AN ORDINANCE amending Section 5.44.040 of the Pasco Municipal
Code by eliminating the insurance provisions
thereunder and substituting for the same a re-
quirement that a taxi cab operator obtain a per-
mit from the Director of Licensing pursuant to
RCW 46.72.020
WHEREAS, the State of Washington requires all taxi cab operators
to obtain a permit from the Director of Licensing and a requirement of
obtaining such permit is a surety bond or liability coverage through
insurance, the requirement of Section 5.44.040 Pasco Municipal Code
that the operator procure and maintain Insurance in stated amounts is
duplicitous and unnecessary,
The City Council of the City of Pasco, Washington, do ordain as
follows:
Section 1. Section 5.44.040 of the Pasco Municipal Code which
now states as follows:
5.44.040 OPERATOR'S LICENSE - INSURANCE. The
city council in the granting of any operator's
license, shall require the operator to procure
and maintain in force insurance covering prop-
erty damage and personal injury to passengers
as well as to other persons, from a company
licensed to write such Insurance in the state
of Washinaton, in an amount not less than ten
thousand dollars for damage to property of any
person other than the assured, and twenty-five
thousand dollars bodily injury, for each person
carried.
Each policy of insurance required herein shall
be filed with the city clerk and kept in full
force and effect, and failure to do so shall be
cause for the revocation of the license. It is
further required that an affidavit from such
insurance company, or authorized agent of such
company be filed with the city clerk, together
with such policy, which affidavit shall describe
the insurance carried by operator and further
causing such insurance company to notify the
city clerk in the event any policy required
herein be cancelled. (Ord. 1384 § 4, 1969).

Is hereby amended to read as follows:
5.44.040 OPERATOR'S PERMIT. The city council
in the granting of any operator's license, shall
require the operator to procure a permit from the
director of licensing as required by the Revised
Code of Washington. The operator is further re-
quired to maintain in force at all times said
permit and to procure and maintain in force either
the surety bond or liability coverage specified
in Chapter 46.72 of the Revised Code of Washington.
Failure of the operator to procure or to maintain
in force said permit, bond or insurance coverage
shall be cause for the city council not to grant
an operator's license or to revoke said license.
Each policy of Insurance or surety bond required
herein shall be filed with the city clerk. It is
further required that an affidavit from such
insurance company or surety, or authorized agent
thereof, be filed with the city clerk, together
with such policy or surety bond, which affidavit
shall describe the insurance carried by operator
and further causing such insuror or surety to
notify the city clerk in the event any policy or
bond required hereby be cancelled.
Section 2. This ordinance shall take effect five days after
passage and publication according to law.
