HomeMy WebLinkAbout2158 Ordinance.4( PROPOSED ORDINANCE ORDINANCE NO 2158 AN ORDINANCE RELATING TO FIRE PREVENTION AND AMMENDING TITLE 18 OF THE PASCO MUNICIPAL CODE BY REPEALING AND RE-ENACTING CHAPTER 18 04 THEREOF THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS Section 1 That Title 18 of the Pasco Municipal Code be and the same is hereby amended by repealing Chapter 18.04 thereof in its entirety and re- enacting the same to read as follows 18 04 010 Adoption There is hereby adopted by the City Council of the City of Pasco pursuant to the provisions of RCW 35 21 180 & 35A 12 140 for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion that certain Code known as the Uniform Fire Code, recommended by the Western Fire Chief's Association and the International Conference of Building Officials, being particularly the 1979 Edition thereof together with appendixes A. through I and except for portions as are herein- after deleted, modified or amended of which Code not less than three copies have been and now are filed in the Office of the City Clerk of the City of Pasco, and same are hereby adopted and incorporated as fully as if set out in length herein, and from the date on which this Ordinance shall take effect the provisions thereof shall be controlling within the corporate limits of the City of Pasco It is the specific intent of the Fire Code of the City of Pasco as herein adopted, modified and amended to place the obligation of complying with its requirements upon the owners and occupiers of the buildings and premises within the scope, and no provision of nor any term used in this Fire Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation and enforcement of this Fire Code shall be discretionaryaand not mandatory. Nothing contained in this Fire Code is intended to be nor shall be construed to create or form the basis for any injury or damage resulting from the failure of a building or any premises to comply whith the provisions of this Fire Code, or by reason or in consequence of any inspection, notice, order, certificate, permission or approval authorized or issued or done in commection with the implementation or enforcement of this Fire Code, or by reason of any action or inaction on the part of the City related in any manner to the enforcement of this Fire Code by its officers, employees or agents. It is expressly the purpose of this P-re Code to provide for and promote the health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the provisions of this Fire Code. 1 2. 18 04 015 - Substitution for Section 2 302 of the Uniform Fire Code. Section 2 302 of the Uniform Fire Code shall be omitted and the follow- ing shall be substituted in Its place, Section 2 302 Appeals Whenever the Fire Chief of the Pasco Fire Department disapproves andapplication or refuses to grant a permit applied for, or when it is claimed that the provisions of this Code do not apply, or that the true intent of the Code has been misconstrued or wrong- fully interpreted, the applicant may, within 30 days of the decision, appeal that decision to the Board of appeals established under the Building Code. 18.04 020 - Ammendment for Article 9 of the Uniform Fire Code Article 9 Definitions Definitions of the following words and terms in Article 9 of the Uniform Fire Code are added or amended in Sections 9.108 and 9 112, to read as follows 9 108 FIREWORKS means blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, fire balloons (balloons of a type which have burning material of any kind attached thereto or which require fire underneath to ompel theff14 firecrackers, torpedoes, skyrockets, rockets, Roman candles, daygo bombs, or any other fireworks of of like construction and any fireworks containing any other combustible or explosive substance for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation but does not include toy canes, toy guns, or other similar devices in which paper caps containing not more than twenty-five hundredths grain of explosive compound per cap are used. 3 (A) DANGEROUS FIREWORKS. Dangerous fireworks include any of the following (1) Pyrotechnics of fireworks containing phosphorous, sulpha- cyanide, mercury, magnesium, potassium picrate, gallic acid, chlorate of potash and sulfur or chlorate of potash and sugar, (2) Firecrackers, salutes, and other explosive articles of similar nature, (3) Blank Cartridges, (4) Skyrockets, rockets, includingoall similar devices employing any combustible or explosive material which rise in the air during discharge, (5) Roman candles, including all devices which discharge balls of fire into the air, (6) Chasers, including all devices which dart or travel about the surface of the ground during discharge, (7) Snakes, boa constrictors and snake nests, containing biochloride or mercury, (8) All articles for pyrotechnic display, which contain gunpowder, (9) Articles commonly known as son-of-a-gun, devil-on-the- rock, crackit sticks and automatic torpedoes which contain arsenic, (10) Explosives known as devil-on-the-walk, or any other article of similar character which explodes through means of friction, and all other similar fireworks, unless otherwise designated, (11) Toy torpedoes of all kinds, (12) All pyrotechnic devices having a side fuse, (13) Fire balloons or balloons of any type which have burn- ing material of any kind attached thereto, and (14) Such other fireworks as may be designated as dangerous by the State Fire Marshal. (B) "SAFE AND SANE FIREWORKS" includes fireworks not designated as "Dangerous Fireworks" except that in all cases only end fuses may be used and the total pyrotechnic content of any one piece shall not exceed 100 grams 9 112 JURISDICTION means the City of Pasco JURISDICTIONAL AREA means that territory included within the Pasco City Limits. 4 18 04 030 Substitution for Section 10 207 of the Uniform Fire Code. Section 10.207 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place. (a) Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways with all-weather driving surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearance All access roadways which are in excess of 200 feet in length and do not enter into a public street ot roadway shall include a turn around area which shall be of sufficient size as to allow fire apparatus to turn completely around. A turn around may include but not be limited to cul-de-sacs, hammer- heads, open areas, etc. a properly located fire hydrants may elimi- nate the need for a turnaround when impractical to provide ar turnaround. EXCEPTION When there are not more than two Group-R Division 3 or M occupancies as defined in the Building Code, the requiftments of tills t'ection -may be modified when fire fighting or e -S--oue operations would not be impaired (b) The required width of access roadways shall not be obstructed in any manner, including parking of vehicles, and no person, except a public officer acting within the scope of his public duties, shall obstruct, block or park a vehicle in the access roadway. "No Parking" signs and other appropriate notice prohibiting obstruction shall be required, installed and maintained in an approved manner The installation and maintenance of such signs shall be the responsibility of the owner of the property. (c) The access roadway shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. Any building which exceeds 36 feet in height shall have access road- ways which immediately adjoin the two longest sides of the build- ing, provided, that such access roadways may be separated from the building by a yard if the farthest boundary of the access road- way is no more than 45 feet from the building and such yard provides easy access to the building. Where access roadways cannot be provided, approved fire protection system or systems shall be provided. (d) Where approved fire protection systems are provided, the above required clearances may be modified (e) The Chief shall have the authority to require an increase in the minimum access width where such width is not adequate for fire or rescue operations. 5. 18 04 040 - Amendment for Section 10.301 of UFC Section 10.301 Section 10.301 of the Uniform Fire Code is amended to read as follows Section 10.301 (d) When fire protection facilities are to be installed by the developer, such facilities including all surface access roads shall be installed and made serviceable prior to and during the time of construction When alternate methods of protection, as approved by the Chief, are provided, the above may be modified or waived Fire hydrants connected to an approved water supply system capable of deliver- ing the required fire flow shall be provided on the public street or on the site of the premises to be protected as required by the Chief, prior to any installation or accumulation of combustible materials 18.04.050 - Substitution for Section 11101 of the UFC Section 11.101 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 11.101 (a) PERMIT REQUIRED No person shall kindle or maintain any bon- fire, or rubbish fire or warming fire or field fire or authorize any such fire to be kindled or maintained without a permit EXCEPTION No permit shall be required for campfires or residential barbecues, and such fires shall be allowed provided they do not constitute a fire hazard. During the construction or demolition of buildings or structures, no waste materials or rubbish shall be disposed of by burning on the premises or in the immediate vicinity without having obtained a permit A permit shall be required for each construction site. Burning permits shall be obtained in person between the hours of 8 00 a m. and 5 00p.m Monday through Friday except on holidays. Burning permits will be issued upon approval of an on-sight inspection of the burning site by a Fire Department representative All permits will be in writing and will be valid for a period of one year from the date of issue, at which time they may be renewed The Pasco Fire Department may utilize controlled burning for the purpose of training Firefighters without a permit. Burning permits will be free of charge. Section 11.101 (b) Location Restricted. No person shall kindle or maintain any bonfire or rubbish fire or warming fire or authorize such fire to be kindled or maintained on any private land unless (1) the location is not less than 25 feet from any structure and adequate provision is made to prevent fire from spreading to within 25 feet of any structure, or (2) the fire is contained in an approved waste burner located safely not less than 15 feet from any structure. Bonfires, rubbish fires and warming fires shall not be located less than 25 feet from power poles and not under overhead transmission lines. Section 11.101 (c) Attendance of Open Fires. Bonfires and rubbish fires and open field fires shall be constantly attended by a competent person until such fire is extinguished. This person shall have a garden hose connected to a water supply, or other fire extinguishment equipment readily available for use. Warming fires and campfires shall be under the constant observation of a competent person, and shall be extinguished one hour prior to the evacuation of the site 6 Section 11 101 (d) Field Fires Open field burning may be allowed when in the opinion of the Chief such burning does not constitute a hazard. Such burning shall be limited to 2 acres in area, and shall be surrounded by an effective fire barrier as follows (1) Ten feet from roadways, power poles, and from other like areas. (2) Twenty-five feet from structures Such areas or widths may be modified if in the opinion of the Chief they donnot constitute a distinct hazard to life or property. Section 11 101 (e) Chief May Prohibit The Chief may prohibit outdoor fire when atmospheric conditions or local circumstances make such fires hazardous No person shall kindle any outdoor fire or authorize_such fire to be kindled or maintained even if a permit has been issue -d when any of the following conditions are in force (1) If the wind velocity is above 10 miles per hour, or (2) If a temperature inversion is present or air circulation is insufficient to disperse smoke, gases, and fumes, to the extent necessary to protect public health It shall be the responsibility of the permittee to check the local conditions prior to burning by calling the phone number listed on the permit Section 11.101 (f) - All controlled burning shall comply with the regulations of the Benton/Franklin/Walla Walla counties Air Pollution Control Authority 18 04 060 - SUBSTITUTION FOR SECTION 11 102 OF THE UFC. Section 11 102 of the Uniform Fire Code is hereby omitted and the following shall be substituted in its place. Section 11 102 - Kindling of fire on land of others restricted No person shall kindle a fire upon the land of another without written permission of the owner thereof or his agent, such written permission to be filed with the Pasco Fire Department at the time of the issuance of a permit 18 04 070 - SUBSTITUTIION FOR SECTION 11 112 OF THE UFC Section 11 112 of the Uniform Fire Code is omitted and the following shall be s substituted an its place Section 11 112 - (a) No waste matter shall be disposed of by burning except as follows All burning shall take place during the hours of 6 00 a m and one hour before sunset or 6 00 p.m., whichever comes first EXCEPTION Campfires and bonfires approved by the Chief Section 11 112 - (b) Burning confined to incinerators EXCEPTIONS All burning shall be done in an approved incinerator except that outdoor burning of approved combustible waste matter may be done in the open if (1) A permit to engage in such burning is obtained from the Chief. 7 Section 11.112 - (b) Burning confined to incinerators. (continued) (2) Burning is done at a distance of more than 25 feet from any building and/or structure (3) A garden hose and water supply or other fire exting- uishing equipment is on hand (4) Applicants for such permit must be in legal control of the lot or parcel of land on which the burning-is to be done (5) None of the following materials shall be burned lawn grass clippings,leaves, garbage, dead animals, asphalt, paper, petroleum products, paints, rubber products, plastics, any substance which normally emits dense smoke or obnoxious odor. (6) All controlled burning fire shall be of a size so as not to constitute a fire hazard to surrounding property The size of the fire will be determined at and during the inspection for the permit and shall be listed on the permit Fires on the premises of a residence shall not exceed a size of four feet in diameter or more than four feet in height. 18.04.080 - AMENDMENT FOR SECTION 11.203 OF THE UFC Section 117203 of the Uniform Fire Code is amended by the addition of a new subsection. Subsection (d) to read as follows Section 11 203 (d) - Regulation of storage in unprotected spaces It shall be unlawful to place, store, or keep, or permit to be placed, stored, or kept in any unprotected attic or other space directly under a building except a residence, any furniture baggage or other combustible or flammable material The term "unprotected" as used in this section shall apply to any space or area directly under a roof of any building or under the lowest story of any building, which if used for storage of combustible material, would be required by the Building Code to have all walls and ceilings lathed and plastered or otherwise protected as required for any intermediate area or space within the building. 18 04.090 - Substitution for Section 25 117 (b) 4 of the UFC Section 25 117 (b) 4 of the Uniform Fire Code is ommited and the following shall be substituted in its place Section 25.117 (b) 4. Notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand held candles No permit is required for battery-operated candles or other electric candles. 8 18.04 100 - Amendment for section 77 106 of the UFC Section 77 106 (b) of the Uniform Fire Code is amended to read as follows Section 77 106 (b) - Establishment of limits of districts in which storage _ of explosives and blasting caps is to be prohibited The limits referred to in Section 77 106 (b) of the Uniform-Fire Code in which storage of explosives and blasting agents is prohibiteddis establ- ished as follows All use districts except I-1 (Light Industrial) and 1-2 (Heavy Industrial). 18.04.110 - SUBSTITUTION FOR SECTION 78.102 OF THE UNIFORM FIRE CODE Section 78.102 of the Uniform FITT Code shall be omitted and the following shall be substituted in its place Section 78.102 - Manufacture, Sale and Discharge of Fireworks. (a) The manufacture of fireworks is prohibited within the City. (b) Except as herein provided, it shall be unlawful for any person to store, offer for sale, expose for sale, sell at retail, or use, fire„or discharge any fireworks. (1) The Fire Chief shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks by the municipality, fair association, amusement parks, and other organizations. Every such display shall be handled by a competent operator approved by the Police Chief of the Police Department and the Fire Chief of the Fire Department of the City of Pasco Every operator shall have first obtained a state license pursuant to RCW 70 77.305. The display shall be of such a character, and so located, discharged or fired as in the opinion of the Fire Chief of the Fire Department, after proper inspection, shall not be hazardous to property or endanger any person (2) The Fire Chief of the Fire Department may issue each year permits for the sale of safe and sane fireworks to persons, corporations, or organizations, after investigation and his determination that the location where the fireworks are to be sold is not hazardous to property or endangers any person, and that the persons in charge of selling the fireworks are competent and trained to handle such fireworks. No person under the age of eighteen shall be employed by the permittee in connection with such sale. If the Fire Chief of the Fire Department refuses to issue a permit, the applicant shall have the right of appeal. - - (c) Applications for permits for a public display of fireworks shall be made in writing at least ten days in advance of the display. (d) No permit granted hereunder shall be transferable (e) Safe and sane fireworks may be issued, fired, or discharged in the City, during the period commencing at 12 00 o'clock noon on the twenty-eighth of June and ending at 12 00 o'clock noon on the sixth day of July each year, except as provided in paragraphs (k) and (1 ) below. (f) Approved "NO SMOKING" signs shall be posted at conspicuous loca- 9 tions on all four sides of the fireworks stand or structure and such other places as may be designated by the inspecting authority. Each sign shall have the words "No Smoking By Order of the State Fire Marshal" in red letters not less than two inches in height on white background. All signs shall be maintained in a legible condition. (g) Smokang and the discharge of fireworks shall be prohibited within twenty-five feet of any building or stand in which fireworks are sold at retail or stored after hours (h) Each retail fireworks location shall have not less than two water- type extinguishers of not less than two and one-half gallon capacity (1) There shall be no accumulation of dry grass, paper, cardboard, trash, lumber or other combustibles within one hundred feet of any retail fireworks outlet (j) Temporary structures or stands used for the retail sale of safe and sane fireworks shall be removed from the premises within one week after July 6 of each year Any such stand or structure re- maining beyond one week may be removed by the regulating authority at the expense of the permittee or owner (k) Fireworks shall not be sold or given to minor children under the age of eight unless accompanied by the responsible parent or adult (1) It shall be unlawful to use, fire, or discharge any safe and sane fireworks along the route of and during any parade or at any place of public assembly or in any commercial use district. (m) It shall be unlawful at any time to throw or toss any safe and sane fireworks at any person, animal, vehicle, or other thing or object. (n) All other rules and regulations of the State Fire Marshal relating to fireworks, RCW Chapter 70 77 "State Fireworks Law" including but not limited to rules and regulations adopted pursuant to Chapter 70.77 (o) Nothing herein shall be deemed to prohibit the uses for industrial purposes of any explosive or flammable compound, blasting caps and simillar items. 18.04.120 - SUBSTITUTION FOR SECTION 78 103 OF THE UNIFORM FIRE CODE Section 78 103 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 78.103 - Insurance Required. The permittee shall file with the Fire Chief, a public liability and property damage insurance policy providing coverage with limits not less than one hundred fifty thousand dollars to the applicant for liability for the payment of damages which may be caused either to a 10. f person or to property by reason of the permitted display, and arising from any acts, or failure to act of the permittee, his agents, employers or subcontractors, unless he is excused from filing such policy by reason of the provision of RCW 20 77 355 18 04.130 - Substitution for Section 78.106 of the Uniform Fire Code. Sectnn 78 106 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 78.106 - Seizure of Fireworks. Any member of the Pasco Police or Fire Departments is hereby authorized and empowered to seize, take, remove or cause to be removed at the expence of the owner any and all stocks of Fireworks offered or exposed for sale, stored, or transported, or held in violation of this article. 18.04 140 - AMENDMENTS FOR SECTION 79.109 OF THE UNIFORM FIRE CODE Section 79.109 of the Uniform Fire Code is amended by the addition of a new subsection Subsection (c) to read as follows Section 79.109 (c) - Not withstanding any other provision of the Uniform Fire Code, flammable and combustible liquids used as motor fuels may not be stored and dispensed from fixed equipment into the fuel tanks of motor vehicles in any use district classified under title 22 of the Pasco Zoning Code, as R-1 (Low Density), R-ls (Suburban), R-2, R-3. and RMH 1,2,3, Use Districts. 18.04 150 - AMENDMENT FOR SECTION 79.201 OF THE UNIFORM FIRE CODE. Section 79 201 of the Uniform Fire Code is hereby amended to read as follows Section 79 201 - Establishment of Limits of Districts in Which Storage of Flammable Liquids in Aboveground Tanks is Prohibited (a) The limits referred to in Section 79.201 of the Uniform Fire Code, in which storage of flammable liquids in outside, aboveground tanks is prohibited, are established as follows All districts except I-1 (Light Industrial) and 1-2 (Heavy Industrial). 18 04 160 - AMENDMENTSFOR SECTION 79 601 OF THE UNIFORM FIRE CODE. Section 79.601 of the Uniform Fire Code is hereby amended to read as follows Section 79 601 Establishment of limits of Districts in which New Bulk Plants for Flammable or Combustible Liquids is prohibited. (b) The limits referred to in Section 79.601 of the Uniform Fire Code in which new bulk plants for flammable or combustible liquids are prohibited, are established as follows, all use districts except I-1 (Light Industrial) and 1-2 (Heavy Industrial) 11. 18 04.170 - SUBSTITUTION FOR SECTION 79 709 OF THE UNIFORM FIRE CODE. Section 79.709 of the Uniform Fire Code Subsection 79.709 (b) of the Uniform Fire Code shall be omitted and the following shall be substituted in its place Section 79 709 (b) - Extinguishers of a minimum classification of 20-B, C shall be provided and so located that no pump dispenser, or fill-pipe opening shall be a greater distance than 75 feet from such extinguisher 18 04 180 - AMENDMENT FOR SECTION 82 105 OF THE UNIFORM FIRE CODE. Section 82.105 - Establishment of limits in which bulk storage of liquified petroleum gases is to be restricted The limits referred to in Section 82 105 (a) of the Uniform Fire Code in which bulk storage of liquified petroleum gas is restricted are established as follows all use distrnts except I-1 (Light Industrial) and 1-2 (Heavy Industrial). 18.04 190 - VIOLATIONS - PENALTIES. employees or agents It is expressly the pur- pose of this Fire Code to provide for and promote the health, safety and wel- fare of the general public, and not to create or other wise establish or designate any particular class or group of persons who will or should be especially pro , tected or benefited by the 1 provisions of this Fire Code 18 04 015 — Substitution for Section 2 302 of the misconstrued or wrongfully interpreted, the applicant may, within 30 days of the decision, appeal that deci sion to the Board of Ap Peals established under the Building Code , 18 04 020 — Amendment for Article 9 of the Uniform Fire Code Article 9 Definitions Defi nt'ions of the following words and terms in Article 9 of the Uniform Fire Code are added or amended in Sections 9 108 and 9 112, to read as follows 9 108 Fireworks means blank cartridges, toy pistols, fey cannons, toy canes or toy guns in which explo sives are used, fire balloons (balloons of a type which have burning material of any kind attached thereto or which require fire under- neath to propel them) fire- cracker s, torpedoes, skyrockets, rockets, Roman candles, daygo bombs, or any other fireworks of like construf,tion and any fire works containing any other combustible or explosive substance' for the purpose of producing a visible or audible- effect—by corn bustion, explosion, deflagra non, or detonation but does not include toy canes, toy guns, or other similar de vices is which paper caps containing not more than twenty-five hundredths grain of explosive compound per COP are used (A) Dangerous Fireworks Dangerous fireworks include any of the following (1) Pyrotechnics of fire works containing phos- phorous, sulphocyanide, mercury, magnesium, potas slum picrate, (iodic acid, chlorate ..r,if potash and sul fur or chlorate of potash and sugar, (2) Fkrecrackers, salutes and other explosive articles of similar nature, (3) Blank Cartridges, ' (4) Skyrockets, rockets, Including all similar devices employing any combustible or explosive material which rise ,in the air during discharge, (5) Roman candies, in- cluding all devices which discharge balls of fire Into the air, (6) Chasers, including oil devices which dart or trav- el about the surface of the ground during discharge, (7) Snakes, boa con- strictors and snake nests, containing blochloride or mercury, (8) All articles for pyro technic display, which con fain gunpowder, (9) Articles commonly known as son of-a gun, de- vil on the rock, crockit sticks and automatic torpedoes which contain arsenic,, (10) Explosives known as devil on the-walk, or any other article of similar character which explodes through means of friction, and all other similar fire works, unless otherwise designated, (11) Toy torpedoes of all kinds, (12) All pyrotechnic de- vices having a side fuse, (13) Fire balloons or bal loons of any type which hove burning material of any kind attached thereto, I and 1 (14) Such other fireworks as may be designated as dangerous by the State Fire Marshal (B) ' Safe and Sane Fire- works ' includes fireworks not designated as "Dan- gerous Fireworks ' except that In all cases only end fuses may be used and the total pyrotechnic content of any one piece shall not ex ceed 100 grams 9 112 Jurisdiction means the City of Pasco Juris (fictional Area means that territory included within the Pasco City Limits 18 04 030 Substitution for Section 10 207 of the Uni form Fire Code Section 10 207 of the Uni- form Fire Code shall be omitted, and the following shall be substituted in its place (a) Every building here after constructed shall be accessible to Fire Depart- ment apparatus by way of access roadways with all- weather driving surface of not less than 20 feet of un obstructed width, with ade- quate roadway turning radius capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inch es of vertical clearance All access roadways which are in excess of 200 feet in length and do not enter into a public street or roadway shall include a turn around area which shall be of suf ficient size as to allow fire apparatus to turn corn pleteiy around A turn around may include but not be limited to cul de sacs, hammer heads, open areas, etc a properly located fire hydrants may eliminate the need for a turnaround when impractical to provide a turnaround Exception When there are not more than two Group R Division 3 or M occupancies as defined in the Building Code, the re- quirements of this section may be modified when fire ftghting or rescue oper- ations would not be Impaired (b) The required width of access roadways shall not be obstructed in any man ner, including parking of vehicles, and no person, ex- cept a public officer acting within the scope of his pub- lic duties, shall obstruct, block or park a vehicle in the access roadway "No Parking ' signs and other appropriate notice prohibit ing obstruction shall be re quired, installed and maintained in an approved manner This installation sued upon approval of an on sight inspection of the burning site by a Fire De- partment representative All permits will be In writing and will be permit Burning permits will be free of charge Section 11 101 (b) Loca- tion Restricted No person shall kindle or maintain any bonfire or rubbish fire or warming fire or authorize such fire to be kindled or maintained on any private land unless (1) the location is made to prevent fire from spreading to within 25 feet of any structure, or (2) the fire Is contained in an approved waste burner located safely not less than 15 feet from any structure Bonfires, rubbish fires and warming fires shall not be located less than 25 feet from power poles and not under overhead transmis sion lines Section 11 101 (c) Attend- ance of Open Fires Bon fires and rubbish fires and open field fires shall be constantly attended by a competent person until such fire is extinguished This person shall have a garden hose connected to a water supply, or other fire exti- nguishment equipment read ily available for use Warming fires and camp fires shall be under the constant observation of a competent person, and shall be extinguished one hour prior to the evacuation of the site Section 11 101 (d) Field Fires Open field burning may be allowed when in the opinion of the Chief such burning does not con stitute a hazard Such burn mg shall be limited to 2 acres in area, and shall be surrounded by an effective fire barrier as follows (1) Ten feet from roadways, power poles, and from other like areas (2) Twenty five feet from structures Such areas or widths may be modified if In the opin- ion of the Chief they do not constitute a distinct hazard to life or property Section 11 101 (e) Chief May Prohibit The Chief may prohibit outdoor fire when atmospheric conditions or local circumstances make such fires hazardous No person shall kindle any outdoor fire or authorize such fire to be kindled or maintained even if a permit has been issued when any of the following conditions are in force (1) If the wind velocity is above 10 miles per hour, or (2) If a temperature in version is present or air circulation is insufficient to disperse smoke, gases, and fumes, to the extent neces sary to protect public health It shall be the responsi bility of the permatee to check the local conditions prior to burning by calling the phone number listed on the permit Section 11 101 (f) — All controlled burning r shall comply with the regulations of the Benton/Franklin/Wal- la Walla counties Air Pollu tion Control Authority 18 04 060 — Substitution for Section 11 102 of the UFC Section 11 102 of the Um form Fire Code is hereby omitted and the following shall be substituted in its of dis tricts in which storage of explosives and blasting caps is to be prohibited The lim its referred to in Section 77 106 (b) of the Uniform Fire Code in which storage of explosives and blasting agents is prohibited „is es tablished as follows All use districts except I 1 (Light Industrial) and I 2 (Heavy industrial) 18 04 110 — Substitution for Section 78 102 of the Uniform Fire Code Section 78 102 of the Lint form Fire Code shall be omitted and the following shall be substituted in its place Section 78 102 — Manufac tore, Sale and Discharge of Fireworks (a) The manufacture of fireworks is prohibited with In the City (b) Except as herein pro vided, it shall be unlawful for any person to store, of- fer for sale, expose for sale, sell at retail, or use, fire, or discharge any fireworks (1) The Fire Chief shall have power to adopt rea sonable rules and regu- lations for the granting of Permits for supervised pub lic displays of fireworks by the municipality fair associ ation, amusement parks, and other organizations Every such display shall be handled by a competent op erator approved by the Po lice Chief of the Police Department and the Fire Chief of the Fire Depart- ment of the City of Pasco Every operator shall have first obtained a state li- cense pursuant to RCW 70 77 305 The display shall be of such a character, and so located, discharged or fired as in the opinion of the Fire Chief of the Fire Department, after proper in spection, shall not be haz ardous to property or endanger any person (2) The Fire Chief of the Fire Department may issue each year permits for the sale of safe and sane fire works to persons, corpo- rations, or organizations, after investigation and his determination that the loca tion where the fireworks are to be sold is not haz ardous to property or en- dangers any person and that the persons in charge of selling the fireworks are competent and trained to handle such fireworks No person under the age of eighteen shall be employed by the permittee in con nection with such sale If the Fire Chief of the Fire Department refuses to Issue a permit the applicant shall have the right of appeal (c) Applications for per mits for a public display of fireworks shall be made in writing at least ten days in advance of the display (d) No permit granted hereunder be transferrable (e) Safe and sane fire- works may be issued, fired, or discharged in the City, during the period corn mencing at 12 00 o clock noon on the twenty eighth of June and ending at 12 00 'd clock noon on the sixth rinv_,C-1,11v_exn,h_xonr pm caused either to a person or to property by reason of the permitted display, and arising from any acts, or failure to act of the permit- tee, his agents, employers or subcontractors, unless he is excused from filing such policy by reason of the pro vision of RCW 20 77 355 18 04 130 — Substitution for Section 78 106 of the Uniform Fire Code Section 78 106 of the Uni- form Fire Code shall be omitted and the following shall be substituted in its Place Section 78 106 — Seizure of Fireworks Any member of the Pasco Police or Fire Departments is hereby authorized and empowered to seize, take, remove or cause to be re- moved at the expense of the owner any and all stocks of fireworks offered or exposed for sale, stored, or transported, or held in violation of this article 18 04 140 — Amendments for Section 79 109 of the Uniform Fire Code Section 79 109 of the Uni- form Code is amended by the addition of a new sub section Subsection (c) to read as follows Section 79 109 (c) — Not withstanding any other pro vision of the Uniform Fire Code, flammable and corn bustible liquids used as ma tor fuels may not be stored and dispensed from fixed equipment into the fuel tanks of motor vehicles in any use district classified under Title 22 of the Pasco Zoning Code, as R 1 (Low''' Density), R Is (Suburban), R2, R3 and RMH 123, Use Districts 18 04 150 — Amendment for Section 79 201 of the Uniform Fire Code Section 79 201 of the Uni- form Fire Code is hereby amended to read as follows Section 79 201 — Estab- lishment of Limits of Dis- tricts in Which Storage of Flammable Liquids in Aboveground Tanks is Prohibited (a) The limits referred to in Section 79 201 of the Um form Fire Code, in which storage of flammable liquids in outside, aboveground tanks is prohibited, are es tablished as follows All dis tricts except I I (Light Industrial) and I 2 (Heavy Industrial) 18 04 160 — Amendment for Section 79 601 of the Uniform Fire Code Section 79 601 of the Uni form Fire Code is hereby amended to read as follows Section 79 601 Estab lishment of limits of Dis tricts in which New Bulk Plants for Flammable or Combustible Liquids is prohibited (b) The limits referred to in Section 79 601 of the Uni form Fire Code in which new bulk plants for flam mable or combustible liq uids are prohibited are established as follows, oil use districts except I 1 (Light Industrial) and I 2 (Heavy industrial) 18 04 170 — Substitution for Section 79 709 of the Uniform Fire Code Section 79 709 of the Uni- form Fire Code Subsection 79 709 (b) of the Uniform Fire Code shall be omitted and the access roadway is no more than 45 feet from the building and such yard provides easy access to the building Where access roadways cannot be provided, opprov ed fire protection system or systems shall be provided (d) Where approved fire protection systems are pro vided, the above required clearances may be modified (e) The Chief shall have the authority to require an increase in the minimum access width where such width is not adequate for fire or-rescue operations 18 04 040 — Amendment for Section 10 301 of UFC Section 10 301 Section 10 301 of the Uniform Fire Code is amended to read as follows Section 10 301 (d) When fire protection facilities are to be installed by the devel oper, such facilities includ- ing all surface access roads shall be Installed and made serviceable prior to and during the time of construc- tion When alternate meth- ods of protection, as approved by the Chief, are provided, the above may be modified or waived Fire hydrants connected to an approved water supply sys- tem capable of delivering the required fire flow shall be provided on the public street or on the site of the premises to be protected as required by the Chief, prior to any installation and bonfires approved by the Chief Section 11 112 — (b) Burning confined to incinerators Exceptions All burning shall be done in an approv ed incinerator except that outdoor burning of approved combustible waste matter may be done in the open if (1) A permit to engage in such burning is obtained from the Chief (2) Burning is done at a distance of more than 25 feet from any building and/ or structure 0 A garden hose and water supply or other fire extinguishing equipment is on hand (4) Applicants for such permit must be in legal control of the lot or parcel of land on which the burn ing is to be done (5) None of the following materials shall be burned lawn grass clippings, leaves, garbage, dead ani- mals, asphalt, paper, petro leum products, paints, rubber products plastics, any substance which nor malty emits dense smoke or obnoxious odor (6) All controlled burning fire shall be of a size so as not to constitute a fire hazard to surrounding prop- erty The size of the fire will be determined at and during the inspection for the permit and shall be list ed on the permit Fires on the premises of a residence shall not exceed a size of four feet in diameter or more than para graphs (k) and (1) below (f) Approved "No Smok ing signs shall be posted at conspicuous locations on all four sides of the fire works stand or structure and such other places as may be designated by the inspecting authority Each sign shall have the words ' No Smoking By Order of the State Fire Marshal ' in red letters not less than two inches in height on white background All signs shall be maintained in a legible condition (g) Smoking and the dis charge of fireworks shall be prohibited within twenty five feet of any building or stand in which fireworks are sold at retail or stored after hours (h) Each retail fireworks location shall have not less than two water type ex tinguishers of not less than two and one half gallon capacity (i) There shall be no ac- cumulation of dry grass, Paper, cardboard trash, lumber or other com- bustibles within one hundred feet of any retail fireworks outlet (I) Temporary structures or stands used for the re tail sale of safe and sane fireworks shall be removed from the premises within one week after July 6 of each year Any such stand or structure remaining beyond one week may be removed by the regulating authority at the expense of the permittee or owner (k) Fireworks shall not be sold or given to minor children under the age of eight unless accompanied by the responsible parent or adult (I) It shall be unlawful to use, fire, or discharge any safe and sane fireworks along the route of and dur- ,ing any parade or at any place of public assembly or In any commercial use district (m) It shall be unlawful at any time to throw or toss any safe and sane fire- works at any person, ani- mal vehicle, or other thing or obiect (n) All other rules and regulations of the State Fire Marshall relating to fire works, RCW Chapter 70 77 "State Fireworks Law" in cluding but not limited to rules and regulations adopted pursuant to Chapter 70 77 i) (0) Nothing herein shall be deemed to prohibit the uses for industrial purposes of any explosive or flam- mable compound, blasting caps and similar items 18 04 120 — Substitution for Section 78 103 of the Uniform Fire Code Section 78 103 of the Uni form Fire Code shall be omitted and
