AN ORDINANCE permitting the dispensing and consumption of
beer on the Pasco Municipal Golf Course at the Energy Spells
Progress (ESP) Golf Tournament, May 17, 1985.
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section One. On the conditions hereafter specified it
is lawful for Energy Spells Progress (ESP), a non-profit
organization, to dispense beer at a designated location at the
Pasco Municipal Golf Course during the ESP Golf Tournament on May
17 0 1985, and for persons of legal age to possess, display or
consume such beer at such designated location during such golf
tournament. Provided, however, before dispensing beer at the
Pasco Municipal Golf Course ESP must first obtain a permit to do
so from the Director of Parks and Recreation. Such permit shall
be issued only upon the following conditions:
a. ESP must produce evidence of the agreement of the
concessionaire at the Pasco Municipal Golf Course for the
dispensing of beer by ESP; and
b. The applicant must produce evidence of possession of a
permit from the Washington State Liquor Control Board; and
c. The applicant must deposit a sum of two hundred and
fifty dollars ($250.00) to insure proper performance of cleanup
by the applicant subsequent to the event for which the permit is
issued and for payment of damages; and
d. The payment of a fee in the amount of one hundred and
fifty dollars ($150.00). The fee may be waived if the City
Council finds that there is no private profit to be derived from
the dispension of the beer by the applicant organization, or any
other members or representatives thereof; and
e. The applicant agrees that he or she will save the city
of Pasco harmless from all losses or damage occassioned to the
appllcant or to any third person or party by reason of any act or
omissions of the applicant or anyone dispensing, consuming or
possessing beer pursuant to the permit. Applicant shall, after
reasonable notice thereof, pay the expense of any suit which may
be commenced against the city of Pasco by any third person
alleging injury or loss by reason of such acts; and
f. Agreement by the applicant to comply with all
reasonable requests by the Director of Parks and Recreation for
security, traffic control, dispensing beer and clean up; and
g. The applicant shall comply will all other applicable
city codes and regulations.
Section Two. This ordinance shall take effect five (5)

PASSED this 15 day of April, 1985, and approved by
the Mayor.
