ORDINANCE NO. 2498
AN ORDINANCE concerning solid waste collection services
and amending Section 6.04.310 of the Pasco
Municipal Code.
WHEREAS, the City of Pasco provides for solid waste collection
by contracting with a private contractor, which contractor does its
own billing for services; and
WHEREAS, Chapter 35.21 RCW provides that upon the failure to
pay garbage collection charges, the amount thereof shall become a
lien against the property for which the garbage collection service
is rendered and provides certain procedures for the foreclosure
of said lien; and
WHEREAS, it is the desire of the Pasco City Council that its
contractor for solid waste collection services have the authority
to foreclose on said liens for delinquent service charges, now,
therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section One. Subsection 6.04.310(b) is hereby amended to
read as follows:
In the event of delinquency, charges for solid waste
collection and disposal shall become a lien against
the property. The city's contractor for solid waste
collection services shall have the authority as the City's
assignee to foreclose any such lien per the procedure
set forth in RCW 35.21.140. If an account is delin-
quent for two months or more the customer may be
charged, after written notice thereof, interest at the
rate of twelve percent (12%) per annum from the date
of delinquency or fifty cents ($.50) whichever is
greater. The customer is always responsible for any
costs of collection, including attorney's fees.
Billings for commercial accounts should be mailed to
the tenant in possession unless special instructions
to the contrary are received from the owner. Billings
for a residence or a multifamily residence may be
charged to the tenant in possession of the premises
provided prior written authorization has been given
by the property owner and any required deposit has
been made. The person receiving the billing is also
responsible for the charges.
Section Two. This ordinance shall take effect five (5) days
after passage and publication. 7-Th
