ORDINANCE NO. 2611
AN ORDINANCE concerning the payment of claims or
judgments; and adding new Section
2.54.030(5) to the Pasco Municipal Code.
WHEREAS, the City's authority to indemnify or hold
harmless any of its officials, officers, employees, and agents
from claims and judgments is limited to those claims and
judgments arising out of the performance, purported performance,
or failure of performance, in good faith of duties for, or
employment with the City of Pasco; and
WHEREAS, the Municipal Code needs revision to clearly
reflect such limitation and to exclude punitive or exemplary
damages from the City's obligation to pay,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. New Section 2.54.030(5) is hereby added to
the Pasco Municipal Code and shall read as follows:
SECTION 2.54.030(5)
Section 2.54.030(5). The claim or judgment
arose out of the performance, purported
performance, or failure of performance, in
good faith of duties for, or employment
with, the City of Pasco.
Section 2. This Ordinance shall take effect five (5)
days after passage and publication.
