HomeMy WebLinkAbout2564 OrdinanceORDINANCE NO. 2564 AN ORDINANCE Concerning Unlawful Conduct/Solid Waste Containers; and Adding New Sections 9.64.120 and .130 to the Pasco Municipal Code and repealing Section 9.64.110. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section One. New Section 9.64.120 is hereby added to the Pasco Municipal Code and shall read as follows: 9.64.120 WRONGFUL INTERFERENCE WITH SOLID WASTE. It is unlawful for any person, other than the city's solid waste collector or its employee, an employee of the City of Pasco in the course of exercising any of the duties or responsibilities of his position, or the owner, manager or other occupant of the premises where a can or container containing solid waste is located to rummage through, remove or dispose of any of the solid waste contained in any such container without the permission or consent of such owner, manager or other occupant of the premises. "Solid Waste" means all putresible and nonputresible solid and semi-solid waste including garbage, rubbage, ashes, industrial waste, swill, demolition or construction waste. Section Two. New Section 9.64.130 is hereby added to the Pasco Municipal Code and shall read as follows: 9.64.130 CONCEALING OR RECEIVING SOLID WASTE. It is unlawful for any person, other than the city solid waste collector, its employee, an employee of the City of Pasco in the course or discharge of any duty or responsibility of his position, or the owner, manager or other occupant of the premises where a container containing solid waste is located, to knowingly buy, sell, receive, possess, conceal, withhold, or aid in buying, selling, receiving, possessing, concealing, or withholding any of the solid waste contained in any such container without the permission or consent of such owner, manager or other occupant of the premises. Section Three. Section 9.64.160 PENALTY FOR VIOLATION is hereby repealed in order to subject any person convicted of violation of any provision of Chapter 9.64 PMC to the penalty provisions of 1.01.130 PMC.
