A RESOLUTION SETTING 7:00 PM, MONDAY, AUGUST 21, 2017 AS THE TWIE
AND DATE TO CONDUCT A PUBLIC HEARING TO CONSIDER VACATING A
PORTION OF WEST OCTAVE STREET AND AUTOPLEX WAY.
WHEREAS, from time to time in response to petitions or in cases where it serves the
general interest of the City, the City Council may vacate right-of-way; and
WHEREAS, a petition for the vacation of a portion of Autoplex Way and West Octave
Street has been submitted to the City; and,
WHEREAS, street vacations in Pasco usually involve undeveloped streets or the excess
margins of developed or partially developed streets; and,
WHEREAS, Autoplex Way and West Octave Street are fully improved streets that were
built and finance through the LID process in 1976; and,
WHEREAS, without a public hearing no determination can be made as to the adverse
impacts the proposed vacation may have on accessibility and traffic circulation or what lasting
benefit the proposal may have on the community in general; and,
WHEREAS, the applicant has not indicated the proposed vacation will result in
substantial property improvements with associated fees and increased property values; and,
WHEREAS, the street vacation process provided in PMC 12.40 requires a title report
and an appraisal of value and compensation unless waived by the City Council; and,
WHEREAS, there is currently no justification for the Council to waive the requirements
of PMC 12.40, and;
WHEREAS, a public hearing is needed for the Council to more fully make a reasoned
determination on the need for compensation to offset the loss of public right-of-way as the result
of the proposed street vacation, and;
WHEREAS, R.C.W. 35.79 requires public hearings on vacations to be fixed by
Resolution, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO:
Section 1. Compensation of Vacated Right -of -Way: Pursuant to PMC 12.40 the City
Council hereby reserves the right to require an appraisal, survey, submittal of a title report and
payment of compensation for the proposed vacation, and;
Section 2. Notice of Hearing: That a public hearing to consider vacating all of Autoplex
Way and West Octave Street between the easterly projection of the north line of Lot 3, Short Plat
81-14 (Parcel #119370262) and the northerly projection of the west line of Tract 9 Auto Park
Addition (Parcel #119370155), will be held before the City Council of the City of Pasco in the
Council Chambers at 525 N. Third Avenue, Pasco, Washington, at the hour of 7:00 p.m., on
August 21, 2017. That the City Clerk of the City of Pasco give notice of said public hearing as
required by law.
