AN ORDINANCE relating to solid waste disposal by amending Pasco
Municipal Code Section 6.04.300 (Ordinance No. 2015
§1, 1978).
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS:
Section 1. That Section 6.04.300 of the Pasco Municipal Code
(Ordinance No. 2015 §1, 1978) be and the same is hereby amended to
read as follows:
P.M.C. 6.04.300 SCHEDULE OF SERVICE CHARGES.
(a) The person responsible for water or sewer service to a place
receiving solid waste disposal service is responsible for all charges
and costs resulting from such services. The tenant in possession is
also responsible for all charges and costs resulting from such services
if the bill is sent to that person. In the event no water and sewer
service is provided a location receiving solid waste disposal service,
the tenant in possession, if billed, and the person making application
for the service are responsible for all charges and costs resulting
from such services. In all events, the property and the property
owner are responsible for all charges and costs and the same may become
a lien upon the property in the manner provided by law.
(b) The charges for solid waste disposal services are as set
forth below and include the charges to delinquent accounts as provided
in Section 6.04.310.
(1) CAN RATES:
(A) For each occupied residence or separate unit thereof,
the charge shall be Four & 60/100 ($4.60) Dollars per month for weekly
full service garbage collection.
Full service garbage collection shall include:
(1) The collection of an unlimited number of cans or
containers (including plastic bags) which weigh not more than eighty
pounds, and otherwise meet the requirements of Section 6.04.100;
(11) The collection of an unlimited number of bundles
meeting the requirements of Section 6.04.140;
(iii) Additional Service. Items too large for regular
collection as described in subparagraphs (1) and (11) of this paragraph
shall be limited to two hundred fifty (250) pounds per item from the
premises.

(B) A residence customer as qualified below may apply for
and receive a different rate and service. The rate shall be One and
75/100 ($1.75) Dollars per month for the weekly removal of one can or
container per week. To qualify, the customer must show satisfactory
proof under oath in writing and otherwise provide satisfactory proof
of the following:

(i) That he or she is sixty-five years of age or
older;
(11) That he or she is a single occupant of or the
head of a household all of whose members have a combined annual income
from all sources that is not greater than the United States federal
poverty level. Such poverty level shall be determined by the "Very
Low Income Limits" and updated annually by the finance director.
(111) The person must be the applicant for the garbage
service and must be directly responsible for the payment of the garbage
bill;
(iv) The person must have resided at such residence for
a period of not less than ninety consecutive days prior to the effect
date of the rates set forth above and must intend to remain at such
place;
(v) That one can per week is at least adequate to
meet the normal needs of the residence or separate unit thereof.
The person must state under oath that he or she will
inform the city or the city's garbage contractor in writing if there
is any change in their or the household's status as it relates to the
requirements set forth above. The city finance director or the city's
garbage contractor may require the person demonstrating satisfactory
proof for a residence that qualifies for the rates set forth in this
section to make an updated application at any time.
"Head of the household" means the person owning or having
control of the dwelling unit. In the case of a husband and wife, either
person shall be considered the "head of the household."
(C) For each occupied unit or units of a multi-family
residence the charge shall be Three & 20/100 ($3.20) Dollars per month
for the weekly collection of two cans per unit.
(D) For each commercial establishment the charge shall be
Four & 25/100 ($4.25) Dollars per month for the weekly collection of
two (2) cans.
(E) For each public food establishment the charge shall
be Fourteen & 25/100 ($14.25) Dollars per month for the daily collection
of one (1) can.
(F) The charge of 65/100 ($.65) Dollar per can per week
shall be added for the collection of a can of solid waste over and
above the level of service required or permitted by ordinance codified
in this section.
(2) CONTAINER RATES:
In the event a multi-family residence, a commercial
establishment, or a public food establishment elects to utilize a
container, rather than a can, for disposal of solid waste, the charge
for collection of solid waste from containers shall be:

(A) Four & 35/100 ($4.35) Dollars per collection for a
one (1) cubic yard container.
(B) Five & 40/100 ($5.40) Dollars per collection for a
one and one-half (1 1/2) cubic yard container.
(C) Six & 70/100 ($6.70) Dollars per collection for a
two (2) cubic yard container.
(D) Seven & 20/100 ($7.20) Dollars per collection for a
three (3) cubic yard container.
(E) Nine & 20/100 ($9.20) Dollars per collection for a
four (4) cubic yard container.
(F) Eleven & 80/100 ($11.80) Dollars per collection for a
six (6) cubic yard container.
(G) Fourteen & 55/100 ($14.55) Dollars per collection for
a eight (8) cubic yard container.
(3) ROLL-OFF CONTAINER RATES:
For collection of solid waste contained in a roll-off
container the charge shall be as set forth below:

Thirty-Nine & 60/100 ($39.60) Dollars
Forty-Six & 20/100 ($46.20) Dollars
Fifty-Two & 80/100 ($52.80) Dollars
Forty-Five (45) cubic Fifty-Nine & 40/100 ($59.40) Dollars
yards _ There shall be a minimum of two (2) collections per month or in the
alternative, an additional charge per dump of $2 20 per cubic yard
(4) MISCELLANEOUS RATES:
Miscellaneous rates for service not included in the base
rates of subdivisions (1), (2), and (3), of this subsection shall be:
(A) Eighteen and 75/100 ($18.75) Dollars per hour for a
truck and one (1) man crew for each special collection.
(B) Twenty-Five & 00/100 ($25.00) Dollars per hour for
a truck and two (2) man crew for each special collection.
(C) Two & 50/100 ($2.50) Dollars per compacted cubic
yard, plus disposal fees.

(D) Five & 00/100 ($5.00) Dollars per compacted cubic
yard if compactor belongs to contractor, plus disposal fees.
(E) For containers for special cleanups, rent of
container at Two & 75/100 ($2.75) per day if kept over two days, plus
a Ten & 00/100 ($10.00) Dollar delivery charge. In addition to
these charges, there shall be a service charge. The service charge
for roll-off containers shall be as set forth in (C) above. For the
following described containers, the service charge shall be as set
forth below:
CONTAINER SERVICE CHARGE
Four (4) cubic yards Eleven & 20/100 ($11.20) Dollars
Six (6) cubic yards Thirteen & 80/100 ($13.80) Dollars
Eight (8) cubic yards Sixteen & 55/100 ($16.55) Dollars
(F) Four and 50/100 ($4.50) Dollars per trip for a
return trip when customer failed to place cans at collection point
for regular collection.
(G) 25/100 ($.25) Dollar per can for collection of solid
waste over twenty-five (25) feet, but less than fifty (50) feet from
the collection point; 35/100 ($.35) Dollar per can for collection of
solid waste over fifty (50) feet, but less than seventy-five (75) feet
from the collection point; and 50/100 ($.50) Dollar per can for
collection of solid waste over seventy-five (75) feet from the
collection point.
(H) For special pickups on the regular collection route
after notification by the customer to the contractor, a fee of no
more than Four & 00/100 ($4.00) Dollars for each item collected
shall be charged; for special pickups not on a regular collection
route a return trip fee for Four and 50/100 ($4.50) Dollars may be
charged in addition to the charges provided in this section.
(I) On all services other than those outlined in paragraph
subdivision 1 of subsection A (can rates), a billing charge of 25/100
($.25) Dollar may be added to each bill.
(5) MINIMUM CHARGES:
In the event the contractor determines that certain
minimum container service levels are required, the minimum level shall
be two (2) pickups per week for one (1), one and one-half (1 1/2), and
two (2) cubic yard containers and Thirty-Six & 00/100 ($36.00) Dollars
minimum charge for a three (3) cubic yard container.
(6) SERVICE TO CITY:
The contractor shall make collection at all city parks, fire
stations, the city hall, the library, municipal garage, water shops and
other city-owned or leased public buildings at least once each week
and it shall be reimbursed for such service at the standard rates set
forth in this section.

Section 3. This ordinance shall be in full force and effect on
July 1, 1980.
