AN ORDINANCE concerning the penalties for the violation of
animal control regulations; and amending Chapter 8.04 of the
Pasco Municipal Code.
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section One. Section 8.04.360 of the Pasco Municipal
Code which now reads as follows:
8.04.360 PENALTY PROVISIONS. (a) A violation of any
provision of this chapter except as provided below and
except as provided in Section 8.04.170 shall constitute
an offense punishable by a fine of not less than $50.00
and not more than $500.00.
(b) A violation of Sections 8.04.020 and 8.04.130 shall
constitute an offense punishable by a fine of not less
than $50.00 and not more than $500.00 and/or a jail term
not to exceed six months.
° (c) Each day of a violation shall constitute a separate
violation.

8.04.360 PENALTY PROVISIONS. (a) Any person found to
be in violation of any provision of this chapter, except
as provided below shall be deemed to have committed a
civil infraction and for each violation shall be subject
to a civil penalty in the amount listed, plus
court costs and statutory assessments:
1. First violation within five year period....$30
2. Second violation within five year period...$50
3. Third violation within five year period....$75
4. Violations in excess of third within five year
period $100
(b) A violation of Sections 8.04.020, 8.04.130 and
8.04.170 shall constitute an offense punishable by a
fine of not less than $150.00, no amount of which is to
be suspended or deferred, and not more than $1000.00
and/or a jail term not to exceed one year.
(c) Each day that a violation continues shall be deemed
a separate violation subject to the maximum civil or
criminal penalty, as the case nay be, as set forth in
Subsections (a) and (b) above.
(d) Court costs of ten ($10.00) dollars shall be
assessed in addition to any other fine, penalty,
cost, or statutory assessment imposed.
Section Two. Subsection 8.04.170(f) is hereby repealed.
