HomeMy WebLinkAbout2587 OrdinanceORDINANCE NO. 2587 AN ORDINANCE Creating an Accident Fund and Creating Chapter 3.116 of the Pasco Municipal Code. WHEREAS, RCW 35A.31.060 authorizes a code city to create an accident fund upon which the City Clerk shall draw warrants for the full amount of any judgment including interest and costs against the city on account of personal injury suffered by any person as shown by a transcript of the judgment duly certified to the City Clerk; and WHEREAS, when adopted by a city, this method of paying judgments is the exclusive method available to a judgment creditor, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION ONE. City fund no. 150 entitled ACCIDENT FUND shall be created as authorized by 35A.31.060 RCW for the payment of any judgment including interest and costs against the city on account of personal injury suffered by any person as shown by transcript to the judgment duly certified to the City Clerk, where the city does not have insurance otherwise covering the payment of any such judgment. SECTION TWO. Chapter 3.116 to be entitled ACCIDENT FUND is hereby added to the Pasco Municipal Code and shall read as follows: CHAPTER 3.116 ACCIDENT FUND Section: 3.116.010 Created. 3.116.020 Use. 3.116.010 CREATED. There is created a special fund to be known as the "Accident Fund" pursuant to and for the purposes authorized in RCW 35A.31.060. 3.116.020 USE. The "Accident Fund" shall be used in a manner consistent with and for the purposes authorized in Chapter 35A.31. RCW as amended. SECTION THREE. This ordinance shall take effect five (5) days after passage and publication.
