HomeMy WebLinkAbout2693 OrdinanceT: ells, City Clerk tello, City Attorney ORDINANCE NO. 2693 AN ORDINANCE concerning the maintenance of sidewalks and amending Section 12.04.170 of the Pasco Municipal Code. WHEREAS, PMC 12.04.170 requires adjacent property owners to maintain the sidewalk adjacent to their property; and WHEREAS, the littering of sidewalks has become a significant problem in certain areas of the City and it is the desire of the City Council to clearly state the obligation of adjacent property owners to maintain the adjacent sidewalk free of litter and to provide a civil penalty therefore, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Section 12.04.170 of the Pasco Municipal Code is hereby amended by the following underlined language to read as follows: 12.04.170 MAINTENANCE OF SIDEWALKS. Whenever any street, lane, square, place or alley in the City shall have been improved by the construction of a sidewalk along either side thereof, the duty, burden, and expense of the maintenance, cleaning (including the cleaning of litter and other debris), repair and renewal of such sidewalk, including the erection and maintenance of suitable barriers of wood, iron or masonry along the outer margin of such sidewalk where the same is elevated more than two (2) feet above the abutting property, shall devolve upon the owner of the private property directly abutting on the sidewalk, and the improvement shall be made by the owner in the manner provided by the Ordinances of the City, and the laws of the State. It shall be unlawful for any person after receiving notice from the City to fail to maintain, clean, repair, or renew such sidewalk pursuant to the obligations created above. A violation of this Section shall be a Civil Code infraction carrying a maximum penalty of $250. Section 2. This Ordinance shall take effect five (5) days after passage and publication.
