It is mutually agreed by both parties that this Change Order fully describes the change(s) that is (are) being
made and that the compensation for this Change Order is full and complete and is the only compensation
due or owing for this Change Order. Further, it is mutually agreed that this document will supplement the
present Contract Documents and that the provisions of the previously executed Contract Documents shall
apply to this Change Order.

Re: Change Order #1, Oregon Avenue Waterline — Sawcutting & Asphalt Disposal
Change Order No. 1 reflects the revisions to the Oregon Avenue Waterline project listed below. This change
order was negotiated by the City and Contractor to address a change in condition.
The City was notified of a change in condition for additional asphalt thickness. After reviewing the Contractors
request we agreed that a reasonable person could interpret Detail 2, sheet 16 to mean that the proposed 8"
depth of asphalt replacement is meant to replace an existing asphalt with similar to equal depth, and that the
existing 12" of asphalt in Oregon Avenue resulted in a change in condition.
The original change request was for $117,386.15, after negotiation and the removal of work items which
should not have been included in the original change order, the contractor has resubmitted the change
request with the agreed upon changes.
Staff recommends approving Change Order #1 for $56,751.71 plus tax, and an additional 15 contract days
for work associated with this change order.
