AN ORDINANCE concerning water and sewer service rates,
rules and regulations; and amending Sections 13.16.030
and .050; 13.20.020, .030, .040, .050 and .090;
13.40.020, .030 and .040.
WHEREAS, The City Council after review and consideration
of the Finance Director's report on proposed water and sewer
rates, and after discussion of the report and the recommendations
therein, agrees that the proposed changes in water and sewer
rates are appropriate and a monthly billing cycle rather than the
current bimonthly cycle is in the best interests of the public,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 13.16.030 of the Pasco Municipal
Code is hereby amended to read as follows:
13.16.030 BILLING. The city manager shall
establish billing on a basis whereby
approximately one-eighth fourth of the bills will
be mailed to users each week and, as a result,
each customer will receive a billing
approximately once every-twe--memths7 a month.
Section 2. Section 13.16.050 of the Pasco Municipal
Code is hereby amended to read as follows:
13.16.050 DELINQUENT BILLS. (a) All
water-sewer bills shall be due immediately upon
billing and be delinquent if not paid in full
twenty days after the date of billing. A
delinquency notice shall then be sent the
customer giving notice that the water will be
turned off within ten days of the delinquency
notice unless the customer requests a hearing
with a city official in the event the bill is
disputed. The notice shall also advise that in
addition to any water turn-on charge that may be
needed, that there is a two dollars and fifty
cent late charge or one and one-half percent of
the delinquent and unpaid amount, whichever is
greater, unless the bill is paid in full within
thirty days of the original date of billing.
(b) Any bill not paid by the succeeding
billing cycle shall reflect a two dollar and
fifty cent late charge or one and one-half
percent of the delinquent amount, whichever is
greater, and give notice that the entire billing,
together with all delinquencies and late charges,
is due and payable within five days or
termination of service will occur without further
notice.
(c) In the event of a turn-off for non
payment of a delinquent account, the water shall
remain turned off until the delinquency and all
resulting charges are paid in full unless the
property has been released from responsibility
for water and sewer charges pursuant to Section
-1-
13.04.080, in which event it shall remain turned
off until a subsequent application for service is
accepted; provided, that the subsequent applicant
and any other person residing on or using the
property is not liable for any water-sewer
charges owing on the property or some other
property served by the city water-sewer utility.
Section 3. Section 13.20.020 of the Pasco Municipal
Code is hereby amended to read as follows:
13.20.020 SINGLE-FAMILY DWELLING UNIT -
MINIMUM RATE. The following shall be the minimum
monthly amount charged to single-family unit
accounts inside the corporate limits of the city
of Pasco for water service where such service is
furnished through a separate meter for each

Section 4. Section 13.20.030 of the Pasco Municipal
Code is hereby amended to read as follows:
13.20.030 MULTIPLE DWELLING UNIT,
IRRIGATION AND COMMERCIAL - MINIMUM MONTHLY RATE.
The following shall be the minimum monthly amount
charged to multiple dwelling units, irrigation
and commercial accounts inside the corporate
limits of the city of Pasco for water service.

Section 5. Section 13.20.040 of the Pasco Municipal
Code is hereby amended to read as follows:
13.20.040 OTHER MINIMUM MONTHLY RATES. The
following shall be the minimum monthly rate
charged on a per dwelling unit basis for each
dwelling unit where a person residing therein
shall show satisfactory proof under oath in
writing to the city finance director of the
following:
(1) That he or she is sixty-five years of
age or older;
(2) That he or she is a single occupant of
or the head of a household all of whose members
have a combined annual income from all sources
that is not greater than the United States

federal poverty level. Such poverty level shall
be determined by the "Very Low Income Limits" and
updated annually by the finance director;
(3) The person must be the applicant for the
water service and must be directly responsible
for the payment of the water bill;
(4) The person must have resided at such
place for a period of not less than ninety
consecutive days prior to the effective date of
the rate set forth below and must intend to
remain at such place.
The person must state under oath that he or
she will inform the city in writing if there is
any change in their or the household's status as
it relates to the requirements set forth above.
The city finance director may require the person
demonstrating satisfactory proof for a household
that qualifies for the rates set forth in this
section to make an updated application at any
time.
"Head of the household" means the person
owning or having control of the dwelling unit.
In the case of a husband and wife, either person
shall be considered the "head of the household."
Dwelling units qualifying as set forth above
shall be charged a monthly rate of one dollar and
twenty-five cents per dwelling unit for the
minimum monthly rate_L whieh-shall-prevtde-fer-the

water.: All consumption ever-thet-ameunt shall be
charged at the regular rate.
Section 6. Section 13.20.050 of the Pasco Municipal
Code is hereby amended to read as follows:
13.20.050 MINIMUM-MeNTHEY CONSUMPTION RATE
FOR ALL CLASSES OF USERS OF WATER CONSUMED._

Section 7. Section 13.20.090 of the Pasco Municipal
Code is hereby deleted in its entirety.
Section 8. Section 13.40.020 of the Pasco Municipal
Code is hereby amended to read as follows:
13.40.020 DWELLING UNIT MONTHLY RATE. The
monthly rate for each dwelling unit within the
corporate limits of the city of Pasco shall be

Section 9. Section 13.40.030 of the Pasco Municipal
Code is hereby amended to read as follows:
13.40.030 HOTEL AND MOTEL MONTHLY RATE.
The monthly rate for hotels and motels within the
corporate limits of the city of Pasco shall be
one dollar and f±fty-m±me seventy-five cents per
unit per month.
Section 10. Section 13.40.040 of the Pasco Municipal
Code is hereby amended to read as follows:
13.40.040 COMMERCIAL MONTHLY RATE. The
monthly sewer amounts charged to commercial
accounts inside the corporate limits of the city
of Pasco shall be feur five dollars and
n1nety-twe seventy-one cents minimum plus $87R1R6
$0.26 per one hundred cubic feet for all water
used over one thousand cubic feet per month.
Section 11. This Ordinance shall take effect upon
passage and publication.
