HomeMy WebLinkAbout2588 OrdinanceORDINANCE No. 2588 AN ORDINANCE relating to zoning and amending PMC Title 22 by enacting a new Section 22.80.025 entitled Historic Places. WHEREAS, there are certain places within the City of Pasco which have been accepted on the National Register for Historic Places due to their quality of significance in American history; and this significance is established by some architectural, archaeological, cultural, or other intrinsic aspect of the place; and WHEREAS, the ongoing preservation of such places is threatened once the original historic use has ceased, until a feasible adaptive re-use of the place occurs; and WHEREAS, the underlying zoning of the place may inhibit or discourage desirable adaptive re-use and rezoning may not comport with the city's Comprehensive Plan, and WHEREAS, the City Council is interested in the preservation of such historic places, where economically feasible, and desires to consider proposals of adaptive re-use which may require special exceptions from zoning to allow practical economic use and return; and WHEREAS, the City Council conducted a public hearing on February 18, 1986 to consider special regulations necessary to encourage historic preservation and ensure compatibility with existing and intended development within vicinal properties and after the conduct of said hearing, determined the following regulations to be appropriate for same, NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That the following new Section 22.80.025 to the Pasco Municipal Code is hereby enacted to read as follows: 22.80.025 HISTORIC PLACES. A special permit for the preservation by adaptive re-use of an historic place, accepted on the National Register of Historic Places, may be requested for uses not otherwise permitted within the applicable district. Requests for historic places special permits shall be applied for in the same manner as herein established for uses requiring a special permit. Upon conclusion of a public hearing, the Planning Commission shall make appropriate findings and conclusions, as provided in Section 22.80.060 to determine if the proposed use is, or can be made, compatible with existing and planned vicinal development,and make a recomendation to the City Council. A final decision shall be made by the City Council. A special permit granted under this section is personal to the applicant and shall permit only the applicant to exercise the adaptive re-use authority, and shall not be assigned, transferred, conveyed or passed to heirs or beneficiaries of the applicant's estate. Each applicant granted a special permit shall be required to substantially preserve the intrinsic qualities of the historic place which led to its acceptance on the National Register of Historic Places. Prior to issuance of any building permits the city may consult with the Washington State Office of Archaeology and Historic Preservation to insure compliance with this requirement. Any special permit granted under this authority shall be subject to all other provisions of this chapter. Section 2.
