Chairperson Glatt called the regular meeting of the Code Enforcement Board to order at 7:00 p.m.

Board Member Gutierrez moved, seconded by Board Member Rawlinson, that the minutes of the
November 3, 2016 meeting be approved. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Glatt explained the procedure and purpose for the meeting, noting that the City of Pasco was
the Petitioner and property owners and their authorized representatives who had appeared to discuss the
alleged violations of the Pasco Municipal Code were the Respondents.
a. Hearings
i. City of Pasco vs. Weber, Phil, case number CEB2016-2676, for the property located at 3720
W. Leola Street
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to
read the case facts into the record.
Mr. Torres indicated that the cited violations on this property were PMC 25.24.030 (6) — More
than three dogs on site, PMC 8.02.190 — Failure to license dogs and PMC 8.02340 — Habitual
dog barking. On September 21, 2016 a police officer was called to this property regarding
barking dogs at around 2:47 p.m. The officer confirmed barking and noticed 5 dogs at this
property. Barking was again confirmed by a code officer and a correction notice was sent and a
copy was delivered to the property. On September 28, 2016 the tenant, Phil Weber, called the
Code Enforcement Office stating that he would put bark collars on the dogs and confirmed that
he had 5 dogs. Mr. Torres informed him that he could only have 3 dogs on the property. He said
that he would have to move out of the city limits because he was not going to remove 2 dogs. On
October 11, 2016 the complainant called to notify the City of the dog barking. Mr. Torres could
hear the dogs in the background of the phone call. He notified the complainant that the notice
had been issued and the owner was working on the issue to minimize the barking. On November
10, 2016 the complainant called and dogs were again barking. A notice of civil violation was
issued at this time. On November 16, 2016, Mr. Torres drove by the property and the dogs were
in the backyard barking. The barking lasted no longer than 5 minutes. On November 8, 2016 the
complainant called and the dogs were barking. On November 19, 2016 a police call was made
and a video was taken by the complainant. On December 2, 2016, Mr. Torres drove by the
property and the dogs were in the backyard barking. On December 3, 2016 a video was taken by

the complainant again. Mr. Torres made contact with 3 neighbors on separate instances and the
neighbors said they would hear the barking but it was never for longer than 5 minutes and didn't
find the barking to be an issue. Typically the dogs bark when school children are walking by the
property or when there are other dogs walking by. Once they pass, the dogs would quiet down.
Based on the final inspection of the property completed on December 8, 2016 the property is not
in compliance at this time.
The City of Pasco recommended giving the respondent 10 days to abate the violations or pay a
daily penalty of$100 per day for 10 days.
Phil Weber, 3720 W. Leola Street, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Gutierrez moved, seconded by Board Member
Rawlinson, that the actions taken by the City were appropriate and timely for PMC 25.24.030 (6)
and PMC 8.02.190 but no proof of a violation for PMC 8.02.340. The motion carried
unanimously.
Board Member Rawlinson moved, seconded by Board Member Gutierrez, to give the respondent
10 days to abate the violation or pay a daily penalty of$100 per day for 10 days. The motion
carried unanimously.
ii. City of Pasco vs. Lone, Nicole, case number CEB2016-2853, for the property located at
6419 Penrose Point Drive
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to
read the case facts into the record.
Mr. Torres indicated that the cited violation on this property was PMC 8.02.190 — Failure to
renew dog license.
The City of Pasco recommended imposing a repeat penalty of$200.
Nicole Long, 6419 Penrose Point Drive, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Rawlinson moved, seconded by Board Member
Gutierrez, that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Rawlinson moved, seconded by Board Member Gutierrez, to impose a repeat
penalty of$200. The motion carried 2 to 1 with Board Member Glatt dissenting.
iii. City of Pasco vs. Rosenow, Ernest, case number CEB2016-2894, for the property located at
4217 Finnhorse bane
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Alonso Torres to
read the case facts into the record.
Mr. Torres indicated that the cited violation on this property was PMC 8.02.190 — Failure to
renew dog license.

CODE BOARD DECISION: Board Member Rawlinson moved, seconded by Board Member
Gutierrez, that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Gutierrez moved, seconded by Board Member Rawlinson, to impose a repeat
penalty of$200. The motion carried unanimously.
iv. City of Pasco vs. Larson, Christopher, case number CEB2016-2914, for the property
located at 5516 Koufax Lane
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Debbie Scott to
read the case facts into the record.
Ms. Scott indicated that the cited violation on this property was PMC 8.02.190—Failure to renew
dog license.
The City of Pasco recommended imposing a repeat penalty of$200.
Christopher Larson, 5516 Koufax Lane, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Rawlinson moved, seconded by Board Member
Gutierrez, that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Gutierrez moved, seconded by Board Member Rawlinson, to impose a repeat
penalty of$200. The motion carried unanimously.
v. City of Pasco vs. Garcia, Riaoberto, case numher CEB2016-2932, for the property located
at 1304 E. Lewis Street
Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer Debbie Scott to
read the case facts into the record.
Ms. Scott indicated that the cited violations on this property were PMC 16.04.010 —No permit
for cement, buried tank or underground water line, PMC 5.10A.090 — Expired license tabs, no
access to bathroom at B & L Machine, illegal gray water holding tank, no verification of potable
water source and buried lines and PMC 5.10A.100 (B) — B & L Automotive Machine is not
operating with regular operating hours.
The City of Pasco recommended imposing a repeat penalty of$500.
Rigoberto Garcia, 1304 E. Lewis Street, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Gottschalk moved, seconded by Board Member
Gutierrez, that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
