HomeMy WebLinkAboutRick Terway - Supplemental Employment Agreement - Retirement DeferralSUPPLEMENTAL EMPLOYMENT AGREEMENT (Retirement Deferral) THIS SUPPLEMENTAL EMPLOYMENT AGREEMENT is entered into this p day of`�h '(- 2017, between the City of Pasco, a Washington Municipal Corporation, hereinafter referred to as "City," and Rick Terway, Administrative and Community Services Director, hereinafter referred to as "Mr. Terway." WHEREAS, this Supplemental Employment Agreement is supplementary to that Letter Agreement of Employment dated June 9, 2009, wherein Mr. Terway accepted employment as the Administrative and Community Services (A&CS) Director for the City of Pasco, and provided by its terms, conditions of employment; and WHEREAS, the position of Public Works (PW) Director has been vacated as the result of a resignation, which, due to his experience, training and familiarity with the industry and organization, Mr. Terway provides a significant value to the City; and WHEREAS, the evaluation of the Public Works Department, creation of a position profile and recruitment of a Public Works Director will take several months; and WHEREAS, the Mr. Terway may be eligible for retirement from the City during the term of this Agreement and prior to the completion of recruitment efforts for a Public Works Director and the above -referenced critical projects; and WHEREAS, there are several critical projects commencing immediately and culminating over the 6-12 months within the A&CS and PW Departments that, due to his familiarity and expertise, would benefit from Mr. Terway's continued involvement and oversight; and WHEREAS, it is determined in the best interest of the City that the City, based upon adequate consideration, seek the deferral of the Mr. Terway's eligibility for retirement until the completion of the aforementioned recruitment and substantial progress is made on these pending projects. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the Parties agree as follows: 1. Deferral of Retirement. Mr. Terway hereby agrees to defer his eligibility for retirement from the City for the purpose of accomplishing the goals identified herein during the term of this Agreement. 2. Term of Aereement. This Agreement formalizes a verbal agreement that has been in place since late 2016 and, except as provided in Sections 3 and 4 below, shall commence on the date of execution, and terminate on the 30th day of May, 2018, unless earlier terminated or extended as provided below. Supplemental Employment Agreement, Richard Terway Page 1 i 3. Compensation. As additional compensation, the City shall pay to Mr. Terway the following: 3.1 Compensation. Compensation shall be at the rate of $11,600 per month commencing on the first day of February, 2017, during the term of this Agreement. 3.2 Benefits. Mr. Terway shall be entitled to the following additional benefits: 3.2.1 Management Benefit Package as modified below: 3.2.1.1 Vacation accrual is reduced to 4 weeks annually. 3.2.2 During the term of this agreement, Mr. Terway will not be eligible for a car allowance; however, mileage reimbursement will be allowed for trips in excess of 50 miles from City Hall at the published rate. 4. Additional Duties. hi addition to his regular duties as Administrative and Community Services Director, Mr. Terway shall provide the following services during the term of this Agreement: 4.1 Serve as Interim Public Works Director, leading the Department in the implementation of programs, projects, delivery of services and fulfilling those duties of the Public Works Director as required by Federal, State and City laws, rules and regulations. 4.2 Oversee completion of the feasibility study and preparation of the final design and bid specifications for the new Tri -Cities Animal Control Authority shelter. 4.3 Oversee completion of final design, bid specifications, public outreach efforts and construction of Phase I of Peanut Plaza Park Improvements. 4.4 Complete replacement and/or repairs to the Boat Basin Docks and develop a plan concurrent with the Schlagel Park Master Plan. 4.5 Oversee fast -tracking of the planned interim improvements to the municipal WWTP by the July 1, 2017 deadline. 4.6 Oversee completion of the required facilities and engineering plan for the municipal WWTP. 4.7 Oversee completion of the facilities plan for the Process Water Reuse Facility, implementation of an industrial pre-treatment program, standardize user effluent profiles and cost allocation scheme. 4.8 Continue efforts initiated in 2016 among PW management group utilizing Campbell Consulting; present 2017 work plan for this effort by March 20, 2017. Supplemental Employment Agreement, Richard Terway Page 2 4.9 Coordinate closely with the City Manager's office, Finance Director and Stevan Gorcester of Performance Plane LLC in providing leadership and direction to Department staff in initiating a lean culture into the A&CS and PW Departments. 4.10 Assist in the onboarding and transition of the new Public Works Director and Administrative & Community Services Director, anticipated to occur within the first and second quarters of 2018 respectively. 5. Early Termination. Early termination of this agreement may be accomplished as follows: 5.1 Upon written notice of 30 days to Mr. Terway if in the best interests of the City as determined solely by the City Manager. 5.2 Upon written notice of 30 days to the City Manager by Mr. Terway. 6. Extension. In the event the City Manager determines that it is in the best interest of the City that this agreement be extended beyond the term provided in Section 2 above, this Agreement may be extended by mutual agreement of the parties according to the terms and conditions above, or such other terms as the parties may mutually agree. 7. Remaining Terms. All remaining terms contained in the Letter Agreement of June 9, 2009; and such additional addendums and applicable employment conditions imposed by ordinance, law, or regulation, not inconsistent with the provision of this Agreement, shall remain in full force and effect.
