HomeMy WebLinkAbout2507 OrdinanceORDINANCE NO. 2507 -B AN ORDINANCE permitting the dispensing and consumption of beer at Memorial Park for the Centennial Celebration Labor Day Picnic and providing for a permit therefore. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section One. On the conditions hereafter specified it is lawful to dispense beer at Memorial Park for the 1984 Centennial Celebration Labor Day Picnic, and to open, possess, display or consumesuch beer at Memorial Park. Any person or persons dispensing beer at Memorial Park must first obtain a permit to do so from the City Council. Such permit shall be issued on the following conditions. (a) the applicant must produce evidence of possession of a banquet permit from the Washington State Liquor Control Board; (b) payment of a fee in the amount of $150.00. The fee may be waived if the City Council finds , that there is no private profit to be derived from the dispension of the beer by the applicant, the organization repre- sented, or any other members or representatives thereof, and the event at which the beer is to be dispensed has a substantial public or community purpose; (c) the applicant deposits a sum of $250.00 to ensure proper performance of the cleanup by the applicant subsequent to the event for which the permit is issued and for payment of damages; (d) the applicant agrees that he or she will save the City of Pasco harmless from all losses or damage occasioned to the applicant or to any third person or party by reason of any act or omissions of the applicant or anyone dispensing, consuming or possessing beer pursuant to the permit. Applicant shall, after reasonable notice thereof, pay the expense of any suit which may be commenced against the City of Pasco by any third person alleging injury or loss by reason of such acts; (e) the applicant shall furnish written confirmation from the Chief of Police of the City of Pasco that adequate provision has been made by the applicant for police, security, and traffic control, considering the type of activity proposed by the applicant; ells, ity C erk ft- A Ordinance No. Page 2 (f) in all cases the dispensing of beer shall be conducted within a specifically defined and segregated area by specific persons who are identified within or along with the permit application. These persons shall be designated as "authorized dispensers". In no case shall self-service of beer be allowed. All consump- tion of the beer shall take place within the specifically defined and segregated area where the beer is dispensed. The means and manner of segregation of the area and the dispension of the beer must be approved by the Director of Parks and Recreation, or his designee; (g) the applicant shall comply with all other applicable city codes and regulations. Section Two. This ordinance shall take effect five (5) days after passage and publication according to law. PASSED this All day of June, 1984, and approved by the Mayor.
