De i e, ity Attorney ORDINANCE NO. 2159 AN ORDINANCE relating to the further extension of the Franklin County Irrigation District into the City and the conditions thereto. WHEREAS, it is in the public's best interest to allow and provide for the further extension of Franklin County Irrigation District lines into the city; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS: Section 1. The city hereby grants a non-exclusive franchise to the Franklin County Irrigation District to Install, operate, and maintain irrigation water lines and appurtenances thereto under, over, and along the following described public right-of-way: The east/west alley between Block 1 and Block 2 of Ventura Heights Addition to the City of Pasco. The facilities permitted herein shall not interfere with the use of the public right-of-way as determined by the city. Prior to the installation of the facilities permitted herein, the Franklin County Irrigation District shall submit plans and profiles for review by the city and shall obtain all other permits as required by city ordinance. The facilities described herein and their installation, operation and maintenance shall comply with all other requirements of city ordinance and other laws. The Franklin County Irrigation District shall not assign this franchise, and it is not transferable to any successor of the District or any other party. The Franklin County Irrigation District shall be responsible for protecting person and property from any injury or damage from the facilities, including during their installation, their operation, and their maintenance. This franchise shall terminate on January 1, 2010. Section 2. This franchise shall be effective following its passage and publication as required by law.
