AN ORDINANCE relating to fire prevention and the manufacture, import, possession, sale, and display of fireworks in the City of Pasco and amending Chapter 18.04 of the Pasco Municipal Code by the amendment of Sections .020 and .110 thereof. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section One. Section 18.04.020 of the Pasco Municipal Code which amends certain definitions in Article 9 of the Uniform Fire Code is hereby amended to read in its entirety as follows: 18.04.020 AMENDMENT FOR ARTICLE 9 OF THE UFC. Definitions of the following words and terms in Article 9 of the Uniform Fire Code are amended in Sections 9.108 and 9.112, to read as follows: Section 9.108. FIREWORKS means any com- position or device, in a finished state, containing any combustible or explosive substance for the purpose of producing a visible or audible affect by combustion, explosion, deflagration, or detonation, _ and classified as common or special fire- works by the United States Bureau of Explo- sives or contained in the regulations of the United States Department of Transpor- tation. Section 9.112. JURISDICTION means the City of Pasco Jurisdictional area means that territory included within the Pasco City Limits. Section Two. Section 18.04 110 of the Pasco Municipal Code relating to the manufacture, sale and discharge of fireworks in the City of Pasco, is hereby amended in its entirety to read as follows: 18.04.110 SUBSTITUTION FOR ARTICLE 78 OF THE UFC. Article 78 of the Uniform Fire Code titled "Fire- works" shall be omitted and the following shall be substituted in its place. ATTE Eve •. Wells, City Clerk ARTICLE 78 FIPEWORKS (a) The manufacture of fireworks is prohibited within the City and all districts except by special permit and only in I-I (light industrial) and I-II (heavy industrial) (b) The "Washington State Fireworks Law" RCW 70.77, as amended, and all other rules and regu- lations of the State Fire Marshal (WAC 212-14), as amended are hereby adooted by this specific reference as if set forth herein. (c) The local retail fireworks permit fee shall be $(-2'5 00, ffect -i-e January 1, 1983 Section Three. This ordinance is for the health and safety of the community and an emergency is hereby declared and this ordi- nance shall take effect immediately upon passage and publication. 2, a 0 approved by the Mayor.
