HomeMy WebLinkAbout2267 Ordinance410301 ORDINANCE NO 2267 AN ORDINANCE amending Ordinance No 2234 by correcting the legal description of certain vacated portions of South Eighth Avenue, South Ninth Avenue and Ainsworth Street within the City of Pasco WHEREAS, all steps and procedures required by law to vacate the streets hereinafter described were duly taken and performed by the City Council of the City of Pasco prior to adoption of Ordinance No 2234, and WHEREAS, Ordinance No 2234 contained an error in the legal description of each portion of street intended to be vacated under Ordinance No 2234, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS Section 1 That Section 1 of Ordinance No 2234 be and the same is hereby amended to read as follows That the West 10 feet of the west 40 feet of South Eighth Avenue lying South of the centerline of "C" Street and Northerly of the centerline of Ainsworth Street, EXCEPT the South 50 feet as measured at right angles to the centerline of Ainsworth Street AND EXCEPT the North 40 feet as measured at right angles to the centerline of "C" Street, be and the same is hereby vacated and the property so vacated shall vest in the rightful owners thereof and shall attach to the lots or grounds bodering thereon, all in a manner provided by law Section 2 That Section 2 of Ordinance No 2234 be and the same is hereby amended to read as follows That the Northerly 10 feet of the Northerly 50 feet of Ainsworth Street lying between the centerline of South Eighth Avenue and the centerline of South Ninth Avenue, EXCEPT the East 30 feet as measured at right angles to the centerline of South Eighth Avenue AND EXCEPT the West 20 feet as measured at right angles to the centerline of South Ninth Avenue, be and the same is hereby vacated and the property so vacated shall vest in the rightful owners thereof and shall attach to the lots or groulds bodering thereon, all in a manner provided by law Section 3 That Section 3 of Ordinance No 2234 be and the same is hereby amended to read as follows That the East 20 feet of the East 40 feet of South Ninth Avenue lying South of the centerline of "C" Street and Northerly of the Centerline of Ainsworth Street, EXCEPT the South 50 feet as measured at right angles to the centerline of Ainsworth Street AND EXCEPT the North 40 feet as measured at right angles to the centerline of "C" Street, be and the same is hereby vacated and the property so vacated shall vest in the rightful owners thereof and shall attach to the lots or grounds bodering thereon, all in a manner provided by law 410301 Eve s,.ty Clerk ' APPRDVED,AS TO FORM 1 - • A A(A)A4A-- t is J De Fel,i'ce, 410301 Section 4 That a certified copy of this ordinance be recorded by the City Clerk of the City of Pasco in and with the Office of the Auditor of Franklin County, Washington Section 5 This ordinance shall be in full force and effect upon its passage and publication as required by law P SED by the City Council of the City of Pasco his day of , 1981 X A nèr, Mayor ATTEST 148 RCCORDED IN VOL OF OFFICIAL RECORDS PACE PCOUEST OF City of Pasco MAY G 12 50 MT Ont41,1 'AUDI OR riALth enU TY, WASH TY MA 10 City of Pasco P.O.
