HISTORY AND FACTS BRIEF: A) Mobilitie, LLC, is a telecommunications infrastructure company with headquarters in Newport Beach, CA. Mobilitie has presented the City with a franchise application, intending to locate its facilities in the City’s public right-of-way. The initial application presents 5 locations within the City’s public right-of-way, where utility poles as tall as 63 feet are proposed. B) Washington State statute RCW 35A.47.040 grants the authority to every code city to “permit and regulate under such restrictions and conditions as it may set by charter or ordinance and to grant nonexclusive franchises for the use of public streets, bridges or other public ways structures or places above or below the surface of the ground for railroads and other routes and facilities for public conveyances, for poles, conduits, tunnels, towers and structures, pipes and wires and appurtenances thereof for transmission and distribution of electrical energy, signals and other methods of communication…and other private and publicly owned and op erated facilities for Page 2 of 15 public service. The power hereby granted shall be in addition to the franchise authority granted by general law to cities.” Further, RCW 35A.12.120 states that “(t)he passage of any ordinance, grant or revocation of franchise or license…shall require the affirmative vote of at least a majority of the whole membership of the council.” Washington state law makes it clear that the power to approve or deny applications for franchises within the public right-of-way rests with the legislative body of a city. C) Pasco Municipal Code 15.10.010 provides the City of Pasco City Council’s findings and purpose regarding telecommunications facilities and the City’s rights-of-way. PMC 15.10.010(C) states that the City’s public rights-of-way are a “unique and physically limited resource” requiring “proper management by the City” in order to maximize the efficiency and minimize the costs to the taxpayers of the foregoing uses, protect against foreclosure of future economic expansion because of premature exhaustion of the public rights-of-way as an economic resource, and to minimize negative effects upon the public from such facilities’ construction, emplacement, relocation, and maintenance in the rights-of-way.” PMC 15.10.010(C) further enumerates the City’s intent to “(c)onserve the limited physical capacity of the public ways held in public trust by the City” and “(a)ssure that the City can continue to fairly and responsibly protect the public health, safety and welfare.” D) Pasco Municipal Code 15.10.050(B) sets forth the requirements for an application for franchise within the City’s rights-of-way, stating that “(w)ithin 120 days after receiving a complete application under Pasco Municipal Code Section 15.10.040 for Franchise, the City shall issue a written determination granting or denying the application in whole or in part. Prior to granting or denying a Franchise, the City Council shall conduct a public hearing and make a decision based upon the standards set forth in Pasco Municipal Code Section 15.10.050(A).” Per this section, the City Council is the entity with the authority to grant or deny a franchise application, and such determination shall be based upon the eleven enumerated standards set forth in the code. E) Under Section 15.10.050(A), prior to granting or denying a franchise, the City Council must conduct a public hearing and thereafter issue a written determination based on several specific standards. (To minimize repetition of material, the specific standards are not listed here, but are included in the discussion section below). F) In accordance with RCW 35A.47.040, Council must approve a franchise at a regular meeting and can do so no sooner than five (5) days after its introduction for discussion and initial presentation before Council. Per PMC 15.10.050(B), a written determination is required for denial of any franchise application. V. DISCUSSION: City staff suggests that the Council review the following considerations regarding the standards in PMC 15.10.050(A) in making the pertinent determination: Page 3 of 15 1. Whether the applicant has received all requisite licenses, certificates, and authorizations from the Federal Communications Commission, the Washington Utilities and Transportation Commission, and any other federal or state agency with jurisdiction over the activities proposed by the applicant; (Comments) The City is not currently able to confirm whether the applicant has received all licenses, certificates, and authorizations from the above agencies or any other agency that may have jurisdiction over its proposed activities. However, it is suggested that, in the event the Council chooses to grant a franchise, such grant be conditioned upon the applicant’s providing evidence of all applicable authorizations. 2. The capacity of the public ways to accommodate the applicant's proposed facilities; (Comments) Potentially, at some locations, there is space to accommodate the proposed facilities, but that space is limited and, in some cases, already occupied by existing infrastructure in much of the City. In some cases, the proposed facilities would occupy most, if not all, of the available right-of-way. In some instances, the remaining right-of-way outside of curb, gutter, and sidewalk may be as little as 5.5 feet. The applicant’s current proposed structures include several steel poles that are 63 feet high. They have a 23-inch diameter at the base with a foundation of 35 inches in diameter and 13.5 feet below the ground. This does not take into account the utility pole grounding rods which in their installed placement extend approximately 12 feet from the centerline of the pole foundation. (See attachment 1.) 3. The capacity of the public ways to accommodate additional utility, cable, open video, and telecommunications facilities if the franchise is granted; (Comments) Due to the proposed pole foundation being 35 inches in diameter, not including the grounding rod configuration, there will be very limited room for additional utilities traditionally located within the right-of-way for other traditional franchisees and utility providers delivering services associated with the safety, health and welfare of the community at-large at the proposed locations of the facilities of the applicant. 4. The damage or disruption, if any, of public or private facilities, improvements, service, travel or landscaping if the franchise is granted; (Comments) The installation of the proposed facilities would most certainly cause damage, or at a minimum, disruption of the surrounding public and/or private facilities, but would be monitored and restoration would be required, as with any franchisee working within the City of Pasco right-of-way. 5. The public interest in minimizing the cost and disruption of construction within the public ways; Page 4 of 15 (Comments) The public does have an inherent interest in the minimization of the costs and disruptions associated with right-of-way construction. 6. The service that applicant will provide to the community and region; (Comments) It is unclear, and possibly difficult to measure what service, if any, that the applicant, as a cellular service provider, will provide to the residents of the City of Pasco. It is also important to note that the existing franchisees offer services to all the residents of Pasco, such as power, telephone, cable TV, natural gas, etc. 7. The effect, if any, on public health, safety and welfare if the franchise is granted; (Comments) Consideration should be given to the inherent risks of placing a large, 63 foot x 23-inch, solid, immovable object within the roadway corridor. Traffic safety recommends a “clear zone” area to be considered when designing roadways (see Attachment 2 - Memorandum from DKS Associates). The preferred approach is to go with crash considerate items, such as breakaway signposts, in-road rights-of-way. Additionally, PMC 26.32.100 (see below) requires that utilities, such as power, that was previously located overhead, be placed underground. This is mostly from a safety consideration as above-ground utility poles are immovable and represent a considerable safety concern. 26.32.100 UNDERGROUND UTILITIES. (1) All utility lines serving the subdivision, including but not limited to power, telephone and television cables shall be installed underground. Adequate easements shall be provided for all such utility lines, which will not be located within the right -of -way. 8. The availability of alternate routes and/or locations for the proposed facilities; (Comments) Historically, these types of telecommunications structures have been placed on private parcels for a fee to the property owner. Private parcels remain abundantly available for the placement of large telecommunication structures within the City of Pasco. 9. Applicable federal and state communications laws, regulations and policies; (Comments) The City is not currently aware of applicable federal and state communications laws, regulations and policies that pertain to the decision regarding this application except as noted herein. 10. Such other factors as may demonstrate that the grant to use the public ways will serve the community interest; (Comments) It does not appear that there are other factors which demonstrate that a Page 5 of 15 community interest is served by granting the use of the City’s rights -of-way. Presently, the utilities facilities located in the City’s rights -of-way provide services which are utilized by citizens residing along such rights-of-way, and locating utilities such as sewer, water, and gas lines, among others, in the right-of-way is necessary for the adjacent properties to gain direct access to said utility service. The nexus of service and location is not clearly demonstrated by the current application. 11. Such other and further factors as may be deemed appropriate by the City. (Comments) It is important to consider the potential costs to other private development should a pole need to be relocated for improvements to the frontage of said parcel(s) including roadway widening, construction of curb and gutter, sidewalk and/or underground utilities. PROPOSED LOCATION SUMMARY The applicant is currently proposing to locate utility poles at five (5) locations throughout the City as follows (See Attachment 3): 1. 14th Avenue and West Henry - Wood Pole - Total Height 28’ 2. 6605 Burden Boulevard - Wood Pole - Total Height 37’ 3. 7421 Sandifur Parkway - Steel Pole - Total Height 63’ 4. 17th Avenue and West Sylvester Street - Steel Pole - Total Height 63’ 5. Madison Avenue and Hartford Drive - Steel Pole - Total Height 63’ Staff notes that while the proposed wood poles are comparable in height and size as typically found in existing utility poles, most particularly in the older parts of the community which were installed prior to undergrounding requirements, the proposed steel structures are of such a scale as to provide an imposing view and safety consideration on the traveling public (See Attachment 4). Staff would further note that the City, in partnership with Franklin County PUD, expends in excess of $100,000 annually to underground power distributions systems in large part to eliminate the hazard(s) presented by the existence of even wood utility poles within the public road right-of-way. STAFF RECOMMENDATION Although there is public right-of-way capacity that could be utilized by the applicant, it is the City staff’s recommendation that the application for franchise be rejected on the grounds that the service provided does not specifically and identifiably benefit the residents of the City of Pasco; that the amount of available public right-of-way is limited and the franchisee’s structures prevent future use of the right-of-way; that the structures as proposed constitute a potential traffic hazard being placed within the “Clear Zone” of the traveling public; and there exists adequate property for the applicant to locate such structures within private property and away from any of the listed concerns.
