DETERMINATION H EAIUNGS: Chairperson Gottscha lk explain ed the procedure a nd purpose for the meetin g, noting that the City of Pasco was the Petitioner a nd property owners and their authorized representatives who had appeared to discuss th e a ll eged v io lation s of the Pasco Municipal Code were the Respondents. a. Hearings 1. City of Pasco vs. Ruiz, Armando & Antonia case number CEB2017-0281, for the property located at 2905 Bosch Court Troy Hendren , In spection Services Manager, asked Code Enforcement Officer Debra Scott to read the case facts into the record. M s. Scott indicated that the cited violati o ns o n this property were PMC 8.02.030 -2nd Repeat Dogs allowed to roam onto nei g hbori ng prope1ty a nd depos it feca l matter, PMC 8.02.050( I) -2nd Repeat Dogs allowed to roam off owners premises w ith o ut th e owner in contro l o f the a nima ls and PMC 8.02.190 -Unlicensed third dog on s ite . A compla int came in about the dogs . Pictures were take n o n March 16 , 20 17 a nd v iol atio ns of the Pasco Municipal Code were observed and determined to be a repeat violation. On June 23, 20 16 a correction notice was sent for 2 unli censed dogs on s ite, dogs defecating on properties, dogs wanderin g off of the property w ith o ut the owners' s upervi sion. A no ti ce o f c ivi l violat ion was sent for this case on July 11 , 2 016 for non-compliance. The owners agreed to keep the d ogs on s ite and li cen se the 2 dogs. The case was c losed w ith out penalties on Augus t 2, 20 16 . On September 27, 20 16 a repeat notice of civil v io lation was se nt fo r dogs being a ll owed to roam onto neighboring properties, depos it in g fecal matters and th e dogs were a ll owed to roam offs ite without control from their owners. This case was assessed penalties of $2,245. A second repeat notice of civil violation was issued on March 23 , 2017 v ia certified mail. T he property owners were legally notified on March 25, 2017 of the cond iti ons believed to be a second repeat pena lty of the Pasco Municipal Code. Again, th e neighbors provided pictures of th e dogs offs it e and complain ed about the dogs defecating in their yards and thi s time there were now 3 dogs offsite. Ms. Scott stated that she contacted a ll neighbors in vo lved in thi s case on May 4 , 20 17 and none h ave seen the dogs offsite 05042 017 CEB Minutes Page 1of 3 late ly , however they have seen 3 dogs onsite. There are on ly 2 dog li censes at this locatio n. The owners have been taking the dogs out, not on a leash but s upervised by them. Based on a final inspection of the property completed on May 3, 20 17 the property is not in comp li ance at this time. T h e City of Pasco recommended imposing a repeat penalty of $400. CODE BOARD DECISION: Board Member Rawlinson moved, second ed by Board Member G uti errez, that the actions taken by th e C it y were appro priate a nd timely. T h e motion carried unanimously. Board Member Rawlinso n moved , seconded by Board Member Gut ie r rez , to give the respondent I 0 days to abate any remaining violat ions or pay a daily penalty o f $400 per day fo r I 0 d ays and imposing a repeat penalty of $400. T he motio n car ried unanimou sly. 11. City of Pasco vs. La r sen, James, case numbe r CEB2017-0336, for the property located at 9817 Star La ne Troy Hendren, In spectio n Serv ice s Ma nager , asked Code Enfo rcement Officer Martin Barajas to read the case facts into the record. Mr. Barajas indicated th at the c it ed violations o n thi s property were PMC 16.04.0 10 -No permit fo r pl acement of manufactured home that is stored in the s ide yard a nd PMC 25.22 .030(3 ) - Mob il e ho m e that is not approved for occup ancy or storage stored on the property. The property was inspected o n March 14 , 20 17 and violations of th e Pasco Municipal Code were o bserved and a no t ice of c ivil v io lati on was issued on Apri l 6, 2017. The property owner was legall y notified v ia process ser ver on Apri I 13, 20 17. Based o n a final in s pection of the property compl eted on May 3, 20 17 the property is not in complia nce. Mr. Barajas noted th at The C ity of Pasco recommended giving the re s pondent 10 days to abate the vio lations or pay a daily pena lty of $50 per day for I 0 days. Motion Board Member Rawlinson made a motion to approving Resolution No. 2017-005, Board Member Gutierrez seconded. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: F.
