- ORDINANCE NO 22-75
AN ORDINANCE vacating a certain portion of Park Street
in the City of Pasco.
WHEREAS, all steps and procedures required by law to
vacate the certain portion of Street hereinafter described
have been duly taken andperformed; NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS:
Section 1. That that portion of Park Street lying between
the east line of 5th Avenue and the west line of 4th Avenue,
subject to retention of a full width easement for the constru-
ction, repair and maintenance of public utilities, be and same
is hereby vacated and the property so vacated shall vest in
the rightful owners thereof and shall attach to the lots or
grounds bordering thereon all in a manner provided by law.
Section 2. That a certified copy of this Ordinance be
recorded by the City Clerk of the City of Pasco in and with
the office of the Auditor of Franklin County, Washington.
Section 3. This Ordinance shall be in full force and
effect upon its passage and publication as required by law.

COMMON EASEMENT AGREEMENT
THIS AGREEMENT entered into this -2 7 1 15L day of June,
1981, by and between the following parties to provide for a
common easement for all said parties, and the property of
said parties as herein designated:
1. Simeon and Enriqueta Mayuga, husband and wife, as
to Lots 16 through 20, inclusive, Block 5, Sylvester Park
Addition, according to the Plat thereof, recorded in Volume
"B" of Plats, page 52, records of Franklin County, Washington.
2. GRAAF, a partnership whose partners are Enriqueta
Mayuga, M D., Nemesio Racsa, M.D.; Juan Resol, M.D., Justiniano
Delos Santos, M.D., and Sergio Palanca, M.D., as to Lots 11
through 15, inclusive, Block 5, Sylvester Park Addition,
according to the Plat thereof, recorded in Volume "B" of
Plats, page 52, records of Franklin County, Washington.
3 Our Lady of Lourdes Hospital, Inc., a corporation,
formerly Sisters of Sc. Joseph Nursing Home, as to Lots 6
through 10, inclusive, Block 5, Sylvester Park Addition,
according to the Plat thereof, recorded in Volume "B" of
Plats, page 52, records of Franklin County, Washington.
4. Our Lady of Lourdes Hospital, Inc., a corporation,
as to all of Block 4, Sylvester Park Addition, according to
the Plat thereof, recorded in Volume "B" of Plats, page 52,
records of Franklin County, Washington.
A common easement for the use, benefit and enjoyment of
all of the parties hereto and the properties set forth shall
hereafter exist concerning that certain property to be
vacated by the City of Pasco, commonly known as West Park
Street, extending between 4th and 5th Streets, City of
Pasco, County of Franklin, State of Washington, legally

That property extending from 4th Street to
5th Street lying between Lots 6 through 20,
Block 5, inclusive, and all of Block 4,
Sylvester, Park Addition to the City of
Pasco according to the Plat thereof, recorded
in Volume "B" of Plats, page 52, records of
Franklin County, Washington.
Said common easement shall be and remain a compon
easement for the use and benefit of all common land owners
adjacent thereto, for the purpose of providing necessary
access for ingress and egress for said abutting land, which
common easement shall constitute a covenant running with the
land and binding upon all of the heirs, executors, administrators,
personal representatives, and assigns, to further be utilized
by those members of the general public desiring ingress and
egress to and from said adjoining property as may be necessary,
providing that Our Lady of Lourdes Hospital, Inc., a corporation,
and its assigns and successors shall have the right to
establish permanent vehicle parking on said property, provided
that same does not interfer with the common covenant and
easement for ingress and egress as established herein for
the properties and parties above designated and set forth.
