AN ORDINANCE concerning official city holidays for
non-represented employees; and amending Section 2.42.290 of the
Pasco Municipal Code.
WHEREAS, the third Monday in January is now being
celebrated as an official state holiday, in recognition of Martin
Luther King Jr. 's birthday, and the third Monday in February is
celebrated as an official state holiday in recognition of
"Presidents' Day",
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. PMC 2.42.290 is hereby amended to read as
follows as shown by the underlined additions and deletions by
interlineation:
2.42.290 HOLIDAYS. (a) The following are the
official holidays for all regular employees of the
city.; ; provided amy-helidays-set-ferth-in-am-ex±sting
agreement—between---the--empleyees—and—the-eity-sheil
eenstitute-the-legal-helidays--fer-these-empleyeest this
section shall not apply to any employee who is a member
of a collective bargaining unit having an agreement with
the City. This subject shall be determined exclusively
by the terms of the contract.

(b) For those employees whose present legal holidays
are not set forth in an existing contract between the
employees and the city, each employee may select the day
on which he desires to take one additional holiday,
subject to the following conditions:
(1)The employee has been continuously employed by the
city for more than six months;
(2) The employee has given not less than fourteen
calendar days of written notice to his immediate
supervisor; provided, however, the employee and
his supervisor may agree on an earlier date;
(3) The supervisor has approved the day;
(4) The day selected does not prevent a department
from providing continued public service and does not
interfere with the efficient operation of the
department;
(5) The personal day must be taken during the
calendar year or entitlement to the day will lapse,
except when an employee has requested a personal holiday
and the request has been denied.
(c) When any of these holidays falls on a Saturday,
the Friday immediately preceding such holiday shall be
observed as the holiday. When any of these holidays
falls on a Sunday, the Monday immediately following
shall be observed as the holiday.

Section 2. This Ordinance shall take affect five (5)
days after passage and publication.
