ORDINANCE NO. 2129
AN ORDINANCE relating to lower rates for water, sewer, and garbage
utility service for low-income senior citizens.
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS:
Section 1. That Section 13.20.040 of the Pasco Municipal Code
(Ordinance No. 1850 §3, 1977) be and the same is hereby amended to
read as follows:
P.M.C. 13.20.040 OTHER MINIMUM MONTHLY RATES. The following
shall be the minimum monthly rate charged on a per dwelling unit basis
for each dwelling unit where a person residing therein shall show
satisfactory proof under oath in writing to the city finance director
of the following:
(1) That he or she is sixty-five years of age or older.
(2) That he or she is a single occupant of or the head of a
household all of whose members have a combined annual income from all
sources that is not greater than the United States federal poverty
level. Such poverty level shall be determined by the "Very Low Income
Limits" and updated annually by the finance director.
(3) The person must be the applicant for the water service
and must be directly responsible for the payment of the water bill.
(4) The person must have resided at such place for a period
of not less than ninety (90) consecutive days prior to the effective
date of the rate set forth below and must intend to remain at such
place.
The person must state under oath that he or she will inform the
city in writing if there is any change in their or the household's stetus
as it relates to the requirements set forth above. The city finance
director may require the person demonstrating satisfactory proof for
a household that qualifies for the rates set forth herein to make an
updated application at any time.
"Head of the household" shall mean the person owning or having
control of the dwelling unit. In the case of a husband and wife, either
person shall be considered the "head of the household."
Dwelling units qualifying as set forth above shall be charged a
monthly rate of one & 25/100 ($1.25) dollars per dwelling unit for the
minimum monthly rate which shall provide for the maximum consumption
of five hundred cubic feet of water. All consumption over that amount
shall be charged at the regular rate.
Section 2. That Section 13.40.050 of the Pasco Municipal Code
(Ordinance No. 1850 §11, 1977) be and the same is hereby amended to
read as follows:

Section 3. That Sub-section 6.04.300(b)(1)(B) of the Pasco
Municipal Code be and the same is hereby amended to read as follows:

(B) A residence customer as qualified below may apply for
and receive a different rate and service. The rate shall be one
& 75/100 ($1.75) dollar per month for the weekly removal of one can or
container per week. To qualify the customer must show satisfactory
proof under oath in writing and otherwise provide satisfactory proof
of the following:

(i) That he or she Is sixty-five years of age or older.
(ii) That he or she is a single occupant of or the head
of a household all of whose members have a combined annual income from
all sources that is not greater than the United States federal poverty
level. Such poverty level shall be determined by the "Very Low Income
Limits" and updated annually by the finance director.
(iii) The person must be the applicant for the garbage
service and must be directly responsible for the payment of the garbage
bill.
(iv) The person must have resided at such residence for a
period of not less than ninety (90) consecutive days prior to the effect
date of the rates set forth above and must intend to remain at such
place.
(v) That one can per week is at least adequate to meet
the normal needs of the residence or separate unit thereof.
The person must state under oath that he or she will inform
the city or the city's garbage contractor in writing If there is any
change in their or the household's status as it relates to the requirements
set forth above. The city finance director or the city's garbage
contractor may require the person demonstrating satisfactory proof for
a residence that qualifies for the rates set forth herein to make an
updated application at any time.
"Head of the household" shall mean the person owning or having
control of the dwelling unit. In the case of a husband and wife, either
person shall be considered the "head of the household."
Section 4. The city hereby agrees to amend its contract with
its garbage contractor to comply with the provisions of Section 3 of
this ordinance and the mayor Is authorized to execute such amendment
to the contract.
Section 5. This ordinance shall be in full force and effect
upon its passage and publication as required by law.
