AGREEMENT
CITY OF PASCO and PORT OF PASCO
SEWER RATES FOR DISCHARGES FROM THE TRI -CITIES AIRPORT
DEICING WASTE TREATMENT FACILITY
By this Agreement entered into this 1 p day of 2010, the City of Pasco (City)
will allow the Port of Pasco (Port) to discharge into the Cis sewer collection system from the
Tri -Cities Airport Deicing Waste Treatment Facility.
This Agreement and sewer rate is in accordance with PMC Section 13.40.020, Monthly Charges.
The Port has constructed a Deicing Waste Treatment Facility and has been monitoring the water
effluent. The waste characteristics are:

Since the discharge flows are seasonal and no City water is used in the collection or treatment of
the deicing treatment, it is mutually agreed that a twelve (12) month sewer rate be based on the
above waste characteristic and shall be considered the equivalent to four (4) commercial sewer
customers without a water use charge.
The monthly sewer charges shall be based on the City's most current commercial rate. The
current rate is $36.79 per month. The monthly rate for the Deicing Facility is $147.12 per month
or $1,765.44 per year. The City upon increase of the monthly sewer charges and rate structure
shall provide Port sixty (60) days notice.
The Port shall provide the City an annual report on the waste characteristic discharged to the
sewer system by the first of May of each year. The monthly and annual rate for the Deicing
Facility shall be recalculated each year based on the waste characteristics provided in the annual
report. Such rate changes shall not require sixty (60) days advance written notice.

In the event of a dispute regarding the terms of this Agreement, the Chief Executive Officers of
the City and the Port shall meet in a good faith attempt to resolve such dispute prior to exercising
any other legal or equitable right of enforcement.
