AN ORDINANCE relating to zoning by enacting a moratorium regarding petitions
for reclassification to R-3 (High Density Residential) and providing
an expiration date thereof
- WHEREAS, the City Council in March 1980, upon recommendationof che City
Planning Commission, adopted a new Comprehensive Plan containing goals and policies
more accurately reflecting contemporary values of the community with respect to
land development and, further, expressly directing that the municipal zoning
regulations contained in Title 22 of the Pasco Municipal Code (PMC) be amended to
reflect the goals and policies of the new Comprehensive Plan, and
W'HEREAS, the City Planning Commission, at the direction of the City Council,
has performed certain research relating to the residential zoning categories set
forth under Title 22 (PMC) in preparation of undertaking the revision of said
categories and regulations thereunder and has determined that the R-3 (High Density
Residential) zoning category presents the greatest conflict with the goals and
policies of the new comprehensive and contemporary values of the community, as
evidenced by the record of public hearings conducted over the past two years in
relation to petitions for reclassification to R-3 (High Density Residential), and
WHEREAS, the City Planning Commission is prepared to undertake the revision of
the residential categories and has recommended the City Council enact a temporary
moratorium prohibiting the consideration of petitions for zoning reclassification to
R-3 (High Density Residential) until said revisions have been completed, and
WHEREAS, the City Council conducted a public hearing on July 20, 1981, due
notice of which was properly given, to consider the necessity for such a temporary
moratorium and the reasonableness of the time period recommended for such
moratorium, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS
Section 1 That the City Council, upon due consideration of the Planning
Commission recommendation and evidence and testimony received during the public
hearing, finds as follows
1) The R-3 (High Density Residential) zoning category presents substantial
conflicts with the contemporary values of the community relating to
residential development, as those values are enumerated in the recently
adopted Comprehensive Plan,
2) There presently exists sufficient vacant land already classified R-3
(High Density Residential) to provide in excess of 300 new dwelling units,
said number exceeding the estimated demand for high-density residential
dwelling units anticipated for the ensuing 12-month period in consideration
of the reduced employment within the region,
3) The reclassification of additional land within the City of Pasco to
R-3 for development of high-density residential dwelling units during
the period of time in which the Planning Commission and City Council will
undertake the revision of the residential zoning categories would
result in further substantial conflicts with community values and would
unnecessarily subvert the goals and policies of the new Comprehensive
Plan and the revision of the residential zoning categories presently
being undertaken by the City Planning Commission,

4) The amount of time estimated to be reasonably necessary for the City '--
Planning Commission and City Council to identify the necessary revisions
of the residential categories and enact appropriate amendments to Title
22 (Zoning) of the Pasco Municipal Code is six (6) months
Section 2 That there shall be and hereby is enacted a moratorium prohibiting
the filing of petitions, as provided for in Chapter 22 88 of the Pasco Municipal
Code, which seek to change the zoning classification of any real property in the
City of Pasco from its present classification to the R-3 (High Density Residential)
zoning classification
Section 3 This ordinance and the moratorium enacted herein shall remain
in effect until January 18, 1982
Section 4 This ordinance shall take effect after its passage and
publication as required by law
