A RESOLUTION SEITING 7:00 PM, MONDAY, APRIL 17, 2017 AS THE TIME
AND DA TE TO CONDUCT A PUBLIC HEARING TO CONSIDER VACA TING A
PORTION OF COMMERCIAL A VENUE .
WHEREAS, from time to time in response to petitions or in cases where it serves the
general interest of the City, the City Council may vaca te right-of-way; and
WHEREAS, a petition for the vacation of a portion of Commercial A venue ha s been
submitted to the City; and ,
WHEREAS, the street vacation process provided in PMC 12.40 requires a title report
and an apprai sa l of v alue and co mp ensation unl ess waived by the City Council; and ,
WHEREAS, the City Council may waive the requirement for a titl e report , an appraisal
of v alue and compensation if the resulting benefit to the community from the projec t requiring
the vacation outweighs the appraised value of the right-of-way to be vacated ; and,
WHEREAS, the ap plic ant previously provided the City with a perpetual exclus ive
easement with an adjoining access easement for the PK Hi ghw ay lift station at no cost to th e
City; and,
WHEREAS, the applicant wi ll be dedic ating and improving one to two additional street s
improving circulation in the area and current development adjacent to the proposed vacation area
has re sulted in th e addition $2,670,000 in prope1ty va lue along with $38,000 in permit fees and
additional utility taxes ; and,
WHEREAS, the va lue of the right-of-way proposed for vacation will be completely off-
set by th e dedi cati on a new fully developed 60 foot right-of-way, and ;
WHEREAS, the new deve lopment will result in significant b ene fit s that will have a
lasting impac t on the community; and,
WHEREAS, R.C.W . 35.79 requires publi c hearings on vacations to be fixed b y
Resolution, NOW, THEREFORE,
B E I T RESOLVED BY THE C ITY COUNCIL OF THE CITY OF PASCO:
Section l. Wavier of Requirements: That pursuant to PMC 12 . 40.120 B . the City
Council her eby waives the requirement for an appraisa l, titl e report and payment of
compensation for the proposed Commerc ial A venue vacation, and;
Section 2. Notice of Hearing: That a public hearing to consider vacating the east 30 feet
ofNorth Commercial Avenue adjacent a portion of Lot 1, BSP 2013-04 and Lot 1, BSP 20 16-0 1
and the northerly 61.5 feet of Lot 2, BSP 20 16-0 1 together with the east 15 of North Commercial
Avenue adj acent to Lot 3 , BSP 20 16 a nd Lot 3 and a portion of Lot 1, BSP 20 13-04, w ill be held
before the C ity Council of the City of Pasco in the Council Chambers at 525 N. Third A v enue,
Pasco, Washington, at the hour of 7:00 p.m., on April 17 , 2017. That the City Clerk of the C it y
of Pasco give notice of said public hearing as required by la w.
