( dht -4/1 nE__J-A0 : MAYOR ELLS, City Clerk EGA sco RUBSTELLO, ity Attorney ORDINANCE NO. 2613 AN ORDINANCE establishing the crime of criminal attempt; and creating new Section 1.01.145 of the Pasco Municipal Code. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. New Section 1.01.145 of the Pasco Municipal Code is hereby created and shall hereby read as follows: 1.01.145 CRIMINAL ATTEMPT. (1) A person is guilty of an attempt to commit crime, if, with intent to commit a specific crime, he does any act which is a substantial step toward the commission of that crime. (2) If the conduct in which a person engages otherwise constitutes an attempt to commit a crime, it is no defense to a prosecution of such attempt that the crime charged to have been attempted was, under the attendant circumstances, factually or legally impossible of commission. (3) An attempt to commit a crime is a misdemeanor and punishable by fine of not more than Five Hundred Dollars ($500.00) or by imprisonment for a period of not more than ninety (90) days, or by both such fine and imprisonment.
