HomeMy WebLinkAbout2566 OrdinanceORDINANCE NO. 2566 AN ORDINANCE relating to signs within the City of Pasco, amending PMC Title 17 by enacting a new Chapter 17.46, Off-Premise Signs, and deleting or amending conflicting regulations as provided herein below. WHEREAS, the widespread proliferation of billboard and other off-premise signs throughout the City of Pasco contribute to visual pollution and clutter; excessive traffic inattention and potential accident, injury or congestion therefrom; and the unsightly use of or appearance of the landscape adjacent the public ways; and WHEREAS, the Planning Commission conducted public meetings on April 18 and May 2, 1985, and conducted public hearings on June 20 and July 10, 1985, to consider the issue and concluded additional regulation of off-premise sign structures was warranted to resolve the above-noted concerns; and recommended same to City Council; and WHEREAS, the City Council of the City of Pasco has reviewed the recommendations of the Planning Commission and finds the proposed amendments reasonably provide for the continuance of off-premise advertising within the city while mitigating aforesaid concerns; and concludes the proposed regulation appropriate; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS: Section One. That a new PMC Chapter 17.46, entitled Off-Premise Signs, is hereby enac t ed to read as follows: CHAPTER\17.46 OFF-PREMISES SIGNS Sections: 17.46.010 17.46.020 17.46.030 17.46.040 17.46.050 17.46.060 17.46.070 17.46.080 17.46.090 17.46.100 17.46.010 permitted Generally Off-Premise Sign Corridor Zoning Property Requirements Design Height Display Area Setbacks Spacing Non conforming Signs GENERALLY. Except where otherwise specifically by this title, no person shall erect or maintain any off-premise sign within the City of Pasco except in compliance with this chapter, and in accordance with other provisions of this title. 17.46.020 OFF-PREMISE shall be within a corridor 395 and Interstate highway only the land area within of said highways. SIGN CORRIDOR. All off-premise signs located along state highways 12 and 1-182. The corridor shall include 2,000 feet of the rights-of-way lines 17.46.030 within the Business), 17.46.040 located on ZONING. Off-premise signs shall only be allowed off-premise sign corridor on lands zoned C-3 (General I-1 (Light Industrial) and 1-2 (Heavy Industrial). PROPERTY REQUIREMENTS. Off-premise signs shall be private property adjacent an arterial street. 17.46.050 DESIGN. Off-premise signs shall be designed in accordance with Chapter 17.20. In addition, any such sign with over 150 square feet of display area shall have an open space of not less than six feet between the bottom of the sign and the ground level below. 17.46.060 HEIGHT. The maximum height of an off-premise sign structure shall be thirty-five (35) feet. 17.46.070 DISPLAY AREA. The maximum display area of an off-premise sign shall be three hundred (300) square feet, with no more than two sides of display area. 17.46.080 SETBACKS. Off-premise signs shall be setback from all property lines a distance equal to or greater than the height of the sign structure. 17.46.090 SPACING. No off-premise sign shall be located closer than 500 feet to another off-premise sign; within 100 feet of a public street intersection; or within 300 feet of a residential district. In addition, no off-premise sign with over two hundred square feet of display area shall be located within 250 feet of a freestanding sign which contains over two-hundred square feet of display area. 17.46.100 NON-CONFORMING SIGNS. (a) Off-premise signs which do not conform to the requirements established above shall be removed within five (5) years of the effective date of this ordinance, except as provided in subsections (b) and (c) below. (b) In the event a non-conforming sign was erected without a permit, the owner of the sign shall be given written notice to remove the sign from the property. The compliance period fixed by written notice shall not exceed 60 days. (c) If the removal of any sign requires compensation in accordance with RCW 47.42.107, such sign may remain until the city orders compliance by written notice. Section Two. That PMC Sections 17.08.120 and 17.56.120, and PMC Subsection 17.56.080(d) are hereby repealed in their entirety. Section Three. That PMC Section 17.56.050 is hereby amended as follows: 17.56.050 ZONE C-1 RETAIL BUSINESS DISTRICT. (a) Except as provided in Subsection (d), A any type sign permitted by this title shall be a permitted use. (b) The total display area of all types of signs located on any one parcel in a C-1 zone shall not exceed six hundred square feet except in parcels of ten thousand square feet or more, where the provisions of Section 17.56.110(c) apply. (c) Vertical clearance and projection of signs over public property shall be regulated in accordance with TABLE NO. 3-A. (d) No off-premise signs shall be allowed in a C-1 zone. exeept-withim-the-area-deseribed-im-Seetem-i75671B87 Section Four. PMC Section 17.08.125 which now reads: 17.08.125 OFF-PREMISE SIGN. "Off-premise sign" means a sign which advertises a business service, or product that is not available on the parcel on which the sign is erected. is hereby amended to read as follows: 17.08.125 OFF PREMISE SIGN. "Off-premise sign" means a sign carrying a message of any kind except that pertaining to the business, industry or other pursuit conducted on or within the premises. A sign carrying a message pertaining to the business, industry or other pursuit conducted on or within the premises may also carry a non-commercial message on an equal amount of display area simultaneously and in addition to the commercial message that the sign displays, without coming under the definition of an off-premises sign. Section Five. This Ordinance shall be in full force and effect after its passage and publication as required by law.
