AN ORDINANCE CONCERNING THE EQUIPMENT RENTAL FUND AND
AMENDING SECTION 3.68.070 OF THE PASCO MUNICIPAL CODE.
WHEREAS, the City Council has determined on information
and recommendation from city staff that the city's equipment
rental fund has accumulated funds in excess of its needs and
unnecessary to the fulfillment of the purposes for which the
fund was created; and
WHEREAS, the City Council has further determined that a
mechanism should be provided for the removal of accumulated
excess funds from the equipment rental fund back to the funds
and departments participating in the equipment rental fund;
and
WHEREAS, the City Council has further determined that
monies returned from the equipment rental fund to the parti-
cipating funds and departments should be returned to the
closest extent possible in relation to the source of such
excess funds to the equipment rental fund, but the City Council
further realizing that over the years the source of the excess
funds now existing has become blurred in city finance records
and impossible to decipher to an accurate extent, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN
AS FOLLOWS:
SECTION ONE. Section 3.68.070 of the Pasco Municipal Code
is hereby amended by the following underlined additions to read
as follows:
3.68.070 UNEXPENDED MONEY. All monies deposited
in the equipment rental fund and not expended as
provided herein shall remain in the fund from year
to year and shall not be transferred to any other
fund or expended for any other purposes whatsoever;
provided, however, the City Council by a favorable
vote of one greater than the majority present at such
meeting as the vote on a motion is taken, may approve
the reversion to the several funds and departments
participating in the equipment rental fund such monies
in the fund that the City Council determines to be
in excess of the needs of the fund and unnecessary
to the fulfillment of the purposes for which the fund
was created; or approve return to the fund of origin
monies in the fund for the replacement of a vehicle
or equipment that will not be replaced.
SECTION TWO. The following amount of monies are determined
to be in excess of the current needs of the equipment rental
fund and unnecessary to the fulfillment of the purposes for which
the fund was created and shall be returned to the following
named funds according to the distribution set forth below:

SECTION THREE. This ordinance shall take effect five (5) days
after passage and publication according to law.
