AN ORDINANCE relating to zoning by amending PMC Chapter
22.82.
WHEREAS, the City Council of the City of Pasco, in March
1979, adopted Ordinance No. 2036 setting forth certain landscape
and screening requirements for commercial and industrial develop-
ments within the City of Pasco, and further, providing a two (2)
year period from the effective date of Ordinance No. 2036, within
which all existing commercial or industrial developments must
comply with applicable provisions of Ordinance No. 2036; and
WHEREAS, the City Council of the City of Pasco, in March
1981, adopted Ordinance No. 2253, extending to April 2, 1982, the
compliance provisions embodied in Ordinance No. 2036 due to
distressed economic conditions throughout the region, thereby
making compliance unusually burdensome to existing commercial
and industrial development within the City of Pasco; and
WHEREAS, the City Council conducted a public hearing on
April 16, 1984, due notice of which was properly given and
concluded that the provisions of Ordinance No 2036 as extended
by Ordinance No. 2253 relating to existing commercial or industrial
developments remain desirable goals but the time period in which
such developments must comply should be further extended to
alleviate the unusual hardship presented by present economic
conditions; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS
FOLLOWS:
Section 1. That Section 22.82.020 of the Pasco Municipal
Code be and the same is hereby amended to read as follows:
PMC 22.82.020 APPLICATION OF CHAPTER. The requirements
contained in this Chapter shall be deemed to be minimum standards
for landscape and screening within the commercial and industrial
districts of the City and, within said districts, shall be fulfilled
in accordance with the following:
a) NEW DEVELOPMENTS. New commercial or industrial
developments shall comply with all of the require-
ments in this Chapter.
b) EXISTING DEVELOPMENTS. Commercial or industiral
developments existing upon March 2, 1979:

1) Shall comply with the screening requirements of
this Chapter by April 2, 1987;
2) Shall fulfill twenty-five (25) percent of the
landscape area requirements of Section 22.82.040
(a) by April 2, 1987;
3) In conjunction with any gross floor area expansion,
shall provide landscape as required by this Chapter
to the extent of net lot area related to said
expansion.
c) The owner, occupant and person responsible for or having
control of the premises shall be responsible for compliance
with the requirements of this Chapter.
Section 2. This Ordinance shall be effective upon its passage
and publication as required by law.
