HomeMy WebLinkAbout2573 OrdinanceORDINANCE NO. 2573 AN ORDINANCE Adopting Parking and Traffic Regulations For The Tr-Cities Airport Set Forth in Port of Pasco Resolution No. 779; and Adding Chapter 10.94 to The Pasco Municipal Code. WHEREAS, the Port of Pasco has adopted Resolution 779, which promulgates rules and regulations governing the parking, standing, stopping and the use of motor vehicles within the Tr-Cities Airport property; and WHEREAS, the Port of Pasco prior to the adoption of Resolution No. 779 held a public hearing on the proposed regulations pursuant to the requirements of RCW 53.08.220; and WHEREAS, the Port of Pasco has requested that the City of Pasco adopt such regulations as contained in Resolution No. 779 as part of the ordinances of the city of Pasco; and WHEREAS, there is mutual benefit to be derived both to the Port of Pasco and to the City of Pasco by the City Council's approval of such request, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION ONE. The rules and regulations governing the parking, standing, stopping, and use of motor vehicles at the Tr-Cities Airport, as set forth in Port of Pasco Resolution No. 779, dated September 26, 1985 are hereby approved and adopted by the City of Pasco. SECTION TWO. New chapter 10.94 is hereby added to the Pasco Municipal Code, which chapter shall read as follows: CHAPTER 10.94 TRI-CITIES AIRPORT PARKING AND TRAFFIC REGULATIONS Sections: 10.94.010 ADOPTION BY REFERENCE. The rules and regulations governing the parking, standing, stopping and use of motor vehicles at the Tr-Cities Airport as set forth in Port of Pasco Resolution No. 779, adopted September 26, 1985 by the Port of Pasco Port Commission, are adopted by reference as part of the traffic ordinances of this city as if fully set forth herein. SECTION THREE. A copy of Port of Pasco Resolution No. 779 is attached hereto and incorporated by reference herein as if fully set forth. SECTION FOUR. This ordinance shall take effect five (5) days after passage and publication. PASSED this A/ day of October, 1985 and approved by the Mayor. A(,—.4....d.dApululA r is, City Clerk /APPROVED AS TO FORM: Ut Gre Rubstel o City Attorney tr,- ,---- , \ 1 c RESOLUTION NO 779 A RESOLUTION of the Port of Pasco regulating parhing , and traffic control of motor vehicles at the Tr-Cities Airport including the Industrial Park adjacent thereto (hereinafter referred to as the "Airport"), and providing penalties therefor, and superseding prior inconsistent Resolutions, if any WHEREAS, municipalities including Port Districts may establish, construct, operate and maintain airports and other air navigation facilities pursuant to RCW 12 08 et seq, and WHEREAS, the Port of Pasco has held a public hearing on these proposed matters pursuant to the requirements of 53 08 220 R C W , and WHEREAS, it is necessary that rules and regulations be adopted to provide for the orderly flow of traffic to and from the Airport, the deplaning and enplaning of passengers, the delivery of goods and services to the Airport and the protection of the public health, safety and welfare of the users of the Airport and its facilities, and WHEREAS, the Tr-Cities Airport and the adjacent industrial park set forth in attached plats are within the City of Pasco, and WHEREAS, it is the intent of the Port of Pasco to promulgate rules and regulations governing the parking, standing, stopping, and use of motor vehicles consistent with the laws of the State of Washington and the City of Pasco ordinances, NOW, THEREFORE, BE IT RESOLVED by the Port of Pasco that the following provisions shall be applicable to the parking, standing, stopping, driving and use of motor vehicles within the boundaries of the Tr-Cities Airport Section 1 PARKING RESTRICTIONS; Vehicles shall not be parked in areas within the Airport boundaries other than in the places and in accordance with the restrictions and rules set forth in the attached plat and designated by posted signs indicating such areas and the applicable restrictions , Section 2 STOPPING, STANDING AND PARKING PROHIBITED IN SPECIFIC PLACES There shall be designated, by proper signs pursuant to the attached plat, those roads within the Airport on which standing or parking would create hazardous conditions or cause a delay to traffic and, when official signs are erected, no person shall stop, stand or park a motor vehicle in any such designated place Section 3 PASSENGER AND PUBLIC CARRIER ZONES There shall be designated, pursuant to the attached plat, locations for passenger loading zones and public carrier stands and there shall be appropriate signs indicating the same No person shall stop, stand or park a vehicle in a passenger loading zone other than for the expeditious loading or unloading of passengers or baggage Vehicles shall not be left unattended in any passenger loading zone No operator of a private vehicle shall stop, stand or park in a zone designated and posted by proper signs for public carriers or permittees Section 4 PARKING PROHIBITED IN CERTAIN AREAS In the interest of minimizing congestion and affording patrons of the Airport convenient use of the terminal facilities, there shall be designated, pursuant to the attached plat, portions of the roadways in the vicinity of the Airport terminal and other terminal buildings on which parking shall be prohibited or limited to specified time periods Such prohibitions and time limitations shall be clearly indicated by posted signs Section 5 HANDICAPPED PARKING There shall be designated certain places within the boundaries of the Airport which may be specifically designated for parking by handicapped persons Parking in areas so designated and posted by the Airport may be limited to those persons displaying a distinguishing decal as provided by RCW 46 16 380, as adopted or as hereafter amended Section 6 PARKING SPACES MARKED - MUST PARK IN STALLS The Airport is authorized to have lines or markings painted or placed upon the curb and/or upon the roadway adjacent to areas for the purpose of indicating the parking space, and each vehicle shall park within the lines or markings so established It shall -2- be a violation of this Resolution to park any vehicle across any such line or marking, or to park such vehicle in such position that the same shall not be entirely within the area so designated by such lines or markings Section 7 PARKING TIME LIMIT - MAXIMUM PARKING TIME (1) The time limit for parking on streets and parkillg lots and areas of the Airport property designated shall be as determined by the Airport Manager A parking fee shall be paid by all persons parking a motor vehicle within any parking space in the areas designated in the attached plat and so enumerated as paid parking areas in the amount indicated by a sign or legend installed or posted A sign or legend shall indicate the fee schedule and the time for which parking is permitted (2) The fees for parking in a parking area shall be designated by the Airport Manager (3) If said vehicle shall remain parked or standing in said parking space beyond the legal time which shall be designated by a sign or signs posted showin3 limited parking, such vehicle shall be considered parked overtime The parking of a vehicle overtime shall be a violation of this Resolution and subject the registered owner and/or operator to a penalty as provided herein Section 8 OVERTIME PARKING It shall be a violation of this Resolution for any person to cause, allow, permit or suffer any vehicle registered in the name of such person to be parked overtime or beyond the period of legal parking time established for any parking space or area Section 9 REGISTERED OWNER RESPONSIBLE FOR UNLAWFUL PARKING Every person in whose name a vehicle is registered shall be responsible for any violation of this Resolution caused by the parking, standing or stopping of said vehicle in violation hereof It shall be no defense that the vehicle was parked, stopped or left unattended or standing by another, unless proof is presented that said vehicle had been stolen and had not been returned to the registered owner by the date of the violation This Section shall not apply to registered owners transferring vehicle ownership who ._ -3- • have complied with RCW 46 52 104, as now or hereafter amended, prior to the date of the violation Section 10 PARKING There shall be designated certain , places within the boundaries of the Airport which may be specifically designated for parking by employees of the Port, the Federal Aviation Administration and the Port's tenants Parking in areas so designated and posted by the Airport may be limited to those persons displaying a distinguishing decal as provided by the Port of Pasco, or a decal placed on the vehicle by the car rental agency renting from the Port of Pasco Section 11 OTHER INFRACTIONS The Port of Pasco hereby adopts and incorporates herein, as is set forth in full herein, the traffic ordinances of the City of Pasco as set forth in Chapter 10 05 Pasco Municipal Code as the same presently are and as subsequently amended, including its adoption of the Washington Model Traffic Ordinance, (and only said sections) the following sections of RCW 46 90 46 90 300 46 90 445 46 90 406 46 90 403 46 90 460 46 90 454 46 90 412 46 90 463 46 90 457 46 90 415 46 90 475 46 90 418 46 90 478 46 90 427 46 90 481 46 90 430 46 90 705 46 90 433 46 90 720 46 90 436 46 90 730 46 90 439 46 90 740 46 90 442 46 90 900 Section 12 VIOLATIONS NOT CRIMINAL OFFENSE Failure to perform any rule or regulation, or the performance of any act prohibited by this Resolution shall be designated as a traffic infraction and may not be classified as a criminal offense unless so classified by the R C W Section 13 REQUEST FOR ORDINANCE The Port of Pasco hereby requests the City of Pasco to adopt this Resolution and the provisions hereof as part of the ordinances of the City of Pasco ADOPTED by the Port of Pasco this 26th day of September, 1985 PORT OF PASCO PORT COMMISSION jahae,w, ames L Hay / 42- Rich'ard Banks, Vice President ) \-z. 74,1 -21---n zl t ) ( ) James W Rogers, Secrfetary -4; Subscribed and sworn to bef e this , day of October , 19 85 ORDINANCE NO 2573 , AN ORDINANCE Adopt- ing Parking and Traffic 'Regulations For The Tri-Cit- les Airport Set Forth in Port of Pasco Resolution No 779 and Adding Chapter 10 94 to The Pasco Munici pal Code WHEREAS the Port of Pasco has adopted Resolu- tion 779 which promul- gates rules and regulations governing the parking standing stopping and the use of motor vehicles within the Tr-Cities Airport prop- erty and WHEREAS the Port of !
