HomeMy WebLinkAbout2559 Ordinance2559 ORDINANCE NO. AN ORDINANCE Prohibiting Loitering Under Certain ) Conditions and Adding New Chapter 9.36 to the Pasco Municipal Code. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section One. New Chapter 9.36 relating to Loitering is hereby added to the Pasco Municipal Code and shall read as follows: CHAPTER 9.36 LOITERING Sections: 9.36.010 9.36.020 9.36.030 9.36.040 Prohibited Conduct Circumstances to Cause Alarm Same - Opportunity to Dispel Alarm Same - Requisites for Conviction 9.36.010 PROHIBITED CONDUCT. It shall be unlawful for any person to loiter or prowl in a place, at a time or in a manner not usual for law abiding individuals under circumstances that warrant alarm for the safety of persons or property in the vicinity. 9.36.020 CIRCUMSTANCES TO CAUSE ALARM. Among the circumstances which may be considered in determining whether alarm is warranted is the fact that the person takes flight upon appearance of a police officer, refuses to identify himself or endeavors to conceal himself or any object. 9.36.030 SAME - OPPORTUNITY TO DISPEL ALARM. Unless flight by the person or other circumstances makes it impractical, a police officer shall, prior to any arrest for an offense under this chapter, allow the person an opportunity to dispel any alarm which would otherwise be warranted by requesting him to identify himself and explain his presence and conduct. 9.36.040 SAME - REQUISITES FOR CONVICTION. No person shall be convicted of an offense under this provision if the police officer did not comply with the proceeding section, or if it appears at trial that the explanation given by the person, if believed by the police officer at the time, would have dispelled the oe W.
