HomeMy WebLinkAbout2139 OrdinanceORDINANCE NO. 2139 , AN ORDINANCE creating a fund for the deposit of monies derived for special parks purposes and providing for the keeping ane expenditure thereof. THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS CHAPTER 3.29- PARK FUND Section 1. That Section 3.29.010 of the Pasco Municipal Code be and the same is hereby enacted to read as follows: P.M.C.3.29.010 PARK FUND. There is hereby established a fund to be called the "Park Fund." All monies derived from the fees collected pursuant to Chapter P.M.C. 21 26 and 22.66 shall be deposited in and disbursed from this fund only. All interest earned that is attributable to monies in the fund shall be deposited in and credited to the fund. Section 2. That Section 3.29.020 of the Pasco Municipal Code be and the same is hereby enacted to read as follows: P.M.C. 3.29.020 PARK PLANNING DISTRICTS. (1) Neighborhood park planning districts are hereby established and identified by numbers one through and including twenty-one with the boundaries as shown on the map attached hereto and incorporated herein by this reference. (2) Community park planning district I shall consist of neighborhood park planning districts one, two, three, four, five, six, seven, eight, nine, ten, eleven, and sixteen. (3) Community park planning district II shall consist of neighborhood park planning districts twelve, thirteen, fourteen, fifteen, seventeen, eighteen, nineteen, twenty, and twenty-one. (4) The park fund shall have separate accounts numbered to correspond to the park planning districts described in this section. Section 3. That Section 3.29.030 of the Pasco Municipal Code be and the same is hereby enacted to read as follows: P.M.C. 3.29.030 DEPOSIT OF MONIES. Ninety percent of all monies derived from the fees collected pursuant to Chapters P.M.C. 21.26 and 22.66 shall be credited to the account corresponding to the neighborhood park planning district from which the fees were derived. Ten percent of all monies derived from the fees collected pursuant to Chapters P.M.C. 21.26 and 22.66 shall be credited to the account corresponding to the community park planning district from which the fees were derived. Section 4, That Section 3.29.040 of the Pasco Municipal Code be and the same is hereby enacted to read as follows- P.M.C. 3.29.040 PARK PURPOSES. As used in this chapter, park purposes shall mean the acquisition of land for park and/or recreational purposes or for major capital improvements to an existing facility, such improvements being of a nature that substantially increases the capacity of or the ability to utilize said facility, or for major capital expenditures to construct new facilities that do not replace existing facilities except to the extent a new facility has greater capacity than the facility it replaced. Park purposes shall not include maintenance and operation or repair or mere replacement of existing facilities. Section 5, That Section 3.29.050 of the Pasco Municipal Code be and the same is hereby enacted to read as follows- P.M.C. 3.290050 EXPENDITURE OF FUNDS. (1) Monies credi ted to a neighborhood park planning district account shall only be expended for park purposes in that district or in that portion of an adjoining district that is within one-half mile of the district boundary. (2) Monies credited to a community park planning district account shall only be expended for park purposes in a community park in that district. "Community park" as used in this chapter shall include the existing Memorial Park and any other park of fifteen acres or larger in size. To be a community park, the park must be utilized in a manner generally consistent with the City's Comprehensive Park and Recreation Plan or as it may be hereafter amended. Community Park shall also include a community park district-wide or community-wide trail system. (3) No monies shall be expended from this fund without the approval of a majority of the City Council. Before ruling on any proposed expenditure, the Council shall receive a report from the City Planner reviewing the proposal for its impact on community planning and from the City Attorney reviewing the proposal for its legality under this ordinance. The Park Director shall provide all needed information for these reviews and shall report on the proposal as it relates to park and recreation plans and needs of the City. Section 6. That Section 3.29.060 of the Pasco Municipal Code be and the same is hereby enacted to read as follows P.M.C. 3.29.060 NEW AREAS. If monies are derived from the fees collected pursuant to Chapters P.M.C. 21.26 and 22.66 from areas not identified in P.M.C. 3.29.020, the Finance Director - E. , Snider, Mayor Pro Tern velyn Wel s, City Clerk -3-- shall identify said monies in an account within the park fund by the legal description of the land from which the monies were derived. The Finance Director shall then notify the City Manager, the Parks Director, and the City Planner of the need to amend the ordinance to include the area from which the monies were derived in neighborhood and community park planning districts. In the event the area is not Included in such districts at the time the monies derived therefrom are to be expended, their expenditure must be in a manner consistent with this ordinance and consistent with the Comprehensive Park Plan in effect at that time.
