ORDINANCE NO. 21 30
AN ORDINANCE approving and confirming the
assessments and assessment roll of Local Improve-
ment District No. 103 which has been created and
established for the the purpose of improving
Hillsboro Street and certain other streets and
avenues within the City of Pasco, Washington,
as provided by Ordinance No. 2017, and levying
and assessing the amount thereof against the
several lots, tracts, parcels of land and other
property shown on the roll.
WHEREAS, the assessment roll levying the special assess-
ments against the properties located in Local Improvement District
No. 103 in the City of Pasco, Washington, created under Ordinance
No. 2017, has been filed with the City Clerk of the City of Pasco,
Washington, as provided by law; and
WHEREAS, notice of the time and place of hearing thereon
and of making objections and protests to the roll was duly od-Aished
at and for the time and in the manner provided by law, fixing the
time and place of hearing thereon for the 28th day of January, 1980,
at 8:00 o'clock p.m. (PST) in the Council Chambers in the City Hall,
Pasco, Washington, and further notice thereof was duly mailed by
the City Clerk to each property owner shown on the roll; and
WHEREAS, at the time and place fixed and designated in
the notice, the hearing was duly held, and all written protests
received were duly considered and overruled, and all persons
appearing who desired to be heard were heard; NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN, as follows:
Section 1. The assessments and assessment roll of Local
Improvement District No. 103, which has been created and established
for the purpose of improving Hillsboro Street and certain other
streets and avenues within the City of Pasco, Washington, in accordance
with standards adopted by the City, including the necessary excavation,
grading, ballasting, asphalt concrete pavement, curb and gutters,
illumination, drainage facilities, domestic water improvements including
installation of the necessary water mains, fire hydrants, valves and
other appurtenances for the purpose of supplying water for domestic
use and fire protection, and sanitary sewer improvements including
installation of the necessary sanitary sewer trunk lines and laterals,
manholes, side sewer service lines and other appurtenances, and all
other work as may be necessary in connection therewith and incidental
thereto, all in accordance with the plans and specifications prepared
by R. R. Jump, Consulting Engineers, Inc., and approved by the City
Engineer, as provided by Ordinance No. 2017, as the same now stand, be
and the same are hereby in all things and respects approved and
confirmed in the total amount of $ 2,040,296.47
Section 2. Each of the lots, tracts, parcels of land and
other property shown upon the roll is hereby determined and declared
to De specially benefited by such improvement in at least the amount
charged against the same and the assessment appearing against the
same is in proportion to the several assessments appearing upon such
roll. There is hereby levied and assessed against each lot, tract,
parcel of land and other property appearing upon such roll the amount
finally charged against the same thereon.
Section 3. The assessment roll as approved and confirmed
shall be filed with the Treasurer of the City of Pasco for collection,
and the City Treasurer is hereby authorized and directed to publish
notice as required by law stating that the roll is in his hands for
collection and payment of any assessment thereon or any portion of
the assessment can be made at any time within thirty days from the
date of the first publication of such notice without penalty, interest
or cost, and that thereafter the sum remaining unpaid may be paid in
ten equal annual installments with interest thereon hereby fixed at
the rate of 83/4% per annum. The first installment of assessments
on the assessment roll shall become due and payable during the thirty-
day period succeeding the date one year after the date of first
publication by the City Treasurer of notice that the assessment roll
is in his hands for collection and annually thereafter each succeeding
installment shall become due and payable in like manner. If the
whole or any portion of the assessments remains unpaid after the
thirty-day period, interest upon the whole unpaid sum shall be charged
at the rate of 8 3/4% per annum and each year thereafter one of the
installments, together with interest due on the whole of the unpaid
balance, shall be collected. Any installment not paid prior to the
expiration of the thirty-day period during which such installment
is due and payable shall thereupon become delinquent. All delinquent

installments shall be subject to a charge for interest at 8 3,44%
per annum and for an additional charge of 6% penalty levied upon
both principal and interest due upon such installment or installments.
The collection of sucn delinquent installments will be enforced in
the manner provided by law.
PASSED by the City Council and APPROVED by the Mayor of
the City of Pasco, Washington, at a regular open public meeting
thereof, this 28th day of January, 1980.
