ORDINANCE NO. 2692
AN ORDINANCE relating to zoning, amending PMC Title 22, by
enacting new regulations pertaining to inoperable
vehicles.
WHEREAS, the growing number of inoperable vehicles upon
private property has resulted in increased blight and slum
conditions, unsightliness, attractive nuisances to children,
uncontrolled weed growth, litter, insect and rodent environments,
a negative impact on vicinal residential property values, and is
a significant source of complaint by citizens of Pasco; and,
WHEREAS, increasing public cost is associated with the
abatement process, to remove inoperable vehicles from private
property; and,
WHEREAS, the City Council of the City of Pasco
conducted a public hearing on July 18, 1988, to consider new
zoning regulations to resolve the problems noted hereinabove, and
finds the proposed regulation to be appropriate, NOW, THEREFORE:
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS
FOLLOWS:
Section 1. A new PMC Section 22.12.822 hereby is enacted
to read as follows:
22.12.822 VEHICLE, INOPERABLE. "Inoperable vehicle" means a
vehicle which is apparently inoperable and is extensively
damaged, including but not limited to: a broken window or
windshield; is absent a tire, wheel, engine, transmission,
rearend, axle or driveline; or a vehicle or part thereof which is
placed upon jacks, blocks or other support.
Section 2. That a new PMC Section 22.68.020(n) hereby is
enacted to read as follows:
22.68.020(n) Inoperable vehicles, as defined in Section
22.12.822 are permitted within the R-T, R-IS, R-1, R-2, R-3, R-4,
R-5, RMH-1, RMH-2 and RMH-3 Districts subject to the following
conditions:
1) Only one (1) inoperable vehicle may be stored outside of a
fully enclosed building on the property, as a accessory use
to a dwelling unit.
2) The inoperable vehicle stored outside shall not be stored
upon a public right-of-way or in the front or side yard areas
of the property, and shall not conflict with other
residential requirements such as off-street parking and lot
coverage.
3) The trunk of the outside inoperable vehicle shall be removed
or locked at all times it is unattended, and the unattended
vehicle shall be completely enclosed within a six (6) foot
fence, which is fully site obscuring.
Section 3. This ordinance shall be in effect after its
passage and publication as required by law.

4) All vehicle parts not properly installed upon a vehicle shall
be stored inside a fully enclosed building except that parts
may be stored within the outside inoperable vehicle.
(5) Where an inoperable vehicle or vehicles is found to be
non-conforming as of the effective date of this Ordinance,
the owner of the property upon which the inoperable vehicle
or vehicles is located shall have ninety (90) days to comply
with the provisions contained in this section.

at all times it is unattended,
and the unattended vehicle
shall be completely en-
closed within a six (6) foot
fence which is fully site
obscuring
4) All vehicle parts not

vehicle shall be stored in-
side a fully enclosed build-
ing except that parts may
be stored within the outside
inoperable vehicle
(5) Where an inoperable
vehicle or vehicles is found
to be non-conforming as of
the effective date of this Or-
dinance the owner of the
property upon which the in-
operable vehicle or vehi-
cles is located shall have
ninety (90) days to comply
with the provisions con
tamed in this section
Section 3 This ordi-
nance shall be in effect
after its passage and publi-
cation as required by law
