HomeMy WebLinkAbout2504 Ordinance2504 ORDINANCE NO AN ORDINANCE of the City of Pasco relating to Fire Prevention and amending Title 18 of the Pasco Municipal Code by repealing and re- enacting Chapter 18 04 thereof THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS Section 1 That Title 18 of the Pasco Municipal Code be and the same is hereby amended by repealing Chapter 18 04 thereof in its entirety and re-enacting the same to read as follows 18 04 010 ADOPTION OF UNIFORM FIRE CODE There is hereby adopted by the City Council of the City of Pasco, pursuant to the provisions of RCW 35 21 180 and 35A 12 140 for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code and standards known as the Uniform Fire Code, including Appendix- Chapters I-A, I-B, II-A, II-B, II-C, II-D, III-A, III-B, IV-A, V-A, VI-A, VI-C, and the Uniform Fiire Code Standards published by the Western Fire Chiefs Association and the Inter- national Conference of Building Officials, being in particular the 1982 editions thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended of wnich Code and Standards not less than three (3) copies have been and are now filed in the office of the City Clerk of the City of Pasco and the same are hereby adopted and incorporated as fully as if set out at length herein and from the date on which this ordinance shall take effect, the provision thereof shall be controlling within the corporate limits of the City of Pasco It is the specific intent of the fire code of the City of Pasco as herein adopted, modified and amended, to place the obligation of complying with its requirements upon the owners and occupiers of the buildings and premises within the scope, and no provision of nor any term used in this fire code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation and enforcement of this fire code shall be discretionary and not mandatory Nothing contained in this fire code is intended to be nor shall be construed to create or form the basis for any injury or damage resulting from the failure of a building or any premises to comply with provisions of this fire code, or by reason or in consequence of any inspection, notice, order, certificate, permission or approval authorized or issued or done in connection with the implementation or enforcement of this fire code, or by reason of any action or inaction on the part of the City, related in any manner to the enforcement of this fire code by its officers, employees or agents It is expressly the purpose of this fire code to provide for and promote the health, safety and welfare of the general publics andnot to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the provisions of this fire code 18 04 015 SUBSTITUTION FOR SECTION 2 302 OF THE UFC Section 2 302 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 2 302 Appeals Whenever the Fire Chief of the Pasco Fire Department disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of this code do not apply, or that the true intent of the code has been misconstrued or wrongfully interpreted, the applicant may, within thirty (30) days of the decision, appeal that decision to the Board of Appeals established under the Building Code 18 04 020 AMENDMENT FOR ARTICLE 9 OF THE UFC Definitions of the following words and terms in Article 9 of the Uniform Fire Code are amended in Sections 9 107, 9 108 and 9 112, to read as follows Section 9 107 Electrical Code Is the National Electrical Code (currently adopted edition by the State of Washington) and the State of Washington "Rules and Regulations for Installing Electric Wires and Equipment and Administrative Rules " Section 9 108 Fireworks Means those devices meeting the current definition of fireworks as found in the "Washington State Fireworks Law", RCW 70 77 Section 9 112 Jurisdiction Means the City of Pasco Jurisdictional area means that territory included within the Pasco city limits 18 01 030 SUBSTITUTION FOR SECTION 10 207(b) AND (c) OF THE UFC Section 10 207(b) and (c) of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 10 207(b) Obstructing The required width of access roadways shall not be obstructed in any manner, including parking of vehicles, and no person e except a public officer acting within the scope of his public duties, shall obstruct, block or park a vehicle in the access roadway "No Parking" signs and/or other appropriate notice prohibiting obstruction shall be required The installation and maintenance of such signs shall be the responsibility of the owner of the property (c) Access The acces,xoadway shall be extended to within one-hundred-and-fiftyqi5Ofeet of all portions of the exterior walls of the first stor -y -Of any building Any building which exceeds thirty-six (36) feet in height shall have access roadways - 2 - which immediately adjoin the two longest sides of the building, provided that such access roadways may be separated from the building by a yard if the farthest boundary of the access roadway is no more than forty-five (45) feet from the building and such yard provides easy access to the building Where access roadways cannot be provided, approved fire protection system or systems shall be provided 18 04 040 SUBSTITUTION FOR SECTION 11 101 OF THE UFC Section 11 101 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 11 101(a) Permit Required No person shall kindle or maintain any bonfire, campfire, rubbish fire, warming fire, or field fire, or authorize any such fire to be kindled or maintained without a permit EXCEPTION No permit shall be required for residential barbecues provided they do not constitute a fire hazard During the construction or demolition of buildings or structures, no waste materials or rubbish shall be disposed of by burning on the premises or in the immediate vicinity without having obtained a permit A permit shall be required for each construction site A permittee may be issued one permit for multiple locations provided each location is inspected and each location is noted on the permit Burning permits shall be obtained in person between the hours of 8 00 a m and 5 00 p m , Monday through Friday, except on holidays Original burning permits will be issued upon approval, after an on-site inspection of the burning site by a Fire Department representative Permits will be in writing and will be valid for a period of one (1) year from the date of issue, at which time may be renewed Renewal burning permits will not require an on-site inspection for Issuance The Pasco Fire Department may utilize controlled burning for the purpose of training firefighters, without a permit Burning permits will cost Fifteen Dollars ($15 00) No permit shall be issued without the payment of this fee first being made EXCEPTION No permit fee shall be required in cases of financial hardship as determined by the City Manager or his designee for the burning of material that, in the sole determination of the City Manager or his designee, is not reasonably disposable by the City's mandatory garbage collection service Retired persons living on fixed income shall be given special consideration by the City Manager or his designee as hardship cases - 3 - (b) Location Restricted No persons shall kindle or maintain any bonfire, campfire, rubbish fire or warming fire, or authorize such fire to be kindled or maintained on any private land unless (1) The location is not less than twenty-five (25) feet from any structure, power pole, combustible fence, vehicle, trees/shrubs, and not under overhead transmission lines Adequate provision is made to prevent the fire from spreading (2) The fire is contained in an approved waste burner (incinerator) per UFC Section 11 105 and located with respect to combustibles as per UFC Section 11 106 (3) The permittee is in legal control of the lot or parcel of land on which the burning is to be done (c) Open Burning Restrictions Bonfires, rubbish fires and field fires, shall be constantly attended by a competent person until such fire is extinguished Warming fires and campfires shall be under the constant observation of a competent person and shall be extinguished one (1) hour prior to the evacuation of the site A garden hose and water supply and/or other fire extinguishing equipment shall be on hand at the burning site None of the following materials shall be burned Lawn grass clippings, leaves, garbage, dead animals, asphalt, paper, petroleum products, paints, rubber products, plastic, any substance which emits dense smoke or obnoxious odor All controlled burning fires shall be of a size so as not to constitute a fire hazard to surrounding property The size of the fire will be determined at and during the inspection for the permit and shall be listed on the permit Fires on the premises of a residence shall not exceed a size of four (4) feet in diameter or more than four (4) feet in height All controlled burning shall comply with the regulations of the Benton/Franklin/Walla Walla Counties Air Pollution Control Authority It shall be the responsibility of the permittee to check the local conditions prior to burning by calling the phone number listed on the permit (d) Field Fires Open field burning may be allowed when, in the opinion of the Fire Chief, such burning does not constitute a hazard Such burning shall be limited to two (2) acres in area, and shall be surrounded by an effective fire barrier as follows (1) Ten (10) feet from roadways, power poles, combustible fences, vehicles, trees/shrubs and other like areas (2) Twenty-five (25) feet from structures - 4 - Such areas or widths may be modified if, in the opinion of the Fire Chief, they do not constitute a distinct hazard to life or property The fire barrier shall be sufficient to effectively stop or impede the spread of fire in a safe manner (e) Chief May Prohibit The Fire Chief may prohibit outdoor fires when atmospheric conditions or local circumstances make such fires hazardous No person shall kindle any outdoor fire or authorize such fire to be kindled or maintained, even if a permit has been issued, when any of the following conditions are in force (1) If the wind velocity is above ten (10) miles per hour, or (2) If a temperature inversion is present or air circulation is insufficient to disperse smoke, gases and fumes to the extent necessary to protect public health (f) Out-of-Control Fires/Costs In the event that the Pasco Fire Department is called to control or extinguish any fire started under the authority of a permit issued under this section, the person to whom the permit has been issued (permittee) agrees by his or her acceptance of such permit, to be responsible for payment to the City of Pasco of its reasonable costs for labor, equipment, fuel and materials, as determined by the Pasco Fire Chief It shall be unlawful for a permittee to fail to make payment of said costs to the City of Pasco within ninety (90) days of mailing of written demand for said costs through the mail service of the United States Postal Service The conviction of any person for such failure shall constitute a misdemeanor 18 04 050 SUBSTITUTION FOR SECTION 11 102 OF THE UFC Section 11 102 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 11 102 Kindling of Fire on Land of Others Restricted No person shall kindle a fire upon the land of another without written permission of the owner thereof or his agent Such written permission shall be filed with the Pasco Fire Department at the time of the issuance of a permit 18 04 060 SUBSTITUTION FOR SECTION 11 112 OF THE UFC Section 11 112 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 11 112 All outdoor burning shall take place during the hours of 6 00 a m and one (1) hour before sunset or 6 00 p m , whichever comes first EXCEPTION Campfires and bonfires approved by the Fire Chief -5 18 04 070 AMENDMENT FOR SECTION 11 302 Section 11 302 of the Uniform Fire Code is amended by the addition of a new subsection (e) to read as follows Section 11 302(e) It is unlawful for any person, business or legal entity, having or conducting a private fire alarm system to transmit three (3) or more false alarms within a ninety (90) day period The owner of any residence, business or premises in which said alarm system exists, shall be responsible for payment to the City of Pasco of its reasonable costs for labor, equipment, fuel and materials, as determined by the Pasco Fire Chief, for a response by the Fire Department for the third and each subsequent false alarm in a ninety (90) day period For the purposes of this section, the term "False Alarm" means the activation of a fire alarm system because of accident, malfunction or an inadvertent activation, at a time when no fire exists on the premises 18 04 080 SUBSTITUTION FOR SECTION 11 408 OF THE UFC Section 11 408 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 11 408 Any person using a torch or other flame- producing device for removing paint, thawing pipes or sweating pipe joints from or in any building or structure, shall provide one (1) approved fire extinguisher or water hose equipped with a suitable nozzle, sufficient in length to reach all portions of the building and connected to a water supply on the premises where said burning operation is performed Combustible material in the close proximity of open flame shall be protected against ignition by shielding, wetting or other means In all cases, a fire watch shall be maintained in the vicinity of the operation for one half hour after the torch or flame-producing device has been used 18 04 085 SUBSTITUTION FOR SECTION 11 415 OF THE UFC Section 11 415 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 11 415 It shall be unlawful to park, store or repair any gasoline or gas-fueled vehicle, motorcycle, moped or other similar device in any dwelling unit (other than a single family residence), office, exitway or location, that would create a fire or life hazard 18 04 090 SUBSTITUTION FOR SECTION 25 118(b)4 OF THE UFC Section 25 118(b) 4 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 25 118(b) 4 Not withstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand held candles No permit is required for battery- operated candles or other electric candles 18 04 100 AMENDMENT FOR SECTION 77 106(b) OF THE UFC Section 77 106(b) of the Uniform Fire Code is amended to read as follows Section 77 106(b) Establishment of limits of districts in which storage of explosives and blasting caps is to be prohibited The limits referred to in Section 77 106(b) of the Uniform Fire Code in which storage of explosives and blasting agents is prohibited, is established as follows All use districts except I-1 (light industrial) and 1-2 (heavy industrial) -6 18 04 110 SUBSTITUTION FOR SECTION 78 102 OF THE UFC Section 78 102 of the Uniform Fire Code is omitted and the following shall be substituted in its place Section 78 102 Manufacture, Sale and Discharge of Fireworks A The manufacture of fireworks is prohibited within the City and all districts, except by special permit, and only in I-1 (light industrial) and 1-2 (heavy industrial) B Except as herein provided, it is unlawful for any person to possess, store, offer for sale, expose for sale, sell at retail, or use, or explode, fire, or discharge any fireworks (1) The Fire Chief is authorized to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks Applicants shall meet all qualifica- tions and requirements of State law regarding public display of fireworks and all fire and safety requirements as set forth here in the standards for public display Every operator shall have first obtained a state license pursuant to RCW 70 77 300 The display shall be of such character and so located, discharged or fired that, after proper inspection, shall not be hazardous to property or endanger any person (2) The Fire Department shall issue each year permits for the sale of fireworks to persons, corporations, or organiza- tions, after investigation and determination that the location where the fireworks are to be sold is not hazardous to property and does not endanger any person, and that the persons in charge of selling the fireworks are competent and trained to handle such fireworks (3) The use, sale and discharge of fireworks shall be governed at all times by the provisions of RCW 70 77 and by the rules and regulations of the State Fire Marshall adopted pursuant to the authority of said statute (4) The fee for a local fireworks display or sales permit shall be Twenty-Five Dollars ($25 00), the fee to be payable to the City Finance Office upon approval of the application by the Fire Department, and is a non-refundable fee (5) Applications for local fireworks display and sales permits shall be investigated for matters concerning the applicants past history of compliance with safety regulations and present measures for minimizing safety risks C Standards for Retail Sales of Fireworks Retail sales permit holders shall conform to the following minimum standards and conditions (1) Every operator shall have first obtained a State License pursuant to RCW 70 77 -7 - (2) Fireworks sold at retail shall be sold only in temporary stands or in buildings used for no other purpose (3) Each sellers permit issued under this chapter shall be for only one (1) retail outlet (4) Fireworks may be issued, fired, or discharged in the City during the period commencing at 12 00 o'clock noon on the twenty-eighthof furie and ending at 12 00 o'clock noon on the sixth day of July each year (5) The retailer or person in charge and responsible for the retail operation shall be over eighteen (18) years of age, of good moral character and of demonstrated responsibility In no case shall there be anyone under the age of eighteen (18) in the sales stand at any time the stand is stocked (6) A plot plan showing the exact location of the stand shall be submitted to the Fire Department for/ approval (Stands located on street corners shall be located at least twenty (20) feet from that corner in all directions) (7) Each applicant shall present written permission from the legal controller (be it the property owner or the tenant) of the property, authorizing use of the property on which the display and/or retail sales of fireworks is to take place (8) Fireworks stands shall be permitted only in commercial and/or industrial use districts Stands shall be located a minimum distance of fifty (50) feet from any building (9) Each retail fireworks stand shall be so located that motor vehicles cannot park within twenty-five (25) feet of such stands (Barriers shall be provided to restrict vehicle traffic) (10) There shall be no accumulation of dry grass, paper, cardboard, trash, lumber or other combustibles, within twenty- five (25) feet of any retail fireworks outlet (11) Each retail fireworks stand shall be so located that no flammable/combustible liquid and/or liquified petroleum gas dispensing or storage equipment is within one hundred (100) feet of such stand. (12) The site of each sale stand shall be inspected by a representative of the Pasco Fire Department before issuance of a permit (13) Each stand shall have a minimum of two (2) exits and be unobstructed at all times -8 (14) Each retail fireworks location shall have not less than two (2) water type extinguishers of not less than two and one half (2 1/2) gallon capacity or equivalent Water barrels will be acceptable Such fire extinguishers and/or barrels shall be in place prior to the stocking of the stand (15) "No Smoking" signs shall be posted at conspicuous locations on all exterior walls of the fireworks stand or structure and such areas as may be designated by the inspecting authority Each sign shall have the words "No Smoking" in letters not less than two (2) inches in height All signs shall be maintained in a legible condition Smoking shall be prohibited within twenty-five (25) feet of any fireworks stand or building in which fireworks are sold or stored (16) The permit shall be posted in a conspicuous place on the premises for which it was issued (17) Stock from the stand shall not be removed and stored in any other building during the sales period without the express approval of the Fire Department (18) Periodic inspections of the fireworks stands and/ or premises storage location will be made to assure compliance with the requirements (19) Temporary fireworks stands need not comply with all provisions of the building code, provided,,however, that all such stands be erected and constructed in, safe manner ensuring the safety of attendants and patrons In the event any temporary stand is wired for electricity, the wiring and devices shall conform to the electrical code (20) Temporary structures and stands used for the retail sales of fireworks shall be removed from the premises within one (1) week after July 6th of each year Any such stand or structure remaining beyond the one (1) week may be removed by the Fire Department at the expense of the permittee or owner (21) It is unlawful to use, fire, or discharge any fireworks along the route of and during any parade or at any place of public assembly or in any commercial use district Fireworks shall not be discharged within twenty-five (25) feet of any fireworks stand or building in which fireworks are sold or stored (22) It is unlawful at any time to throw or toss any fireworks at any person, animal, or vehicle (23) No permit granted herewithin shall be transferable -9 Standards for Public Fireworks Displays All public fireworks displays shall conform to the following minimum standards and conditions (1) Applications for permits for public display of fireworks shall be made in writing at least ten (10) days in advance of the display (2) All public fireworks displays must be planned, organized, and discharged by a State of Washington licensed Pyrotechnician (3) A permit must be obtained from the City of Pasco and approved by the Fire Chief or his designee prior to any display of public fireworks The permit shall include the name of the applicant and his address, the name of the Pyro- technician and his address, the exact location, date and time of the proposed display, the number, type and class of fireworks to be displayed, the manner in which the fireworks are being stored prior to the public fireworks display, and shall include the name and address of the insurance company providing the bond required (4) A drawing shall be submitted to the Fire Department showing a plan view of the fireworks discharge site and the surrounding area within a five hundred (500) feet radius The drawing shall include all structures, fences, barricades, streets, fields, streams and any other significant factors that may be subjected to ignition or that may inhibit fire fighting capabilities (5) A City of Pasco Fire Department pumper and a minimum of two (2) trained City of Pasco firefighters shall be on site thirty (30) minutes prior to and after the shooting of the event Reasonable compensation for stand-by apparatus and manpower may be necessary as determined by the Fire Chief Any compensation for Fire Department apparatus and manpower will be as per the Washington State Chiefs' Association fee schedule (6) All combustible debris and trash shall be removed from the area of discharge for a distance of three-hundred (300) feet in all directions (7) All unfired or "DUD" fireworks shall be disposed of in a safe manner (8) A minimum of two 2A rated pressurized water fire extinguishers and one (1) fire blanket shall be required to be at the fireworks discharge site (9) The permit may be immediately revoked at any time deemed necessary by the Fire Department due to any noncompliance or weather conditions, such as extremely low humidity or wind factor The display may also be cancelled by accidental ignition of any form of combustible or flammable material in the vicinity due to falling debris from the display - 1 0 - (10) Areas of public access shall be approved by the Fire Department and maintained in an approved manner 18 04 120 SUBSTITUTION FOR SECTION 78 103 OF THE UFC Section 78 103 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 78 103 Insurance Required The applicant for a permit for sales of fireworks shall file with the Fire Chief a public liability and property damage insurance policy providing coverage with limits not less than Five Hundred Thousand Dollars ($500,000) for the payment of damages to persons or to property which shall or may result from or be caused by sales of fireworks, or any act or failure to act of the applicant or his or its agents, servants, employees or subcontractors in the presentation of such sales The applicant for a permit for a public display of fireworks shall file with the Fire Chief a copy of a public liability and property damage insurance policy providing coverage with minimum limits as specified in RCW 70 77 295, however, the holder of a general license from the State Fire Marshall and, upon compliance with RCW 70 77 355, shall be excused from compliance with this section 18 04 130 SUBSTITUTION FOR SECTION 78 106 OF THE UFC Section 78 106 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 78 106 Seizure of Fireworks Any member of the Pasco Police or Fire Departments is hereby authorized and empowered to seize, take, remove or cause to be removed, at the expense of the owner, any and all stocks of fireworks offered or exposed for sale, stored, or transported, or held in violation of this article 18 04 140 AMENDMENTS FOR SECTION 79 101 OF THE UFC Section 79 101 of the Uniform Fire Code is amended by the addition of a new subsection (d) to read as follows Section 79 101(d) Notwithstanding any other provision of the Uniform Fire Code, flammable and combustible liquids shall not be stored and dispensed from portable or fixed equipment into the fuel tanks of motor vehicles in any use district classified under Title 22 of the Pasco Zoning Code, as R-1 (low density), R-PS,i(Suburban), R-2, R-3 (medium density), R-4, R-5 (high density), and RMH 1, 2, 3 Use Districts 18 04 150 AMENDMENT FOR SECTION 79 501 OF THE UFC Section 79 501 of the Uniform Fire Code, is amended to read as follows Section 79 501 Establishment of limits of districts in which storage of Class I and Class II liquids in aboveground tanks is prohibited Zoe W Ja sari, Mayor Rubstelio, City Attorney - 12 - (a) The limits referred to in Section 79 501 of the Uniform Fire Code in which §toirage of Class I and Class II liquids in outside, aboveground tanks is prohibited, are established as follows All districts except I-1 (light industrial), 1-2 (heavy industrial), and AG (Agricultural) 18 04 160 AMENDMENT FOR SECTION 82 105 OF THE UFC Section 82 105 of the Uniform Fire Code is amended to read as follows Section 82 105 Establishment of limits in which bulk storage of liquidied petroleum gas is to be restricted The limits referred to in Section 82 105 (a) of the Uniform Fire Code in which bulk storage of liquified petroleum gas is restricted, are established as follows All use districts except I-1 (light industrial) and 1-2 (heavy industrial) 18 04 170 AMENDMENT FOR APPENDIX I-A Appendix I-A of the Uniform Fire Code is amended by the deletions as follows Subsection (b) (Effective Date) (of 1 General) is deleted in its entirety Section 4 (Basement access or sprinkler protection) is deleted in its entirety 18 04 180 VIOLATIONS - PENALTIES Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than Five Hundred Dollars ($500) or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment Section 2 This ordinance shall be in full force and effect upon its passage and publication as required by law PASSED by the C ouncil if the City of Pasco this day of , 1984 LEGALS - without having obtained a permit A permit shall be required for each construction site A permittee may be is sued one permit for mul tiple locations provided each location is inspected and each location is noted on the permit Burning per mits shall be obtained in person between the hours of 8 00 a m and 5 00 p m Monday through Friday ex cept on holidays Original burning permits will be is- sued upon approval after an on site inspection of the burning site by a Fire De partment representative Permits will be in writing and will be valid for a period of one (1) year from the date of issue at which time may be renewed Renewal burning permits will not require an on site inspection for issuance The Pasco Fire Department may utilize controlled burn- ing for the purpose of train mg firefighters without a permit Burning permits will cost Fifteen Dollars ($15 00) No permit shall be issued with out the payment of this fee first being made EXCEPTION No permit 1 LEGALS fee shall be required in cases of financial hardship as determined by the City Manager or his designee for the burning of material that in the sole determin ation of the City Manager or his desginee is not rea- sonably disposable by the City s mandatory garbage collection service Retired persons living on fixed in come shall be given special consideration by the City Manager or his desginee as hardship cases (b) Location Restricted No persons shall kindle or maintain any bonfire campfire rubbish fire or warming fire or authorize such fire to be kindled or maintained on any private land unless (1) The location is not less than twenty-five (25) feet from any structure power pole combustible fence vehicle trees/sh rubs and not under over- head transmission lines Adequate provision is made to prevent the fire from spreading (2) The fire is contained in an approved waste bur ner (incinerator) per UFC Section 11 105 and located with respect to combust' Wes as per UFC Section 11 106 (3) The permatee is in legal control of the lot or parcel of land on which the burning is to be done (c) Open Burning Re- strictions Bonfires rub- bish fires and field fires shall be constantly at- tended by a competent per son until such fire is extinguished Warming fires and campfires shall be under the constant obser- vation of a competent per son and shall be extinguished one (1) hour prior to the evacuation of the site A garden hose and water supply and/or other fire ex tinguishing equipment shall be on hand at the burning site None of the following materials shall be burned Lawn grass clippings leaves garbage dead ant mals asphalt paper petro- leum products paints rul?ber products plastic any substance which emits dense smoke or obnoxious odor All controlled bunng fires shall be of a size so as not to constitute a fire hazard to surrounding property The size of the fire will be deter mined at and during the in spection for the permit and shall be listed on the per mit Fires on the premises of a residence shall not ex ceeda size of four (4) feet in diameter or more than four (4) feet in height All controlled burning shall comply with the regu- lations of the Benton/Frank lin/VValla Walla Counties Air Pollution Control Authority It shall be the responsibility of the permitee to check the local conditions prior to bur ring by calling the phone number listed on the per mit (d) Field Fires Open field burning may be al lowed when in the opinion of the Fire Chief such burn ing does not constitute a hazard Such burning shall be limited to two (2) acres in area and shall be sur rounded by an effective fire barrier as follows (1) Ten (10) feet from roadways power poles combustible fences vehi- cles trees/shrubs and 1 LEGALS other like areas (2) Twenty-five (25) feet from structures Such areas or widths may be modified if in the opinion of the Fire Chief they do not constitute a dm- tin:3 hazard to life or prop- erty The fire barrier shall be sufficient to effectively stop or impede the spread of fire in a safe manner (9) Chief May Prohibit The Fire Chief may prohibit outdoor fires when atmo- spheric conditions or local circumstances make such fires hazardous No person shall kindle any outdoor fire or authorize such fire to be kindled or maintained even if a permit has been issued when any of the following conditions are in force (1) If the wind velocity is above ten (10) miles per hour or (2) If a temperature inver- sion is present or air circu- lation is insufficient to disperse smoke gases and fumes to the extent nec essary to protect public health (f) Out-of-Control Fires- /Costs In the event that the Pasco Fire Department is called to control or extin- guish any fire started under the authority of a permit is- sued under this section the person to whom the permit has been issued (permittee) agress by his or her accep- tance of such permit to be responsible for payment to the City of Pasco of its rea- sonable costs for labor equipment fuel and materi- als as determined by the Pasco Fire Chief It shall be unlawful for a permittee to fail to make payment of said costs to the City of Pasco within ninety (90) days of mailing of written demand for said costs through the mail service of the United States Postal Services The conviction of any person for such failure shall constitute a misde- meanor 18 04 050 SUBSTITU TION FOR SECTION 11 102 OF THE UFC Sec bon 11 102 of the Uniform Fire Code is omitted and the following shall be sub- stituted in its place Section 11 102 Kindling of Fire on Land of Others Restricted for a re- sponse by the Fire Depart- ment for the third and each subsequent false alarm in a ninety (30) day period For the purpose of this section the term "False Alarm" means the activation of a fire alarm system because of accident malfunction or an inadvertent activation at a time when no fire exists on the premises 18 04 080 SUBSTITU- TION FOR SECTION 11 408 OF THE UFC Sec- tion 11 408 of the Uniform Fire Code is omitted and the following shall be sub- stituted in its place Section 11 408 Any per- son using a torch or other flameproducing device for removing paint thawing pipes or and regulations for the granting of permits for supervised public dis- play of fireworks Appli- cants shall meet all qualifications and require- ments of State law regard- ing public display of fireworks and all fire and safety requirements as set forth here in the standards for public display Every op- erator shall have first ob- tained a state license pursuant to RCW 70 77 300 The display shall be of such character and so located discharged or fired that after proper in- spection shall not be haz ardous to property or endanger any person (2) The Fire Department shall issue each year per mits for the sale of fire- works to persons corporations or organiza- tions after investigation and determination that the location where the fire works are to be sold is not hazardous to property and does not endanger any per son and that the persons in charge of selling the fire- works are competent and trained to handle such fire works (3) The use sale and dis- charge of fireworks shall be governed at all times by the provisions of RCW 70 77 and by the rules and regu- lations of the State Fire Marshall adopted pursuant to the authority of said stat- ute (4) The fee for a local fire- works display or sales per mit shall be Twenty Five Dollars ($25 00) the fee to be payable to the City Fi- nance Office upon approval of the application by the Fire Department and is a non-refundable fee (5) Applications for local fireworks display and sales permits shall be invest' gated for matters concern ing the applicants past history of compliance with safety regulations and pre- sent measures for minimiz- ing safety risks C Standards for Retail Sales of Fireworks Retail sales permit holders shall conform to the following minimum standards and conditions (1) Every operator shall have first obtained a State License pursuant to RCW 70 77 (2) Fireworks sold at re- tail shall be sold only in temporary stands or in buildings used for no other purposes (3) Each sellers permit is- sued under this chapter shall be for one (1) retail outlet (4) Fireworks may be is sued fired or discharged in the City during the period commencing at 12 00 o clock noon on the twenty- eighth of June and ending at 10 00 o clock noon on 1 LEGALS the sixth day of July each year (5) The retailer or person in charge and responsible for the retail operation shall be over eighteen (18) years of age of good moral char acter and of demonstrated responsibility In no case shall there be anyone under the age of eighteen (18) in the sale stand at any time the stand is stocked (6) A plot plan showing the exact location of the stand shall be submitted to the Fire Department for ap- proval (Stands located on street corners shall be lo- cated at least twenty (20) feet from the corner in all directions ) (7) Each applicant shall present written permission from the legal controller (be it the property owner or the tenant) of the property au- thorizing use of the prop- erty on which the display and/or retail sales of fire- works is to take place (8) Fireworks stands shall be permitted only in commercial and/or indus- trial use districts Stands shall be located a minimum distance of fifty (50) feet from any building (9) Each retail fireworks stand shall be so located that motor vehicles cannot park within twenty-five (25) feet of such stands (Bar news shall be provided to re- strict vehicle traffic) (10) There shall be no ac- cumulation of dry grass paper cardboard trash lumber or other combusti- bles within twenty five (25) feet of any retail fireworks outlet (11) Each retail fireworks stand shall be so located that no fiammable/com bustible liquid and/or liqui- fied pertroleum gas dispensing or storage equipment is withon one hundred (100) feet of such stand (12) The site of each sale stand shall be inspected by a representative of the Pasco Fire Department be- fore issuance of a permit (13) Each stand shall have a minimum of two (2) exists and be unobstructed a tI4 I Each retail fireworks location shall have not less than two (2) water type ex tinguishers of not less than two and one half (2 1/2) gal Ion capacity or equivalent Water barrels will be accep- table Such fire extinguish ers and/or barrels shall be in place prior to the stock- ing of the stand (15) "No Smoking" signs shall be posted at conspic- uous locations on all exte- nor walls of the fireworks maintained in a legible condition Smok ing shall be prohibited within twenty five (25) feet of any fireworks stand or building in which fireworks are sold or stored (16) The permit shall be posted in a conspicuous place on the premises for which it was Issued (17) Stock from the stand shall not be removed and stored in any other building during the sales period without the express appro- val of the Fire Department (18) Periodic inspections of the fireworks stands and/or premises storage 10- 1 LEGALS cation will be made to as- sure compliance with the requirements (19) Temporary fireworks Fireworks shall not be discharged wothIn twenty five (25) feet of any fireworks stand or building in which fireworks are sold or stored (22) It is unlawful at any time to throw or toss any fireworks at any person an- imal or vehicle (23) No permit granted herewithin shall be transfer- able D Standards for Public Fireworks Displays All public fireworks displays shall conform to the follow- ing minimum standards and conditions (1) Applications for per- mits for public display of fireworks shall be made in writing at least ten (10) days in advance of the display (2) All public fireworks displays must be planned, organized and discharged by a State of Washington censed Pyrotechnician (3) A permit must be ob- tamed from the City of Pasco and approved by the Fire Chief or his desginee prior to any display of pub- tic fireworks The permit shall include the name of the applicant and his ad- dress the name of the Py- rotechnician and his address the exact location date and time of the
