HomeMy WebLinkAbout2629 OrdinanceORDINANCE NO. 2629 AN ORDINANCE relating to zoning, amending Title 21 of the Pasco Municipal Code, by enacting new parking lot regulations. WHEREAS, the City Council has determined that PMC Title 21 does not properly provide for parking lots as principle uses of land within the City of Pasco; and, WHEREAS, the Planning Commission conducted a public hearing on October 2, 1986 and a public meeting on October 23, 1986 for the purpose of considering such revised regulations pertaining to parking lots; and WHEREAS, the City Council has reviewed the public record of the hearing and the recommendation of the Planning Commission, and finds the same to be appropriate; NOW, THEREFORE: THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. That a new subsection of PMC 22.42.010 hereby is enacted to read as follows: 22.42.010(14) Parking lots within 500 feet of a C-2 district boundary, provided such lots are paved and half of the required landscape is live vegetation and, provided further, that any such property adjacent a residential zoned parcel shall provide a site obscuring fence along the common lot line(s) in accordance with residential fence height requirements. Section 2. That a new subsection of PMC 22.42.025 hereby is enacted to read as follows: 22.42.025(2) Parking lots Section 3. That a new subsection of PMC 22.44.010 hereby is enacted to read as follows: 22.44.010(19) Parking lots, provided such lots are paved and the development complies with the landscape and fencing requirements of the C-1 district, as enumerated in subsection 22.42.010(14). Section 4. That PMC Subsection 22.48.030(1) hereby is amended to read as follows: 22.48.030(1) All uses permitted in the C-2 business district, except parking lots; Section 5. That a new subsection of PMC 22.48.030 hereby is enacted to read as follows: 22.48.030(14) Parking lots within 500 feet of a C-2 district boundary, provided such lots are paved and the development complies with the landscape and fencing requirements of the C-1 district, as enumerated in subsection 22.42.010(14). Section 6. That a new subsection of PMC 22.48.045 hereby is enacted to read as follows: 22.48.045(3) Parking lots Section 7. That subsection 22.52.010(4) hereby is amended to read as follows: 22.52.010(4) Parking lot areas for transient motor vehicles, but not for storage of new or used motor vehicles for sale or hire; provided such lots are paved and the development complies with the landscape and fencing requirements of the C-1 district, as enumerated in subsection 22.42.010(14). Section 8. That a new subsection of PMC 22.56.010 hereby is enacted to read as follows: 22.56.010(13) Parking lots within 500 feet of a C-2 district boundary, provided such lots are paved and the development complies with the landscape and fencing requirements of the C-1 district, as enumerated in subsection 22.42.010(14). Section 9. That a new PMC Section 22.56.025 hereby is enacted to read as follows: 22.56.025 PERMITTED CONDITIONAL USES. the following uses may be permitted in the I-1 district upon approval of a special permit as provided in Chapter 22.80: (1) Parking lots Section 10. That a new subsection of PMC 22.60.010 hereby is enacted to read as follows: 22.60.010(3) Parking lots within 500 feet of a C-2 district boundary, provided such lots are paved and the development complies with the landscape and fencing requirements of the C-1 district, as enumerated in subsection 22.42.010(14). Section 11. That a new PMC Section 22.60.015 hereby is enacted to read as follows: 22.60.015 PERMITTED CONDITIONAL USES. The following uses may be permited in the 1-2 district upon approval of a special permit as provided in Chapter 22.80. That a new subsection of PMC 22.80.020 hereby is enacted to read as follows: 22.80.020(14) Park and ride lots, off-street transfer stations or other similar facility involving the storage, start-up, idling and movement of public or private operated carrier, charter or transit buses, vans, and similar vehicles. Section 13. That PMC 22.84.020 hereby is amended to read as follows: 22.84.020 PARKING LOTS. All parking area previded required pursuant to this chapter shall be on the same lot with the building, except that the Beard-e€-Adj.ustmemt Planning Commission may by special permit, allow the parking spaces to be on a lot within five hundred feet of the building, if it determines that it is impracticable to provide parking on the same lot with the building. Section 14. This ordinance shall be in effect after its passage and publication as required by law. Dated this /7 , 1986. Sections 8 and 9 authorize parking lots as a permitted use in the I-1 district, within 500 feet of a C-2 boundary and, by special permit if farther than 500 feet from a C-2 boundary. Requires half the required landscape to be live vegetation. Sections 10 and 11 authorize parking lots as a permitted use in the 1-2 district, within 500 feet of a C-2 boundary and, by special permit if further than 500 feet from a C-2 boundary. Requires half of the required landscape to be live vegetation. Section 12 requires park and ride or similar transit oriented parking lots to be authorized by special permit. Section 13 clarifies that special permit review is conducted by the Planning Commission. Section 14 stated the ordinance takes effect five (5) days after its passage and publication.
