HomeMy WebLinkAbout2308 Ordinance - Recorded414'787 ORDINANCE NO 2308 AN ORDINANCE vacating certain utility easements retained when rights-of-way were vacated and abandoning certain sewer lines in Block 101, Northern Pacific Plat of the Town of Pasco WHEREAS, the City Council of the City of Pasco has previoulsy vacated the rights-of-way for Hagerman Street adjacent to, and the alleyways within, Block 101, Northern Pacific Plat of the Town of Pasco, and has retained utility easements within those vacated rights-of-way, and, WHEREAS, current development of Block 101 has negated the need for certain of those easements, and, WHEREAS, certain portions of public sewer within the block serve only the new development and will not be extended to serve other parcels, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCO THAT Section 1. The utility easement in the east-west alley of Block 101, Northern Pacific Plat of the town of Pasco, is hereby vacated from the projection of the easterly property lines of Lots 8 and 15 to the projection of the westerly property lines of Lots 7 and 16 Section 2 The 20-foot wide utility easement lying within the vacated Hagerman Street right-of-way between Blocks 100 and 101, Northern Pacific Plat of the Town of Pasco is hereby vacated from a line 10-feet west of the projected east property line of Lot 8 to the west edge of the projected north-south alleyway in Block 100, thence northerly to a line 10-feet south of and parallel to the original southerly property lines of Lots 6 and 7 Section 3 The public sewers situated within the east-west and north-south alleyways of Block 101, Northern Pacific Plat of the Town of Pasco, are hereby abandoned west of the projected easterly property lines of Lots 8 and 15 subject to the following A. The developer (owner of Lots 1 through 8 and 15 and 16) shall install a manhole at the new end of the public sewer at his expense The upstream edge of said manhole shall be located at the end of the remaining easement. The ownership of said sewer being abandoned shall pass to the property owner and shall run with the property C The property owner shall assume full liability and responsibility for any and all damages caused by failure of the abandoned sewer pipe, migration and/or explosion of gases within the pipe, and existing and future defects of the pipe r-- ce-.1 7:3 Cz) 414789 LZ",- City Clerk - V110 T9 ORM i4.
