ORDINANCE NO. 2448 AN ORDINANCE amending Section 22.68.020 of the Pasco Municipal Code and relating to radiological and chemical waste WHEREAS, the City Council after hearing the recommendation of staff and the City Planning Commission, and after due deliberation and discussion, has determined that the disposal, handling, storage or transportation of certain radiological and chemical waste should be allowed in the city only upon a permit granted by the City Council, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS. Section 1. Section 22.68.020 of the Pasco municipal Code is amended by the addition of Subsection (n) which shall read as follows: (n) No person, firm, or corporation shall use any parcel(s), lot(s), or tract(s) of land in the city for (1) disposal of "dangerous" or "extremely hazardous" waste (chemical) as defined by Chapter 173-303 WAC, or (11) any operation involving radioactive material greater than one(1) curie and in a sealed form, or any radioactive material in a non-sealed form, but excluding any place of medical practice; except upon a permit granted by the City Council applied for in the manner prescribed by PMC 22.80 and after receipt by the City Council of the recommendation of the City Planning Commission. In considering the application for any such permit, the City Council shall, in addition to considering the recommendation of the City Planning Commission, consider the location of the Proposed use, the zoning ordinances of the city, the threat to the public health, safety or welfare, the effect of surrounding property values and development, reclamation of property, and the suitability of the Property for the use proposed. Section 2. This ordinance shall take effect five days after passage and publication according to law. PASSED by the City Council and apnroved by the mayor this 1 8 day of April, 1983. shall be paid into the Bond Fund There previously has been created by Ordinance No 2111 the office of the City Finance Director a special fund known and desig- nated as the "Pasco Municipal Golf Course Redevel- opment Funds The principal proceeds and premium if any received from the sale and delivery of the Bonds shall be paid into the 'Pasco Municipal Golf Course Re- development Fund" and used for the purposes specified in Section 5 of this ordinance and to pay the costs of issu- ance and sale of the Bonds Pending the expenditure of such principal proceeds the City may temporarily invest such proceeds in any legal investment and the invest ment earnings may be retained in the Pasco Municipal Golf Course Redevelopment Fund and expended for the purposes of such fund All taxes collected for ana allo- cated to the payment of the principal of and interest on the Bonds hereafter shall be deposited in the Bond Fund Section 11 The Bonds shall be sold for cash at public sale for not less than par plus accrued interest to the date of delivery of and payment for the Bonds The City Clerk is authorized to give notice calling for bids to purchase the Bonds by publishing such notice as required by law and a short abbreviated form of such no- tice also shall be published once in the Seattle Daily Jour- nal of Commerce and Northwest Construction Record of Seattle Washington at least ten days prior to the sale date Such notice shall specify that sealed bids for the purchase of the Bonds shall be received by the City Clerk in her office in the City Hall on May 9 1983 up to 2 00 p m local time at which time all bids will be publicly opened and read and an award made by the City Council at its regular meeting to be held in the City Council Chambers commencing at 8 00 p m local time on the same date Bids shall be invited for the purchase of the Bonds with fixed maturities in accordance with the schedule social- lied in Section 6 hereof The notice shall specify the maximum effective rate of interest the Bonds shall bear namely 13% per annum and shall require bidders to submit a bid specifying (a) The lowest rate or rates of interest and premium if any above par at which the bidder will purchase the Bonds or (b) The lowest rate or rates of interest at which the bid- der will purchase the Bonds at par No bid will be considered for the Bonds for less than par prommtely 20 000 US Army troops (including National Guard and Reserve unit support) to include 150 he licopters 90 tanks and 1 500 wheeled vehicles will constitute the US Army force The US Air Force will participate with approxi- mately 3 000 personnel at various Air Force installa- tions Air Force support will consist of using C 141 and C 130 aircraft to deploy 9th ID forces and providing live bombings within the ar- tillery impact area at YFC in vsu rpsport of combat maneu e Alternatives considered included (1) Conduct corn bat maneuvers at YFC and lease additional land from private owners the State of Washington other federal agencies and the Hanford (AEC) Reservation for sup- port activities (2) Utilize only YFC for all combat ma- neuver and support activ- ities (3) Do not conduct the exercise (4) Conduct the exercise at Ft Lewis (5) Use another military instal lation for the exercise and (6) Reduce the size of the exercise Alternative 1 was the alternative chosen as it best meets the training re quirements of the 9th ID and it has been determined that the proposed action can be mitigated to ensure that long-term degradation of the environment will not occur at YFC or the off post sites Anticipated environmen tal impacts include distur bance of geology soils and local ecosystems resulting from tracked/wheeled vehi cle traffic bivouac areas various types of excava- tions and explosive ordi- nance impact Other anticipated impacts include the generation of air pollut- ants in the form of carbon monoxide hydrocarbons oxides of nitrogen and par ticulates Water quality may be impacted by vehicular traffic excavations possi- ble fuel spills etc Also noise levels can be ex- pected to increase as a re sult of maneuvers weapons firing and the op- erations of helicopters and high performance aircraft Finally there is potential for damage to the 200 + arche ological sites from vehicle traffic excavations and pil- ferage of artifacts and re- mains by military troops The following mitigative actions are being taken to reduce the potential for ad- verse environmental im- pacts resulting from FTX LASER MACE (1) An over printed map showing all sensitive and restricted areas was developed and distributed for use in the exercise (2) A major envi- ronmental protection brief- ing will be presented to all troops (including National Guard and Reserve units) prior to the exercise (3) A Leaders Handbook" on protecting resources during training was developed and 4 000 copies have been distributed (4) A detailed environmental protection maneuver damage and po lice annex was prepared for inclusion into LASER MACE planning guidance (5) Ecologically sensitive areas and archeological- /historical resources have been put off limits and posted with signs or fenced as
