HomeMy WebLinkAbout2295 OrdinanceORDINANCE NO. 2295 AN ORDINANCE relating to zoning and planned density developments by amending Chapter 22.70 of the Pasco Municipal Code. WHEREAS, the City Planning Commission conducted a Public hearing on August 20, 1981, due notice of which was properly given, for the purpose of considering whether or not Chapter 22.70 of the Pasco Municipal Code should be amended to provide for reduced setback requirements within a site designated for planned density development; and WHEREAS, at the conclusion of said public hearing and subsequent deliberations, the Planning Commission found the proposed amendment to be in the best interest of the Pasco community and recommended the City Council amend Chapter 22.70 of the Pasco Municipal Code to provide for reduced setback requirements and require that the development plans of such designated sites within the community be reviewed by the Planning Commission; and WHEREAS, the City Council has considered and concurs with the recommendations of the City Planning Commission; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS: Section 1. That Pasco Municipal Code section 22.70.060 be and the same is hereby amended to read as follows: PMC 22.70.060 SETBACK REQUIREMENT. Minimum setbacks for structures erected within an approved planned density development 'site shall be as follows: (a) Perimeter: The perimeter setbacks prescribed herein shall be measured from the exterior boundary of the lot or group of contiguous lots forming the planned density develop- ment site. The front, side and rear yard setbacks of the underlying zone shall_be the minimum perimeter set- backsfor all structures, provided that such minimum setbacks may be increased by the Planning Commission if deemed necessary to protect the appropriate use and development of adjacent lands. (b) Interior: The minimum distance be- tween structures within a_planned density development site shall not be less than Uniform Building Code requirements. ATTES : Wells, City Clerk APPRO C. That a new Pasco Municipal Code Section 22.70.090 be and the same hereby is enacted to read as follows: PMC 22.70.090 DEVELOPMENT REVIEW. Prior to issuance of a building permit, the site and building elevation drawings shall be reviewed by the Planning Commission. The Planning Comm- ission may require modification of said drawings consistent with the purpose of this chapter. If aggrieved by the decision of the Planning Comm- ission, the owner may appeal the Planning Comm- ission's decision to the City Council if filed in writing with the City Clerk within ten days of the date of the Planning Commission's decision. Appeals shall be prosecuted in the manner pre- scribed in Section 22.16!130 and the City Council shall have the same authority of the Board of Adjustment as provided in Section 22.16.140. Section 3. This Ordinance shall be effective upon its passage and publication as required by law. 8 PASSED by the City Council this day of Septemper , 1981.
