINANCE concerning septic tank waste disposal; and establishing new Chapter 13.54 to the Pasco Municipal Code. WHEREAS, Changes in the requirements of federal and state law concerning the environment and the disposal of waste products has created a need in the area for a depository for the waste products pumped from residential septic tanks; and WHEREAS, The City of Pasco Wastewater Treatment Plant is capable of handling certain domestic waste pumpings from septic tanks, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. New Chapter 13.54 is hereby added to the Pasco Municipal Code, which Chapter shall read as follows: CHAPTER 13.54 SEPTIC TANK WASTE DISPOSAL Section: 13.54.010 Unlawful dumping prohibited. 13.54.020 Wastewater treatment plant - disposal site. 13.54.030 Septage requirements. 13.54.040 Application requirements. 13.54.050 Dumping rules, procedures and practices. 13.54.060 Billing Procedure. 13.54.070 Unlawful dumping - penalty. 13.54.010 UNLAWFUL DUMPING PROHIBITED. It is unlawful for anyone to dump, deposit or place waste from septic tanks into the wastewater (sewer) system of the City of Pasco, except as allowed by the provisions of this chapter. Violation is punishable as a gross misdemeanor. 13.54.020 WASTEWATER TREATMENT PLANT - DISPOSAL SITE. The City of Pasco Wastewater Treatment Plant may accept domestic waste pumpings from septic tanks serving residential dwelling units ("septage"), subject to the requirements of this chapter. 13.54.030 SEPTAGE REQUIREMENTS. Septic tank waste dumpings deposited at the wastewater treatment plant shall not be untypical and/or have characteristics inconsistent with that common to domestic waste. Specifically, the septage shall: (a) Have a PH above 5.5 and below 9.0; and (b) Not contain toxic or poisonous substances that would interfere with the treatment process or by its content be considered hazardous y -1- waste as defined by state statute or administrative regulation; and (c) Not contain any petroleum based product or other flammable material; and (d) Not contain more than 100 parts per million by weight of fat, vegetable oil, or grease; and (e) Not contain rocks or sand. 13.54.040 APPLICATION REQUIREMENTS. No person shall dump any septage at the wastewater treatment plant until the depositor has established an approved account with the city. Each applicant for an approved account shall file an application with the city's finance department providing sufficient information to establish that: (a) The applicant firm is licensed with the Benton-Franklin Health District as a septic tank pumper; and (b) The firm's business name, address, ownership (identity of corporate officers if a corporation) and the person or persons to contact in the case of an emergency; and (c) A description of each truck that will be used for hauling and depositing septage at the wastewater treatment plant which description shall include the truck's license plate number, and the capacity of the truck's tank in gallons. 13.54.050 DUMPING RULES, PROCEDURES AND PRACTICES. The City of Pasco Wastewater Superintendent shall establish rules, procedures and practices in writing regulating the procedures to be followed by depositors of septage at the wastewater treatment plant, emptying hours, clean-up requirements and reporting requirements. 13.54.060 BILLING PROCEDURE. (a) Rate: septic tank waste discharged into the wastewater treatment plant will be charged on the basis of a full truck tank load at ten cents per gallon times the capacity of the truck's tank in gallons. (b) Frequency: Billings will be made on a calendar month basis with the billings sent out not later than the first full week following the end of the preceding month. Bills must be paid, as evidenced by receipt of the same by the city's finance department, prior to the last calendar day of the month the bill is mailed by the city. Failure to pay any billing within the time frame set forth herein shall be sufficient grounds for the city to terminate dumping privileges at the wastewater treatment plant. Any person, firm, business or corporation found to be dumping other than residential dwelling unit septage at the wastewater treatment plant will immediately forfeit its privilege to do any further septage treatment/disposal at the Pasco Wastewater Treatment Plant. Any person, firm, business or corporation disposing its septage into the City of Pasco sewage system at other than the treatment plant will be subject to prosecution under Section .010 of this chapter and any other applicable law.
