ORDINANCE NO. 2582
AN ORDINANCE relating to the vacation of certain
right-of-way within the City of Pasco by amending Ordinance No.
2558.
WHEREAS, Ordinance No. 2558 was passed by the City Council
on July 15, 1985; and
WHEREAS, Section One of that ordinance in part required as
a condition of the vacation of the street and alleyway described
in the ordinance, that the applicant pay compensation to the City
of Pasco in the amount of $4,309.31, or one-half of the total
appraised value of said rights-of-way, whichever amount is less;
and
WHEREAS, an appraisal of said rights-of-way was completed
verifying that the value of said rights-of-way is comparable to
the value of that certain property owned by the applicant lying
within Block 1 of Steffin's Amended Addition lying adjacent to
the east line of Oregon Avenue; and
WHEREAS, such property of the applicant is needed by the
city of Pasco in conjunction with its project for the extension
of Oregon Avenue; and
WHEREAS, the applicant Department of Natural Resources is
willing to convey such property to the City in lieu of the
payment of $4,309.31 or other compensation for the city's
vacation of right-of-way,
ThE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section One. That certain condition set forth in
Section One of Ordinance No. 2558 of the City of Pasco passed on
July 15, 1985 which reads as follows:
The applicant pay compensation to the City of Pasco in the
amount of $4,309.31, or one-half of the total appraised
value of said rights-of-way, whichever amount is less.
Is hereby amended to read as follows:
The applicant shall deed to the City of Pasco by
quit-claim deed supported by an owners policy of title
insurance insuring that the property is free of
encumbrances and there are no defects in title, that
portion of Block 1, Steffin's Amended Addition lying
adjacent to the East line of Oregon Avenue and more
particularly described on Attachment "A" attached

hereto and by reference incorporated herein as if
specifically set forth.
Section Two. Said ordinance No. 2558 is hereby amended
by the addition of new Section Four which shall read as follows:
Section Four. The approval for vacation given in Section
One of this ordinance shall be rescinded and null and void
on March 1, 1986 if the conditions for vacation set forth
in Section One have not been fulfilled by that date.
Section Three. Said ordinance No. 2558 of the City of
Pasco shall in all respects remain the same except as
specifically amended in sections one and two of this ordinance.
Section Four. This ordinance shall be effective five
(5) days after its passage and publication.
PASSED by the Pasco City Council and approved by the Mayor
